IL-KUMMISSJONI TAL-KOMUNITAJIET EWROPEJ,

Wara li kkunsidrat it-Trattat li jistabbilixxi l-Komunità Ewropea,

Wara li kkunsidrat id-Direttiva tal-Kunsill 92/75/KEE tat-22 ta’ Settembru 1992 dwar l-indikazzjoni permezz ta’ ittikkettjar u l-informazzjoni standard tal-prodott dwar il-konsum ta’ l-enerġija u riżorsi oħra ta’ apparat għall-użu fid-dar [1], u partikolarment l-Artikoli 9 u 12 tagħha,

Billi skond id-Direttiva 92/75/KEE il-Kummissjoni għandha tadotta direttiva implimentattiva fir-rigward ta’ apparat ta’ użu fid-djar inklużi l-magni tal-ħasil;

Billi l-użu ta’ l-elettriku minn magni tal-ħasil jammonta għal parti sinifikanti mid-domanda totali ta’ l-enerġija tal-Komunità; billi l-iskop għal tnaqqis fl-użu ta’ l-enerġija minn dawn l-apparati huwa sostanzjali;

Billi l-prestazzjoni ta’ ħasil aħjar ta’ sikwit teħtieġ konsum akbar ta’ l-ilma u l-enerġija; billi l-informazzjoni dwar il-prestazzjoni tal-ħasil ta’ apparat tkun ta’ għajnuna fil-valutazzjoni ta’ l-informazzjoni dwar il-konsum ta’ l-enerġija u ta’ l-ilma minnha; billi dan jgħin lill-konsumaturi sabiex jagħmlu għażla ta’ apparat li tkun konsistenti ma l-użu razzjonali ta’ l-enerġija;

Billi l-Komunità, waqt li tikkonferma l-interess tagħha f’sistema ta’ standardizzazzjoni internazzjonali li tkun kapaċi li tipproduċi standards li jkunu attwalment użati mis-sieħba kollha fil-kummerċ internazzjonali u li tkun kapaċi tilħaq il-ħtiġiet tal-politika tal-Komunità, tistieden lill-organizzazzjonijiet ta’ standards Ewropej sabiex ikomplu l-kooperazzjoni tagħhom ma’ l-organizzazzjonijiet ta’ standards internazzjonali;

Billi l-Kumitat Ewropew għall-Istandardizzazzjoni (CEN) u l-Kumitat Ewropew għall-Istandardizzazzjoni Elettroteknika (Cenelec) huma l-korpi rikonnoxxuti bħala kompetenti sabiex jadottaw standards armonizzati bi qbil mal-linji gwida ġenerali għal kooperazzjoni bejn il-Kummissjoni u dawn iż-żewġ korpi ffirmati fit-13 ta’ Novembru 1984; billi, fit-tifsira ta’ din id-Direttiva, standard armonizzat huwa speċifikazzjoni teknika (standard Ewropew jew dokument ta’ l-armonizazzjoni) adottata minn Cenelec, fuq il-bażi ta’ mandat mill-Kummissjoni bi qbil mad-dispożizzjonijiet tad-Direttiva tal-Kunsill 83/189/KEE tat-28 ta’ Marzu 1983 li tistabbilixxi proċedura għall-għoti ta’ informazzjoni fil-qasam ta’ l-standards u r-regolamenti tekniċi [2], kif l-aħħar emendata bid-Direttiva 94/10/KE tal-Parlament Ewropew u tal-Kunsill [3], u fuq il-bażi ta’ dawk il-linji gwida ġenerali;

Billi l-miżuri stabbiliti f’din id-Direttiva huma bi qbil ma’ l-opinjoni tal-kumitat stabbilit permezz ta’ l-Artikolu 10 tad-Direttiva 92/75/KEE,

ADOTTAT DIN ID-DIRETTIVA:

Artikolu 1

1. Din id-Direttiva għandha tapplika għal magni tal-ħasil għal użu fid-djar imħaddma mill-mains ta’ l-elettriku, apparti milli:

- magni li ma għandhomx il-kapaċità li jagħsru bit-tidwir,

- magni b’reċipjenti tal-ħasil u l-għasir separati (bħalma huma twin tubs), u

- magni tal-ħasil u tnixxif ikkombinat.

L-apparati li jistgħu ukoll jużaw sorsi oħrajn ta’ l-enerġija huma esklużi.

2. L-informazzjoni meħtieġa minn din id-Direttiva għandha tkun imkejla skond standards armonizzati, li n-numri tar-referenza tagħhom kienu ġew ippubblikati fil-Ġurnal Uffiċjali tal-Komunitajiet Ewropej u li għalihom l-Istati Membri kienu ppubblikaw in-numri ta’ referenza tal-istandards nazzjonali li għamlu t-trasposizzjoni ta’ dawk l-istandards armonizzati. F’din id-Direttiva kollha kwalunkwe dispożizzjoni li teħtieġ li tingħata nformazzjoni rigward il-ħoss għandha tapplika meta dik l-informazzjoni tkun meħtieġa permezz ta’ l-Artikolu 3 tad-Direttiva tal-Kunsill 86/594/KEE [4]. Din l-informazzjoni, meta meħtieġa, għandha tkun mkejjla skond id-Direttiva 83/189/KEE.

3. "Negozjant", "fornitur", "folja ta’ informazzjoni", "riżorsi essenzjali oħrajn" u "informazzjoni supplimentari" għandhom ikollhom it-tifsira stabbilita fl-Artikolu 1(4) tad-Direttiva 92/75/KEE.

Artikolu 2

1. Id-dokumentazzjoni teknika msemmija fl-Artikolu 2(3) tad-Direttiva 92/75/KEE għandha tinkludi:

- l-isem u l-indirizz tal-fornitur,

- deskrizzjoni ġenerali ta’ l-apparat, li tkun biżżejjed sabiex l-apparat jiġi identifikat b’mod uniku,

- l-informazzjoni, li tinkludi tpinġijiet kif ikun relevanti, dwar l-aspetti tad-disinn prinċipali tal-mudell u b’mod partikolari punti li jaffettwaw mhux ħażin il-konsum tagħha ta’ l-enerġija,

- rapporti tat-testijiet ta’ teħid ta’ kejl relevanti mwettqa taħt il-proċeduri tat-test ta’ l-istandards armonizzati msemmija fl-Artikolu 1(2)

- struzzjonijiet għat-tħaddim, jekk ikun hemm.

2. It-tikketta msemmija fl-Artikolu 2(1) tad-Direttiva 92/75/KEE għandha tkun kif speċifikata fl-Anness I għal din id-Direttiva. It-tikketta għandha titqiegħed fuq in-naħa ta’ barra ta’ quddiem jew ta’ fuq ta’ l-apparat, b’tali mod li tkun tidher b’mod ċar, u ma tkunx moħbija.

3. Il-kontenut u l-format tal-fiche msemmi fl-Artikolu 2(1) tad-Direttiva 92/75/KEE għandu jkun kif speċifikat fl-Anness II għal din id-Direttiva.

4. Fiċ-ċirkostanzi koperti bl-Artikolu 5 tad-Direttiva 92/75/KEE, u meta l-offerta għal bejgħ, kiri jew xiri bin-nifs, tkun ipprovduta permezz ta’ komunikazzjoni stampata, bħal ma huwa katalogu ta’ bejgħ postali, allura dik il-komunikazzjoni stampata għandha tinkludi l-informazzjoni kollha speċifikata fl-Anness III ta’ din id-Direttiva.

5. Il-klassi ta’ l-effiċjenza ta’ l-enerġija ta’ l-apparat, il-klassi ta’ prestazzjoni tal-ħasil tagħha, u l-klassi ta’ l-effiċjenza tat-tnixxif tagħha, kif speċifikat fit-tikketta u l-fiche, għandhom ikunu kif speċifikat fl-Anness IV.

Artikolu 3

L-Istati Membri għandhom jieħdu l-miżuri kollha meħtieġa sabiex jassiguraw li l-fornituri u negozjanti kollha stabbiliti fit-territorju tagħhom jissodisfaw l-obbligi tagħhom taħt din id-Direttiva.

Artikolu 4

1. L-Istati Membri għandhom jadottaw u jippubblikaw il-liġijiet, ir-regolamenti u d-dispożizzjonijiet amministrattivi meħtieġa sabiex ikunu konformi ma’ din id-Direttiva sa l-1 ta’ Marzu 1996. Għandhom jinfurmaw minnufih lill-Kummissjoni b’dan. Għandhom japplikaw dawk id-dispożizzjonijiet mill-1 ta’ April 1996.

B’dana kollu, l-Istati Membri għandhom jippermettu, sat-30 ta’ Settembru 1996:

- it-tqegħid fis-suq, il-kummerċjalizzazzjoni u/jew il-wiri ta’ prodotti,

- id-distribuzzjoni tal-komunikazzjonijiet stampati msemmija fl-Artikolu 2(4) li ma jkunux konformi ma’ din id-Direttiva.

Meta l-Istati Membri jadottaw dawn id-dispożizzjonijiet, dawn għandhom ikollhom referenza għal din id-Direttiva jew għandhom ikunu akkumpanjati b’din ir-referenza fil-waqt tal-pubblikazzjoni uffiċjali tagħhom. Il-proċedura għal din ir-referenza għandha tkun adottata mill-Istati Membri.

2. L-Istati Membri għandhom jikkomunikaw lill-Kummissjoni t-test tad-dispożizzjonijiet prinċipali tal-liġi nazzjonali li huma jadottaw fil-qasam kopert b’din id-Direttiva.

Artikolu 5

Din id-Direttiva għandha tidħol fis-seħħ fl-20 jum ta’ wara l-pubblikazzjoni tagħha fil-Ġurnal Uffiċjali tal-Komunitajiet Ewropej.

Artikolu 6

Din id-Direttiva hija indirizzata lill-Istati Membri.

2. The following notes define the information to be included:

Note:

I. Supplier's name or trade mark.

II. Supplier's model identifier.

III. The energy efficiency class of an appliance shall be determined in accordance with Annex IV. This letter shall be placed at the same level as the relevant arrow.

IV. Without prejudice to any requirements under the Community eco-label scheme, where an appliance has been granted a Community eco-label pursuant to Council Regulation (EEC) No 880/92 [1], a copy of the eco-label may be added here. The Washing machine label design guide referred to below, explains how the eco-label mark may be included in the label.

V. Energy consumption in kWh per cycle using standard 60 °C cotton cycle in accordance with the test procedures of the harmonized standards referred to in Article 1 (2).

VI. Washing performance class as determined by Annex IV.

VII. Drying efficiency class as determined by Annex IV.

VIII. Maximum spin speed attained for standard 60 °C cotton cycle in accordance with the test procedures of the harmonized standards referred to in Article 1 (2).

ANNEX II

THE FICHE

The fiche shall contain the following information. The information may be given in the form of a table covering a number of models supplied by the same supplier, in which case it shall be given in the order specified, or given close to the description of the appliance:

1. Supplier's trade mark.

2. Supplier's model identifier.

3. The energy efficiency class of the model as defined in Annex IV. Expressed as Energy efficiency class… on a scale of A (most efficient) to G (least efficient). Where this information is provided in a table, this may be expressed by other means provided it is clear that the scale is from A (most efficient) to G (least efficient).

4. Where the information is provided in a table, and where some of the appliances listed in the table have been granted an EU eco-label pursuant to Regulation (EEC) No 880/92, this information may be included here. In this case the row heading shall state EU eco-label, and the entry shall consist of a copy of the eco-label mark. This provision is without prejudice to any requirements under the Community eco-label mark scheme.

5. Energy consumption in kWh per cycle using standard 60 °C cotton cycle in accordance with the test procedures referred to in Article 1 (2), described as energy consumption XYZ kWh per cycle, based on standard test results for 60 °C cotton cycle. Actual energy consumption will depend on how the appliance is used.

6. Washing performance class as determined by Annex IV. Expressed as Washing performance class… on a scale of A (higher) to G (lower). This may be expressed by other means provided it is clear that the scale is from A (higher) to G (lower).

7. Spin drying efficiency class (Annex IV). Expressed as:

"Spin drying performance… on a scale of A (higher) to G (lower)"

. Followed by the statement:

"NB if you use a tumble drier. Choosing a washing machine with A-rated spin, instead of one with a G-rated spin will halve your tumble drying costs. Tumble drying clothes usually uses more energy than washing them."

This statement may also be included as a footnote.

Where this information is provided in a table this may be expressed by other means provided it is clear that the scale is from A (higher) to G (lower), and that the statement concerning running costs is included in the table, or in a footnote.

8. Water extraction efficiency in accordance with the test procedures of the harmonized standards referred to in Article 1 (2) for a standard 60 °C cotton cycle. Expressed as Water remaining after spin…% (as a proportion of dry weight of wash).

9. Maximum spin speed attained for standard 60 °C cotton cycle in accordance with the test procedures of the harmonized standards referred to in Article 1 (2).

10. Capacity of appliance for standard 60 °C cotton cycle in accordance with the test procedures of the harmonized standards referred to in Article 1 (2).

11. Water consumption per cycle using standard 60 °C cotton cycle in accordance with the test procedures of the harmonized standards referred to in Article 1 (2).

12. Programme time for standard 60 °C cotton cycle in accordance with the test procedures referred to in Article 1 (2).

13. Suppliers may include the information in points 6 to 12, in respect of other wash cycles.

14. The average annual consumption of energy and water based on 200 standard 60 °C cotton cycles. This shall be expressed as estimated annual consumption (200 standard 60 °C cotton washes) for a four-person household.

15. Noise during washing and spinning cycles using standard 60 °C cycle, in accordance with Directive (EEC) No 86/594.

If a copy of the label, either in colour or black and white, is included in the fiche, then only the further information included in the fiche need be included.

ANNEX III

MAIL ORDER AND OTHER DISTANCE SELLING

Mail order catalogues and other printed communications referred to in Article 2 (4) shall contain the following information, given in the order specified:

1. Energy efficiency class (Annex II point 3)

2. Energy consumption (Annex II point 5)

3. Washing performance class (Annex II point 6)

4. Spin drying efficiency class (Annex II point 7)

5. Maximum spin speed (Annex I note VIII)

6. Capacity (Annex I note IX)

7. Water consumption (Annex I note X)

8. Estimated annual consumption for a four-person household (Annex II point 14)

9. Noise (Annex I note XI)

Where other information contained in the fiche is provided, it shall be in the form defined in Annex II and shall be included in the above table in the order defined for the fiche.

ENERGY EFFICIENCY CLASS

1. The energy efficiency class of an appliance shall be determined in accordance with the following table 1:
