DEĊIŻJONI TAL-KUNSILL

tat-22 ta’ Diċembru 2009

li temenda n-network ta' konsultazzjoni ta' Schengen (Speċifikazzjonijiet Tekniċi)

IL-KUNSILL TAL-UNJONI EWROPEA,

Wara li kkunsidra r-Regolament tal-Kunsill (KE) Nru 789/2001 tal-24 ta’ April 2001 li jirriserva lill-Kunsill il-poteri ta' implimentazzjoni rigward ċerti dispożizzjonijiet dettaljati u proċeduri prattiċi sabiex jiġu eżaminati l-applikazzjonijiet għall-viżi (1), u b'mod partikolari l-Artikolu 1(2) tiegħu,

Wara li kkunsidra l-inizjattiva tar-Repubblika Ċeka,

Billi:

In-network ta’ konsultazzjoni ta' Schengen ġie stabbilit biex jippermetti konsultazzjoni bejn l-awtoritajiet ċentrali tal-Istati Membri dwar applikazzjonijiet għal viża ppreżentati minn ċittadini minn ċerti pajjiżi terzi.

L-Artikolu 22 tar-Regolament (KE) Nru 810/2009 tal-Parlament Ewropew u tal-Kunsill tat-13 ta’ Lulju 2009 li jistabbilixxi Kodiċi Komunitarju dwar il-Viżi (Kodiċi dwar il-Viża) (2) jimmodifika r-regoli attwali applikabbli fil-każ li Stat Membru jkun talab li l-awtoritajiet ċentrali ta' Stat Membru ieħor jikkonsultaw lill-awtoritajiet ċentrali tiegħu matul l-eżami tal-applikazzjonijiet ippreżentati minn ċittadini ta' pajjiżi terzi speċifiċi jew kategoriji speċifiċi ta' tali ċittadini. L-ispeċifikazzjonijiet tekniċi tan-network ta' Konsultazzjoni ta' Schengen għandhom jiġu emendati kif meħtieġ.

L-Artikolu 31 tal-Kodiċi dwar il-Viżi jippermetti li Stat Membru jeħtieġ li l-awtoritajiet ċentrali tiegħu jiġu informati dwar viżi maħruġin minn Stati Membri oħrajn lil ċittadini ta' ċerti pajjiżi terzi speċifiċi jew għal kategoriji speċifiċi ta' tali ċittadini, ħlief fil-każ ta' viżi ta' transitu f'ajruport.

It-trasmissjoni ta' tali informazzjoni teħtieġ il-ħolqien ta' forma ġdida tan-network ta’ konsultazzjoni ta' Schengen.

Il-viża għal soġġorn fit-tul, valida fl-istess ħin bħala viża għal soġġorn ta' żmien qasir (tip “D + C”) ser tiġi abolita u l-viża ta' transitu (tip “B”) ser tiġi mgħaqqda mal-viża għal soġġorn ta' żmien qasir (tip “C”) mid-data tal-applikazzjoni tal-Kodiċi dwar il-Viżi.

L-ispeċifikazzjonijiet tekniċi tan-network ta’ konsultazzjoni ta' Schengen għandhom jiġu emendati kif meħtieġ u għandhom japplikaw mid-data tal-applikazzjoni tal-Kodiċi dwar il-Viżi.

Konformement mal-Artikoli 1 u 2 tal-Protokoll Nru 22 dwar il-pożizzjoni tad-Danimarka, anness mat-Trattat dwar l-Unjoni Ewropea u mat-Trattat dwar il-Funzjonament tal-Unjoni Ewropea, id-Danimarka mhijiex tieħu sehem fl-adozzjoni ta’ din id-Deċiżjoni u mhijiex marbuta biha jew suġġetta għall-applikazzjoni tagħha. Ladarba din id-Deċiżjoni tibni fuq l-acquis ta' Schengen, id-Danimarka għandha, konformement mal-Artikolu 4 ta' dak il-Protokoll, tiddeċiedi f'perijodu ta' sitt xhur wara l-Kunsill ikun iddeċieda dwar din id-Deċiżjoni, jekk timplimentahiex fil-liġi nazzjonali tagħha.

Fir-rigward tal-Islanda u n-Norveġja, din id-Deċiżjoni tikkostitwixxi żvilupp tad-dispożizzjonijiet tal-acquis ta' Schengen, fis-sens tal-Ftehim konkluż mill-Kunsill tal-Unjoni Ewropea u r-Repubblika tal-Islanda u r-Renju tan-Norveġja dwar l-assoċjazzjoni ta' dawk iż-żewġ Stati mal-implimentazzjoni, l-applikazzjoni u l-iżvilupp tal-acquis ta' Schengen (3), li jaqgħu fil-qasam imsemmi fl-Artikolu 1(A) tad-Deċiżjoni tal-Kunsill 1999/437/KE tas-17 ta’ Mejju 1999 dwar ċerti arranġamenti għall-applikazzjoni ta' dak il-Ftehim (4).

Fir-rigward tal-Isvizzera, din id-Deċiżjoni tikkostitwixxi żvilupp tad-dispożizzjonijiet tal-acquis ta' Schengen, fis-sens tal-Ftehim konkluż bejn l-Unjoni Ewropea, il-Komunità Ewropea u l-Konfederazzjoni Svizzera dwar l-assoċjazzjoni tal-Konfederazzjoni Svizzera mal-implimentazzjoni, l-applikazzjoni u l-iżvilupp tal-acquis ta' Schengen (5), li jaqgħu fil-qasam imsemmi fl-Artikolu 1(A) tad-Deċiżjoni tal-Kunsill 1999/437/KE, moqri flimkien mal-Artikolu 3 tad-Deċiżjoni tal-Kunsill 2008/146/KE dwar il-konklużjoni, f'isem il-Komunità Ewropea, ta’ dak il-Ftehim (6).

Fir-rigward tal-Liechtenstein, din id-Deċiżjoni tikkostitwixxi żvilupp tad-dispożizzjonijiet tal-acquis ta' Schengen, fis-sens tal-Protokoll iffirmat bejn l-Unjoni Ewropea, il-Komunità Ewropea, il-Konfederazzjoni Svizzera u l-Prinċipat tal-Liechtenstein dwar l-adeżjoni tal-Prinċipat tal-Liechtenstein mal-Ftehim bejn l-Unjoni Ewropea, il-Komunità Ewropea u l-Konfederazzjoni Svizzera dwar l-assoċjazzjoni tal-Konfederazzjoni Svizzera mal-implimentazzjoni, l-applikazzjoni u l-iżvilupp tal-acquis ta' Schengen, li jaqgħu fil-qasam imsemmi fl-Artikolu 1, punt A, tad-Deċiżjoni tal-Kunsill 1999/437/KE, moqri flimkien mal-Artikolu 3 tad-Deċiżjoni tal-Kunsill 2008/261/KE dwar l-iffirmar, f’isem l-Unjoni Ewropea, u dwar l-applikazzjoni provviżorja ta’ ċerti dispożizzjonijiet ta’ dak il-Protokoll (7).

Din id-Deċiżjoni tikkostitwixxi żvilupp tad-dispożizzjonijiet tal-acquis ta’ Schengen li fih ir-Renju Unit ma jiħux sehem, skont id-Deċiżjoni tal-Kunsill 2000/365/KE tad-29 ta’ Mejju 2000 dwar it-talba tar-Renju Unit tal-Gran Brittanja u l-Irlanda ta’ Fuq biex jieħdu sehem f’xi dispożizzjonijiet tal-acquis ta’ Schengen (8); għalhekk ir-Renju Unit mhuwiex qed jieħu sehem fl-adozzjoni tagħha u mhuwiex marbut biha jew suġġett għall-applikazzjoni tagħha.

Din id-Deċiżjoni tikkostitwixxi żvilupp tad-dispożizzjonijiet tal-acquis ta' Schengen li fih l-Irlanda ma tiħux sehem, skont id-Deċiżjoni tal-Kunsill 2002/192/KE tat-28 ta' Frar 2002 rigward it-talba tal-Irlanda biex tieħu sehem f'xi dispożizzjonijiet tal-acquis ta' Schengen (9); għalhekk l-Irlanda mhijiex qed tieħu sehem fl-adozzjoni tagħha u mhijiex marbuta biha jew suġġetta għall-applikazzjoni tagħha.

Fir-rigward ta’ Ċipru, din id-Deċiżjoni tikkostitwixxi att li jikkostitwixxi żvilupp tal-acquis ta' Schengen jew li huwa diversament relatat miegħu fis-sens tal-Artikolu 3(2) tal-Att ta' Adeżjoni tal-2003.

Din id-Deċiżjoni tikkostitwixxi att li jibni fuq l-acquis ta' Schengen jew li huwa relatat miegħu b'xi mod ieħor fis-sens tal-Artikolu 4(2) tal-Att tal-Adeżjoni tal-2005,

ADOTTA DIN ID-DEĊIŻJONI:

Artikolu 1

Il-Partijiet 1, 2, 3 u 4 tan-network ta’ konsultazzjoni ta' Schengen (speċifikazzjonijiet tekniċi) huma b’dan emendati kif hemm dispost fl-Annessi I, II, III u IV rispettivament.

Artikolu 2

Din id-Deċiżjoni għandha tidħol fis-seħħ fl-għoxrin jum wara l-pubblikazzjoni tagħha f’Il-Ġurnal Uffiċjali tal-Unjoni Ewropea.

Hija għandha tapplika mill-5 ta’ April 2010.

Artikolu 3

Din id-Deċiżjoni hija indirizzata lill-Istati Membri konformement mat-Trattati.

Artikolu 4

Din id-Deċiżjoni għandha tiġi ppubblikata f’Il-Ġurnal Uffiċjali tal-Unjoni Ewropea.

Consultation when processing a visa application in the context of representation shall be subject to the following rules, in accordance with Article 22 of the Visa Code, and can be carried out in the framework of one or both of the following scenarios:

Picture 1 —   Norway representing Sweden

Norway’s central authorities are to ensure that necessary consultations of the other States take place. The absence of a reply within seven (7) days shall mean that the consulted State(s) has(have) no grounds for objecting to the issuing of the visa. If the represented State (Sweden) wants to be involved this has to be laid down in a bilateral representation arrangement between the States involved (Norway and Sweden). In that case, the represented State must always reply to the representing State's FORM F using a FORM G (obligation to reply). A visa cannot be issued if no reply indicating consent is received. The represented State may specify on the FORM G reply, that a Visa of Limited Territorial Validity (VLTV) should be issued in the framework of representation. In this case, all other Schengen States are duly notified (by means of a FORM C) of the VLTV's issued by the representing State. It is not necessary to state the territory to which the visa is limited.

Sweden’s central authorities are to ensure that necessary consultations of the other State(s) take place. The absence of a reply within seven (7) days shall mean that the consulted State(s) has(have) no grounds for objecting to the issuing of the visa. The represented State must always reply to the representing State's FORM F using a FORM G (obligation to reply). A visa cannot be issued if no reply indicating consent is received. The represented State may specify on the FORM G reply, that a Visa of Limited Territorial Validity (VLTV) should be issued in the framework of representation. In this case, all other Schengen States are duly notified (by means of a FORM C) of the VLTV's issued by the representing State. It is not necessary to state the territory to which the visa is limited. The consultation procedure (7 calendar days) and any further communication between the represented State and representing State in relation to the decision process (e.g. exchange of forms F and G) has to be done within 15 calendar days in accordance with Article 23(1) of the Visa Code.”;

Heading No. 047: Reference of error message

The purpose of this heading is to identify the error message:

 

3 bytes identifying the sending State

 

16 bytes for the national identification number

Heading No. 048: Document reference (erroneous form)

Format: alphanum (19)

This identifies the document the error refers to.

It contains one of the following headings of a referred form:

‘Reference number of request’, (heading 001 of a referred ‘A’ or ‘F’).

‘Reference number of reply’, (heading 040 of a referred ‘B’ or ‘G’).

‘Reference of the decision’, (heading 044 of a referred ‘C’ or ‘H’).

Heading No. 049: Type of form

Format: code (1)

Possible indications:. ‘A’, ‘B’, ‘C’, ‘F’, ‘G’ or ‘H’.

Heading No. 050: Type of error

Format: code (1)

This heading indicates the error causing an E Form to be sent. The following codes can be used:

 

‘1’ technical error

 

‘2’ logical error

Heading No. 051: Reason for the technical error

Format: num (3)

If error code 1 appears under heading No. 050, the number of the heading of the document which contains the first error must compulsorily be entered under heading No. 051.

Heading No. 052: Reason for the logical error

Format: code (2)

If error code 2 appears under heading No. 050, the reason for the error shall be entered, according to the following codes:

 

‘01’ Reply received too late

 

‘02’ No consultation/information required

 

‘03’ Reply was not taken into account since visa of limited territorial validity has been issued in the meantime

 

‘04’ Form received in duplicate

 

‘05’ Unknown which form was received

The national applications shall be adapted in such a way that the statistics generated on Form E enable distinction of the number of error messages caused by technical errors (code = ‘1’ under Heading No. 050) and logical errors (code = ‘2’ under Heading No. 050).

Additional rule for form E:

It is prohibited to scan a form E itself for logical or technical failures and to reply to a malformed E by another form E to prevent a cumulative process – ‘Snowball Effect’.”;

“If a Member State receives an alleged erroneous form R, it has to discard this form R without processing it. This means that the Member State should ignore forms R that seem to be invalid. If the problem persists it has to be solved bilaterally by technical staff.”;

When the national application has received the form it shall prepare an ‘R’ form in order to acknowledge the form of type ‘A, B, C, E, G, F and H’ (each document that contains a line that starts with ′000.′) that was received.

The structure of the ‘R’ form is described in 2.1.10 FORM R: ‘DELIVERY NOTIFICATION’

The ‘R’ Form is to be prepared and transmitted in direct connection to the reception of the form of type ‘A, B, C, E, G, F or H’.

The procedure for preparing, sending and retrieving the ‘R’ Form is otherwise the same as described in steps 1, 2 and 3 above for the normal forms.”.
