Ir-Regolament tal-Kummissijoni (KEE) Nru 1460/96

li jistabbilixxi regoli dettaljati għall-implimentazzjoni tal-ftehim preferenzjali dwar il-kummerċ li japplika għal ċerti prodotti li jirriżultaw mill-ipproċessar ta’ prodotti agrikoli, kif provdut fl-Artikolu 7 tar-Regolament tal-Kunsill (KE) Nru 3448/93

IL-KUMMISSJONI TAL-KOMUNITAJIET EWROPEJ,

Wara li kkunsidrat it-Trattat li jistabbilixxi l-Komunità Ewropea,

Wara li kkunsidrat ir-Regolament tal-Kunsill (KE) Nru 3448/93 tas-6 ta' Diċembru 1993 li jistabbilixxi arranġamenti kummerċjali li japplikaw għal ċerti prodotti li jirriżultaw mill-ipproċessar ta’ prodotti agrikoli [1], u b’mod partikolari l-Artikoli 7, 13 u 16 miġjuba fih,

Billi l-Komunità ikkonkludiet diversi patti ta’ ftehim ma’ pajjiżi terzi li jipprovdu għall-applikazzjoni ta’ komponenti agrikoli mnaqqsa b’relazzjoni mal-komponenti agrikoli ffissati mit-Tariffa Doganali Komuni;

Billi l-eliġibilità għal dawn ir-rati mnaqqsa ta’ dazju hija soġġetta għall-kondizzjoni li l-prodotti joriġinaw minn dawn il-pajjiżi preferenzjali; billi jixraq li f’ ċerti każi jiġi speċifikat liema regoli dwar l-oriġini għandhom japplikaw;

Billi l-eliġibilità għal dawn ir-rati mnaqqsa ta’ dazju, hija mogħtija ġeneralment f’limiti ta’ kwota; billi huwa xieraq li jinfetħu l-kwoti u li jiġu speċifikati regoli dettaljati għall-implimentazzjoni ta’ dawn il-kwoti, partikolarment sabiex jiġi garantit aċċess ugwali u kontinwu mill-importaturi kollha tal-Komunità min-naħa ’l waħda u l-applikazzjoni immedjata, fl-Istati Membri kollha, tat-tariffi mniżżla għall-kwoti, sakemm il-kwoti jiġu eżawriti min-naħa ’l oħra; billi sabiex tkun żgurata l-amministrazzjoni effettiva komuni ta’ dawk il-kwoti, m’ hemm l-ebda raġuni li twaqqaf lill-Istati Membri milli jkunu awtorizzati sabiex jirtiraw il-kwantitajiet meħtieġa li jikkorrispondu ma’ l-importazzjoni attwali mill-volumi tal-kwoti; billi, madanakollu, tali metodu ta’ amministrazzjoni jeħtieġ ko-operazzjoni mill-qrib bejn l-Istati Membri u l-Kummissjoni li għandha b’mod partikolari tikkontrolla r-rata li biha jkunu intużaw il-volumi tal-kwoti u li tinforma b’dan lill-Istati Membri;

Billi r-Renju tal-Belġju, ir-Renju ta’ l-Olanda u l-Gran Dukat tal-Lussemburgu huma rappresentati mill-Unjoni Ekonomika tal-Benelux, kull operazzjoni li għandha x’taqsam ma’ l-amministrazzjoni ta’ dawn il-miżuri tista’ titwettaq minn kwalunkwe mill-Membri tagħha;

Billi t-tnaqqis mogħti huwa ġeneralment stabbilit billi jitnaqqsu l-ammonti bażiċi wżati biex jiġu kalkolati l-komponenti agrikoli li japplikaw għal ċerti oġġetti speċifiċi; billi minħabba li t-tariffi ġew stabbiliti matul n-negozjati ta’ l-Uruguay Round, il-komponenti agrikoli tat-Tariffa Doganali tal-Komunità jiġu ffissati kif inhuma u mhux aktar skond il-kwantità ta’ prodotti bażiċi stabbilita skond l-Artikolu 13 tar-Regolament (KE) Nru 3448/93;

Billi sabiex jiġu kkalkolati l-komponenti agrikoli mnaqqsa, dawn il-kwantitatjiet għandhom jinżammu għall-kummerċ preferenzjali;

Billi r-Regolament tal-Kummissjoni (KEE) Nru 3238/94 [2], kif l-aħħar emendat bir-Regolament (KE) Nru 478/96 [3], jipprovdi għall-istabbiliment u l-amministrazzjoni tal-komponenti varjabbli għal ċerti oġġetti li joriġinaw mill-pajjiżi tal-Ewropa ċentrali u tal-lvant li jjirriżultaw mill-ipproċesar ta’ prodotti agrikoli msemmija fl-Annessi li jinsabu mar-Regolament (KE) Nru 3448/93; billi, mid-dħul fis-seħħ ta’ dan ir-Regolament, il-komponenti verjabbli ġew sostitwiti b’komponenti agrikoli ffissati fit-tariffa tal-Komunità; billi dan ir-Regolament kellu jiġi temporanjament supplimentat għal xi żmien bir-Regolament tal-Kummissjoni (KEE) Nru 1200/95 [4];

Billi r-Regolament tal-Kummissjoni (KEE) Nru 1294/94 tat-3 ta’ Ġunju 1994 dwar il-miżuri ta’ implimentazzjoni ta’ l-arranġamenti tal-kummerċ li jgħoddu għal ċerti prodotti li jirriżultaw mill-ipproċessar ta’ prodotti agrikoli [5] ma għadux applikabbli għall-prodotti mportati barra mill-patti ta’ ftehim preferenzjali;

Billi komponenti agrikoli mnaqqsa ġew introdotti fil-kummerċ ma’ pajjizi terzi; billi għall-raġunijiet ta’ ċarezza, huwa meħtieġ li jkun hemm regolament wieħed li jirrelata ma’ d-disposizzjonijiet speċifiċi li japplikaw għall-kummerċ msemmi fl-Artikoli 6 u 7 tar-Regolament (KE) Nru 3448/93; billi r-Regolamenti (KE) Nru 1294/94 u (KE) Nru 3238/94 għandhom għalhekk jiġu mħassara;

Billi l-Artikolu 6 (3) tar-Regolament (KE) Nru 3448/93 jipprovdi li d-dazji ad valorem li jikkorispondu mal-komponent agrikolu jistgħu jiġu sostitwiti b’ammont speċifiku fejn hekk jipprovdi l-ftehim preferenzjali; billi dan l-ammont m’ għandux, madanakollu, jeċċedi t-tariffa li tapplika għall-kummerċ mhux preferenzjali;

Billi l-miżuri pprovduti f'dan ir-Regolament huma skond l-opinjoni tal-Kumitat ta' Ġestjoni għal kwistjonijiet orizzontali li jikkonċernaw il-kummerċ fi prodotti agrikoli pproċessati li m’ humiex elenkati fl-Anness II,

ADOTTAT DAN IR-REGOLAMENT:

Artikolu 1

Dan ir-Regolament jistabbilixxi r-regoli għall-istabbiliment tal-komponenti agrikoli mnaqqsa msemmija fl-Artikolu 7 tar-Regolament (KE) Nru 3448/93 u għall-immaniġġar tal-kwoti miftuħa skond il-patti ta’ ftehim preferenzjali applikabbli għall-prodotti u oġġetti li jaqgħu taħt ir-Regolament (KE) Nru 3448/93.

Artikolu 2

Għall-fini ta’ l-istabbiliment tal-komponenti agrikoli mnaqqsa, l-prodotti bażiċi li ġejjin għandhom jiġu konsidrati:

- qamħ kommuni,

- qamħ tad-durum,

- sikrana,

- xgħir,

- qamħirrun, barra milli għaż-żriegħ,

- ross tal-qamħa twila imqaxxar, hawnhekk iżjed ’l quddiem imsejjaħ "ross",

- zokkor abjad,

- għasel iswed,

- trab tal-ħalib b’kontenut ta’ xaħam skond il-piż li ma jaqbiżx il-1,5 %, mingħajr zokkor jew xi ingredjent ieħor li jagħti l-ħlewwa u f’ippakkjar immedjat b’kontenut nett ta’ aktar minn 2,5 kilogramm, hawnhekk iżjed ’l quddiem imsejjaħ "PG 2",

- trab tal-ħalib b’kontenut ta’ xaħam skond il-piż ta’ 26 %, mingħajr zokkor jew ingredjent ieħor li jagħti l-ħlewwa miżjud u f’ ippakkjar immedjat b’kontentut nett ta’aktar minn 2,5 kilogramm, hawnhekk iżjed ’l quddiem imsejjaħ "PG 3",

- butir, b’kontenut ta’ xaħam skond il-piż ta’ 82 %, hawnhekk iżjed ’l quddiem imsejjaħ "PG 6".

Artikolu 3

Il-komponenti agrikoli mnaqqsa koperti b’dan ir-Regolament għandhom jiġu kalkolati fuq il-bażi tal-kwantitajiet ta’ prodotti bażiċi konsidrati li ġew użati fil-manifattura ta’ l-oġġetti koperti b’dan ir-Regolament. Dawn il-kwantitajiet għandhom jiġu ffissati fl-Anness I fir-rigward ta’ l-ispeċifikazzjonijiet relevanti fin-nomenklatura maqgħuda.

Għal oġġetti li jaqgħu taħt il-kodiċi tan-nomenklatura maqgħuda u li jirreferi għalihom l-Anness I li jinsab ma’ dan ir-Regolament, dawn il-kwantitajiet għandhom ikunu kif murija fl-Anness II. Għal dawn l-oġġetti msemmija l-aħħar, japplika kodiċi addizzjonali, skond il-komposizzjoni tal-prodotti, kif muri fl-Anness III.

Artikolu 4

Il-kwantitajiet ta’ zokkor u ċereali li għandu jingħata kont tagħhom fil-kalkolu tad-dazji addizzjonali mnaqqsa (AD S/Z) u fuq id-dqiq (AD F/M) għal oġġetti koperti bl-Anness II għandhom ikunu kif muri fil-punti B u C ta’ l-Anness II, għal kontenuti partikolari ta’ sukrosju, zokkor invertit u/jew isoglukosju, u ta’ lamtu u/jew il-glukosju, rispettivament. Għal oġġetti oħra, dawn id-dazji addizzjonali għandhom jinkisbu billi jiġu konsidrat biss il-prodotti bażiċi li jaqgħu taħt jew is-settur taz-zokkor jew taċ-ċereali.

Artikolu 5

1. Il-komponenti agrikoli mnaqqsa u fejn xieraq, id-dazji mnaqqsa addizzjonali, li japplikaw għal kull prodott eliġibbli għal dan it-tnaqqis fid-dazju, jinkisbu bil-moltiplikazzjoni tal-kwanitajiet tal-prodotti relevanti bażiċi wżati bl-ammont bażiku msemmi fil-paragrafu 2 u billi jiżdieda dawn l-ammonti għall-prodotti bażiċi relevanti wżati f’dan il-prodott.

2. L-ammont bażiku li għandu jingħata kont tiegħu fil-kalkolu tal-komponenti agrikoli mnaqqsa u, fejn xieraq, id-dazji addizzjonali mnaqqsa, għandu jkun l-ammont ffissat f’ecu li għalih jipprovdi l-ftehim relevanti jew stabbilit skond dak il-ftehim.

3. Meta ftehim preferenzjali jipprovdi għal tnaqqis fir-rati tal-komponenti agrikoli skond l-oġġett minflok tnaqqis fl-ammonti bażiċi, il-komponenti agrikoli mnaqqsa jiġu kkalkolati billi jingħata kont tal-komponenti agrikoli ffissati mit-Tariffa Doganali tal-Komunità u bl-applikazzjoni tat-tnaqqis li jipprovdi għalih il-ftehim li jirrelata mal-pajjiż konċernat.

4. Fil-każi fejn il-komponent agrikolu mnaqqas u, fejn meħtieġ, id-dazji mnaqqsa addizzjonali, stabbiliti skond il-paragrafu 1, ikunu inqas minn ECU 2,4/100 kilogramm, dak il-komponenti u/jew dazju għandu jiġi ffissat bħala żero.

5. L-ammonti stabbiliti skond dan l-Artikolu għandhom jiġu ppubblikati mill-Kummissjoni fl-Ġurnal Uffiċjali tal-Komunitajiet Ewropej. Ħlief kif xort’oħra provdut fil-ftehim mal-pajjiż relevanti, l-ammonti għandhom japplikaw mill-1 ta’ Lulju sat-30 ta’ Ġunju tas-sena ta’ wara. Madanakollu, jekk kemm id-dazji u l-koeffiċjenti applikabbli għall-prodotti bażiċi ma jinbidlux, il-Kummissjoni ma tibidilx l-ammonti stabbiliti skond dan l-Artikolu, u għandha tippubblika din l-informazzjoni fil-Ġurnal Uffiċjali tal-Komunitajiet Ewropej.

Artikolu 6

1. L-oġġetti eliġibbli għall-komponenti agrikola mnaqqsa u, fejn meħtieġ, għal dazju addizzjonali mnaqqsa jew tnaqqis fid-dazji fil-limiti tal-kwoti għandhom jitniżżlu fil-ftehim jew jiġu stabbiliti skond il-ftehim li jirrelata mal-pajjiż relevanti.

2. Fejn dan it-tnaqqis japplika fil-limiti tal-kwota, din il-kwota għandha tiġi ffissata jew stabbilita skond il-ftehim relevanti.

Artikolu 7

Fejn ftehim jipprovdi għall-applikazzjoni ta’ ammont speċifiku, sew jekk suġġett għat-tnaqqis taħt kwota jew le, u fejn it-Tariffa Doganali Komuni tal-Kommunità tipprovdi għall-applikazzjoni ta’ dazju ad valorem, l-ammont li għandu jitħallas ma jistax jeċċedi l-massimu bir-rata tat-tariffa doganali tal-Komunità.

Artikolu 8

1. Għall-fini ta’ dan ir-Regolament "oġġetti li joriġinaw" għandha tfisser oġġetti li jissodisfaw il-kondizzjonijiet stabbiliti bil:

(a) Protokoll 4 anness mal-Ftehim Ewropew bejn il-Komunitajiet Ewropej u rispettivament:

- il-Polonja,

- l-Ungerija,

- ir-Rumanija,

- il-Bulgarija,

- ir-Repubblika Ċeka,

- ir-Repubblika tas-Slovakkja;

(b) il-Protokoll 3 anness mal-patti ta’ Ftehim mal-:

- Lituwanja,

- Latvja,

- Estonja;

(ċ) il-Protokoll 3 tal-Ftehim dwar il-Kummerċ Ħieles ma’:

- l-Isvizzera,

- n-Norveġja,

- l-Islanda;

(d) il-Protokoll 4 anness mal-Ftehim Temporanju bejn il-Komunità Ewropea u l-Istat ta’ l-Iżrael.

2. Fil-kummerċ mat-Turkija, id-disposizzjonijiet ta’ l-Artikoli 17 sa 23 tad-Deċiżjoni tal-Kunsill Nru 96/142/KE [6], id-Deċiżjoni Nru 1/95 tal-Kunsill ta’ Assoċjazzjoni bejn l-KE u t-Turkija tat-22 ta’ Diċembru 1995 dwar l-implimentazzjoni tal-fażi finali ta’ l-Unjoni Doganali japplikaw.

Artikolu 9

Għall-kwantitajiet li jeċċedu l-kwoti stabbiliti, l-komponenti agrikoli li japplikaw għall-prodotti li jaqgħu taħt l-Anness B li jinsab mar-Regolament (KE) Nru 3448/93 iżda li ma humiex koperti bid-disposizzjonijiet speċifiċi li jirrelataw mal-kummerċ f’dawk l-oġġetti fil-pajjiż konċernat u l-komponenti agrikoli li japplikaw għall-oġġetti koperti b’dawn id-disposizzjonijiet għandhom ikunu dawk tat-Tariffa Doganali Komuni.

Jekk il-kwota tikkonċerna tnaqqis tad-dazji ad valorem, id-dazji applikabbli għal dawk l-oġġetti għall-kwantitajiet li jeċċedu l-kwoti koperti biid-disposizzjonijiet imsemmija hawn fuq għandhom ikunu dawk tat-Tariffa Doganali Komuni jew dawk provduti fil-ftehim.

Artikolu 10

1. Il-kwoti tat-tariffi koperti b’dan ir-Regolament għandhom ikunu amministrati mill-Kummissjoni li tista’ tieħu dawk il-miżuri amministrattivi xierqa sabiex tiżgura li jkun hemm immaniġġar effiċjenti.

2. Fejn importatur jippresenta dikjarazzjoni ta’ rilaxx għaċ-ċirkolazzjoni ħielsa fi Stat Membru li tindkludi applikazzjoni għal trattament preferenzjali ta’ oġġetti koperti b’dan ir-Regolament u meta dik id-dikjarazzjoni tiġi aċċettata mill-awtoritajiet doganali, l-Istat Membru konċernat għandu jirtira, permezz ta’ notifikazzjoni lill-Kummissjoni, kwantità li tikkorrispondi mal-ħtiġiet tiegħu mill-volum ta’ kwota kkonċernat.

L-applikazzjonijiet sabiex isir irtirar mill-kwota b’indikazzjoni tad-data ta’ aċċettazzjoni tad-dikjarazzjoni għandhom jintbagħtu lill-Kummissjoni, mingħajr dewmien.

Irtirar għandu jkun permess mill-Kummissjoni skond id-data meta tkun ġiet milqugħa d-dikjarazzjoni tar-rilaxx għaċ-ċirkolazzjoni ħielsa mill-awtoritajiet doganali ta’ l-Istat Membru konċernat, fejn il-bilanċ disponibbli jippermetti dan.

3. Meta l-Istat Membru ma jużax il-kwantitajiet irtirati, huwa għandu jibgħathom lura mill-aktar fis possibbli lill-volum relevanti ta’ kwota.

4. Jekk il-kwantitajiet mitluba jeċċedu l-bilanċ disponibbli tal-volum tal-kwota, huma għandhom jitqassmu proporzjonalment skond l-applikazzjonijiet. Il-Kummissjoni għandha tinforma lill-Istati Membri dwar l-irtirar li jsir.

Artikolu 11

Ir-Regolamenti (KE) Nru 1294/94 u (KE) Nru 3238/94 huma b’dan mħassra. i

Artikolu 12

Dan ir-Regolament għandu jidħol fis-seħħ fit-tielet jum mill-pubblikazzjoni tiegħu fil-Ġurnal Uffiċjali tal-Komunitajiet Ewropej.

Għandu japplika b’effett mill-1 ta’ Lulju 1996.

Dan ir-Regolament għandu jorbot fl-intier tiegħu u japplika direttament fl-Istati Membri kollha.

[1] Starch/glucoseThe content of the goods (as presented) in starch, its degradation products, i.e. all the polymers of glucose, and the glucose, determined as glucose and expressed as starch (on a dry matter basis, 100 % purity; factor for conversion of glucose to starch: 0,9).However, where a mixture of glucose and fructose is declared (in whatever form) and/or is found to be present in the goods, the amount of glucose to be included in the above calculation is that which is in excess of the fructose content of the goods.

[2] Sucrose/invert sugar/isoglucoseThe content of the goods (as presented), in sucrose, together with the sucrose which results from expressing as sucrose any mixture of glucose and fructose (the arithmetical sum of the amounts of these two sugars multiplied by 0,95), which is declared (in whatever form) and/or found to be present in the goods.However, where the fructose content of the goods is less than the glucose content, the amount of glucose to be included in the above calculation shall be amount equal, by weight, to that of fructose.Note:In all cases, where a hydrolysis product of lactose is declared, and/or galactose is found to be present among the sugars, then the amount of glucose equal to that of galactose is deducted from the total glucose content before any other calculations are carried out.

[3] Milk proteinsCaseins and/or caseinates forming part of goods shall not be regarded as milk proteins if the goods do not have any constituent of lactic origin.Milk fat contained in the goods at less than 1 %, and lactose at less than 1 %, by weight, are not considered as other constituent of lactic origin.When custums formalities are completed, the person concerned must include in the appropriate declaration: "only milk ingredient: casein/caseinate", if such is the case.
