az (EU) 2026/582 végrehajtási határozatnak a ragadós száj- és körömfájás ciprusi előfordulásával kapcsolatos egyes vészhelyzeti intézkedések tekintetében való módosításáról

AZ EURÓPAI BIZOTTSÁG,
tekintettel az Európai Unió működéséről szóló szerződésre,
tekintettel a fertőző állatbetegségekről és egyes állategészségügyi jogi aktusok módosításáról és hatályon kívül helyezéséről szóló, 2016. március 9-i (EU) 2016/429 európai parlamenti és tanácsi rendeletre („állategészségügyi rendelet”) (1) és különösen annak 259. cikke (1) bekezdésére,
mivel:

A ragadós száj- és körömfájás a párosujjú patások (Artiodactyla) és az ormányosok (Proboscidea) rendjébe tartozó emlősöket érintő fertőző vírusos betegség, amely súlyos hatással lehet az érintett állatállományra és a gazdálkodás jövedelmezőségére, zavart okozva az említett állatok és az azokból származó termékek szállítmányainak Unión belüli mozgatásában és harmadik országokba történő kivitelében. A ragadós száj- és körömfájás állatok körében történő kitörése esetén jelentős annak a kockázata, hogy a betegség más, az (EU) 2018/1882 bizottsági végrehajtási rendelet (2) mellékletében meghatározott, jegyzékbe foglalt fajokhoz tartozó állatokat tartó gazdaságokra is átterjed. |

Az (EU) 2020/687 felhatalmazáson alapuló bizottsági rendelet (3) kiegészíti az (EU) 2016/429 rendelet 9. cikke (1) bekezdésének a), b) és c) pontjában felsorolt, illetve az (EU) 2018/1882 végrehajtási rendeletben az A, B és C kategóriájúként meghatározott betegségekkel szembeni védekezésre vonatkozóan megállapított szabályokat. Az (EU) 2020/687 felhatalmazáson alapuló rendelet 21. és 22. cikke korlátozás alatt álló körzet létrehozását írja elő az A kategóriájú betegségek kitörése esetén, amelyek közé a ragadós száj- és körömfájás is tartozik, továbbá bizonyos járványvédelmi intézkedések alkalmazását írja elő e körzetben. Ezenkívül az említett felhatalmazáson alapuló rendelet 21. cikkének (1) bekezdése úgy rendelkezik, hogy a korlátozás alatt álló körzetnek egy védőkörzetből, egy felügyeleti körzetből és szükség esetén a védőkörzetek és a felügyeleti körzetek körül vagy azok szomszédságában további, korlátozás alatt álló körzetekből kell állnia. |

Az (EU) 2016/429 rendelet alapján elfogadásra került az (EU) 2026/582 bizottsági végrehajtási határozat (4), amely egyes vészhelyzeti intézkedéseket állapít meg a ragadós száj- és körömfájásnak a ciprusi Larnaca és Nicosia kerületben található, kérődzőket tartó létesítményekben történt kitöréseivel kapcsolatban. Konkrétabban az (EU) 2026/582 végrehajtási határozat úgy rendelkezik, hogy Ciprusnak az (EU) 2020/687 felhatalmazáson alapuló rendelet 21. cikkének megfelelően védő- és felügyeleti körzetekből álló, korlátozás alatt álló körzeteket, valamint egy további, korlátozás alatt álló körzetet kell létrehoznia, ahol az említett védő- és felügyeleti körzetekben, illetve korlátozás alatt álló körzetben alkalmazandó intézkedéseket legalább az említett végrehajtási határozat mellékletében felsorolt időpontokig alkalmazzák, és az említett védő- és felügyeleti körzeteknek, illetve korlátozás alatt álló körzetnek legalább a szóban forgó mellékletben felsorolt területeket magukban kell foglalniuk. Az (EU) 2026/582 végrehajtási határozatot az (EU) 2026/782 bizottsági végrehajtási határozat (5) módosította. |

Az (EU) 2026/782 végrehajtási határozat elfogadása óta a Ciprus által szolgáltatott információk alapján felülvizsgálták a határozat mellékletében felsorolt védő- és felügyeleti körzetekben és további korlátozás alatt álló körzetben alkalmazandó vészhelyzeti intézkedéseket és végrehajtásuk ütemtervét, különös tekintettel az érintett létesítményeknek az (EU) 2020/687 felhatalmazáson alapuló rendelettel összhangban kötelezően elvégzendő előzetes tisztításának és fertőtlenítésének időpontjára. Következésképpen az említett védő- és felügyeleti körzetekben alkalmazandó vészhelyzeti intézkedések időtartamát felül kell vizsgálni. |

Ezen túlmenően az (EU) 2026/782 végrehajtási határozat elfogadása óta a ciprusi Larnaca és Nicosia kerületben található létesítményekben a ragadós száj- és körömfájás további, többek között az (EU) 2026/582 végrehajtási határozat mellékletében jelenleg védő- és felügyeleti körzetként felsorolt területeken kívül előforduló kitöréseire derült fény. |

Ennek megfelelően – tekintettel a ragadós száj- és körömfájással kapcsolatos jelenlegi ciprusi járványügyi helyzetre, továbbá a betegség említett tagállamon belüli, illetve más tagállamokra vagy harmadik országokra való továbbterjedésének megelőzése érdekében – sürgősen felül kell vizsgálni az (EU) 2026/582 végrehajtási határozat mellékletében védő- és felügyeleti, illetve további, korlátozás alatt álló körzetként felsorolt jelenlegi területeket mind térbeli, mind időbeli szempontból, és adott esetben ki kell őket igazítani, valamint új védő- és felügyeleti körzeteket kell létrehozni a legutóbbi ciprusi kitörések figyelembevételével. Erre az Unión belüli kereskedelem szükségtelen megzavarásának megelőzése, valamint a harmadik országok által felállított indokolatlan kereskedelmi akadályok elkerülése érdekében is szükség van. |

Az (EU) 2026/582 végrehajtási határozatot ezért ennek megfelelően módosítani kell. |

Az e határozatban előírt intézkedések összhangban vannak a Növények, Állatok, Élelmiszerek és Takarmányok Állandó Bizottságának véleményével, |
ELFOGADTA EZT A HATÁROZATOT:
1. cikk
Az (EU) 2026/582 végrehajtási határozat mellékletének helyébe e határozat mellékletének szövege lép.
2. cikk
Ennek a határozatnak a Ciprusi Köztársaság a címzettje.
