kuriuo iš dalies keičiamas Įgyvendinimo sprendimo (ES) 2023/2447 dėl neatidėliotinų priemonių, susijusių su labai patogeniško paukščių gripo protrūkiais tam tikrose valstybėse narėse, priedas

EUROPOS KOMISIJA,
atsižvelgdama į Sutartį dėl Europos Sąjungos veikimo,
atsižvelgdama į 2016 m. kovo 9 d. Europos Parlamento ir Tarybos reglamentą (ES) 2016/429 dėl užkrečiamųjų gyvūnų ligų, kuriuo iš dalies keičiami ir panaikinami tam tikri gyvūnų sveikatos srities aktai, („Gyvūnų sveikatos teisės aktas“) (1), visų pirma į jo 259 straipsnio 1 dalies c punktą,
kadangi:

labai patogeniškas paukščių gripas (LPPG) yra infekcinė virusinė paukščių liga, kuri gali turėti didelį poveikį paukštininkystės pelningumui ir dėl kurios gali sutrikti Sąjungos vidaus prekyba ir eksportas į trečiąsias šalis. LPPG virusais gali užsikrėsti migruojantys paukščiai, kurie juos gali išplatinti dideliais atstumais rudens ir pavasario migracijos metu. Todėl LPPG virusai laukiniuose paukščiuose kelia nuolatinę tiesioginio ir netiesioginio šių virusų patekimo į ūkius, kuriuose auginami naminiai ar nelaisvėje laikomi paukščiai, grėsmę. Kilus LPPG protrūkiui atsiranda pavojus, kad ligos sukėlėjas gali išplisti į kitus ūkius, kuriuose auginami naminiai ar nelaisvėje laikomi paukščiai; |

Reglamentu (ES) 2016/429 nustatoma ligų, kurios perduodamos gyvūnams arba žmonėms, prevencijos ir kontrolės teisinė sistema. LPPG patenka į tame reglamente pateiktą į sąrašą įtrauktos ligos apibrėžtį ir jam taikomos tame reglamente nustatytos ligų prevencijos ir kontrolės taisyklės. Be to, Komisijos deleguotasis reglamentas (ES) 2020/687 (2) papildo Reglamento (ES) 2016/429 nuostatas dėl tam tikrų į sąrašą įtrauktų ligų, įskaitant LPPG, prevencijos ir kontrolės taisyklių. Visų pirma, to deleguotojo reglamento 21 straipsnyje nustatyta, kad, kilus A kategorijos ligos protrūkiui ūkyje, kompetentinga institucija turi nedelsdama nustatyti apribojimų taikymo zoną, kurią sudaro apsaugos zona, priežiūros zona, o prireikus ir papildomos apribojimų taikymo zonos aplink apsaugos ir priežiūros zonas arba greta jų; |

Komisijos įgyvendinimo sprendimas (ES) 2023/2447 (3) buvo priimtas remiantis Reglamentu (ES) 2016/429 ir jame nustatytos neatidėliotinos Sąjungos lygmens priemonės, susijusios su LPPG protrūkiais; |
|

visų pirma, Įgyvendinimo sprendimo (ES) 2023/2447 2 straipsnio a punkte, 3 straipsnio a punkte ir 4 straipsnio a punkte nustatyta, kad atitinkamai apsaugos, priežiūros ir papildomos apribojimų taikymo zonos, kurias valstybės narės pagal Deleguotąjį reglamentą (ES) 2020/687 turi nustatyti po LPPG protrūkių ir kurios išvardytos to sprendimo priede, turi apimti bent tas teritorijas, kurios tame priede yra išvardytos kaip apsaugos, priežiūros ir papildomos apribojimų taikymo zonos. Įgyvendinimo sprendimo (ES) 2023/2447 2 straipsnio b punkte, 3 straipsnio b punkte ir 4 straipsnio b punkte taip pat nustatyta, kad tose atitinkamose zonose pagal tą deleguotąjį reglamentą taikytinos priemonės turi būti toliau taikomos bent iki to įgyvendinimo sprendimo priede nustatytų datų; |

Įgyvendinimo sprendimo (ES) 2023/2447 priedas buvo neseniai iš dalies pakeistas Komisijos įgyvendinimo sprendimu (ES) 2025/2000 (4) po LPPG protrūkių Ispanijos, Lenkijos ir Portugalijos ūkiuose, kuriuose laikomi naminiai ar nelaisvėje auginami paukščiai ir į kuriuos reikėjo atsižvelgti tame priede; |
|

po Įgyvendinimo sprendimo (ES) 2025/2000 priėmimo dienos Bulgarija, Danija, Vokietija, Italija, Nyderlandai, Lenkija ir Ispanija pranešė Komisijai apie 15 naujų LPPG protrūkių tų valstybių narių ūkiuose, kuriose auginami naminiai paukščiai. Pranešimai pirmiausia buvo susiję su vienu protrūkiu Bulgarijos Chaskovo srityje, vienu protrūkiu Danijos Frederisijos savivaldybėje, vienu protrūkiu Vokietijos Šiaurės Reino-Vestfalijos žemėje ir dviem protrūkiais Tiuringijos valstijoje, vienu protrūkiu Italijos Udinės provincijoje, vienu protrūkiu Nyderlandų Drentės provincijoje, dviem protrūkiais Lenkijos Varmijos Mozūrų vaivadijoje ir dviem protrūkiais Didžiosios Lenkijos vaivadijoje, trimis protrūkiais Ispanijos Valjadolido provincijoje ir vienu protrūkiu Madrido provincijoje; |

po tų 15-os naujų protrūkių Bulgarija, Danija, Vokietija, Italija, Nyderlandai, Lenkija ir Ispanija ėmėsi ligos kontrolės priemonių, kurių reikalaujama pagal Deleguotąjį reglamentą (ES) 2020/687, be kita ko, aplink protrūkių vietas nustatydamos apsaugos ir priežiūros zonas; |

Komisija išnagrinėjo ligos kontrolės priemones, kurių ėmėsi Bulgarija, Danija, Vokietija, Italija, Nyderlandai, Lenkija bei Ispanija, ir įsitikino, kad šių valstybių narių nustatytų apsaugos ir priežiūros zonų ribos yra pakankamai toli nuo ūkių, kuriuose buvo patvirtinti LPPG protrūkiai; |
|
(9) |
kad būtų išvengta bet kokių nereikalingų Sąjungos vidaus prekybos sutrikdymų ir trečiųjų šalių sudaromų nepagrįstų prekybos sutrikimų, būtina bendradarbiaujant su Bulgarija, Danija, Vokietija, Italija, Nyderlandais, Lenkija ir Ispanija skubiai Sąjungos lygmeniu apibrėžti šių valstybių narių pagal Deleguotąjį reglamentą (ES) 2020/687 nustatytas apsaugos ir priežiūros zonas; |

todėl teritorijos, kurios į Įgyvendinimo sprendimo (ES) 2023/2447 priedą įtrauktos kaip Vokietijos, Lenkijos ir Ispanijos apsaugos ir priežiūros zonos, turėtų būti iš dalies pakeistos, kad būtų atsižvelgta į apsaugos ir priežiūros zonų, kurias tos valstybės narės nustatė po 11-os naujų LPPG protrūkių jose, ribas ir būtiną priemonių, kurias reikia taikyti šiose zonose pagal Deleguotąjį reglamentą (ES) 2020/687, trukmę; |

šiuo metu Įgyvendinimo sprendimo (ES) 2023/2447 priede nėra išvardytų Bulgarijos, Danijos, Italijos ir Nyderlandų apsaugos ir priežiūros zonų. Todėl susijusios teritorijos dabar turėtų būti įtrauktos į tą priedą kaip Bulgarijos, Danijos, Italijos ir Nyderlandų apsaugos ir priežiūros zonos, kad būtų atsižvelgta į apsaugos ir priežiūros zonų, kurias tos valstybės narės atitinkamose savo teritorijose nustatė po naujausių LPPG protrūkių jose, ribas ir priemonių, kurias reikia taikyti šiose zonose pagal Deleguotąjį reglamentą (ES) 2020/687, trukmę; |

todėl Įgyvendinimo sprendimo (ES) 2023/2447 priedas turėtų būti atitinkamai iš dalies pakeistas; |
|
(13) |
atsižvelgiant į tai, kad į epizootinę situaciją Sąjungoje dėl LPPG paplitimo reikia reaguoti skubiai, svarbu, kad Įgyvendinimo sprendimo (ES) 2023/2447 pakeitimai, kurie turi būti padaryti šiuo sprendimu, įsigaliotų kuo greičiau; |

šiame sprendime nustatytos priemonės atitinka Augalų, gyvūnų, maisto ir pašarų nuolatinio komiteto nuomonę, |

Įgyvendinimo sprendimo (ES) 2023/2447 priedas pakeičiamas šio sprendimo priedo tekstu.
