Proposal for a Council Regulation (EC) amending Regulation (EEC) No 2389/89 on general rules for the classification of vine varieties (97/C 269/07) COM(97) 415 final

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EEC) No 822/87 of 16 March 1987 on the common organization of the market in wine (1), as last amended by Regulation (EC) No . . ./97, and in particular Article 13 (1) thereof,

Whereas Article 6 (2) of Regulation (EEC) No 822/87 has been amended to allow Member States to authorize new plantings on land intended for growing parent vines for scions; whereas all the varieties listed in the classification of vine varieties may be planted on such land in order to provide nursery growers with stocks of all marketable varieties and thus avoid the spread of diseases resulting from transport between the various regions;

Whereas Member States may classify parent vines for scions, because of their special characteristics, for their entire territory or merely for certain administrative units,

HAS ADOPTED THIS REGULATION:

Article 1

Regulation (EEC) No 2389/89 is hereby amended as follows:

1. in Article 2 (2), the following point (e) is added:

'(e) scion variety, a vine variety grown for the production of vegetative vine propagation material and supplying the aerial parts of the plant;`

2. in Article 3, the following paragraph is added:

'3. The scion varieties are the same wine and table grape varieties classified, pursuant to Article 3 (1), for each of the defined administrative units or parts thereof. Each Member State shall determine and classify the scion varieties which it shall authorize in each of the administrative units or parts thereof referred to in paragraph 1`.

Article 2

This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
