establishing the standard import values for determining the entry price of certain fruit and vegetables
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Commission Regulation (EC) No 3223/94 of 21 December 1994 on detailed rules for the application of the import arrangements for fruit and vegetables (1), and in particular Article 4(1) thereof,
Whereas:
(1) |
Regulation (EC) No 3223/94 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in the Annex thereto. |
(2) |
In compliance with the above criteria, the standard import values must be fixed at the levels set out in the Annex to this Regulation, |
HAS ADOPTED THIS REGULATION:
Article 1
The standard import values referred to in Article 4 of Regulation (EC) No 3223/94 shall be fixed as indicated in the Annex hereto.
Article 2
This Regulation shall enter into force on 10 August 2004.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EC) No 1427/2004

amending Regulation (EC) No 1622/2000 laying down certain detailed rules for implementing Regulation (EC) No 1493/1999 on the common organisation of the market in wine and establishing a Community code of oenological practices and processes
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EC) No 1493/1999 of 17 May 1999 on the common organisation of the market in wine (1), and in particular Article 46 thereof,
Whereas:

The Act of Accession of the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia amended point 4(d) of Annex IV to Regulation (EC) No 1493/1999, providing for the possibility to use the pouring of wine onto lees or grape marc or pressed aszú pulp where this practice is traditionally used for the production of ‘Tokaji fordítás’ and ‘Tokaji máslás’ in the Tokaj region of Hungary under conditions to be determined. It is therefore necessary to further determine these conditions and to provide for a notification procedure if the Member State intends to modify these. |

Part A of Annex III to Commission Regulation (EC) No 1622/2000 (2) lists the vine varieties producing grape must or grape must in fermentation that may be used to constitute the cuvée for preparing quality sparkling wines of the aromatic type and quality sparkling wines psr of the aromatic type. That list should be amended to include varieties produced in the Czech Republic, Hungary and Slovakia. |

Limits for sulphur dioxide content are laid down in point 1 of Part A of Annex V to Regulation (EC) No 1493/1999. Derogations to these limits are listed in point 2 of Part A of Annex V to the said Regulation, and in Annex XII of Regulation (EC) No 1622/2000. Annex XII of Regulation (EC) No 1622/2000 should be amended by reason of the accession of the Czech Republic and Slovakia. |

Some French table wines bearing a geographical indication can have a total alcoholic strength by volume greater than 15 % vol. and can consequently have a volatile acid content above the limits laid down in Part B of Annex V to Regulation (EC) No 1493/1999 but less than 25 milliequivalents per litre. Some Greek quality wines psr have a total alcoholic strength by volume of at least 13 % vol., entitling them to exceptions regarding the volatile acid content laid down in point 1 of Part B of Annex V to Regulation (EC) No 1493/1999. Those wines should be added to the list in Annex XIII to Regulation (EC) No 1622/2000. That Annex should also be amended on account of the accession of the Czech Republic, Cyprus, Hungary, Slovakia and Slovenia. |

Annex XVIII of Regulation (EC) No 1622/2000 sets out the quality liqueur wines psr to which the products referred to in point 2(b) of Part J of Annex V to Regulation (EC) No 1493/1999 may be added. That list should be amended by reason of the accession of Cyprus. |
(6) |
Regulation (EC) No 1622/2000 should therefore be amended accordingly. |
(7) |
For reasons of control and in order to provide for the application of the amendments to Regulation (EC) No 1622/2000 as from the date of entry into force of the Treaty of Accession of the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia, the Regulation should apply as from May 1 2004. |

The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Wine, |
HAS ADOPTED THIS REGULATION:
Article 1
Regulation (EC) No 1622/2000 is amended as follows:
1. |
in Title II, Chapter I, the following Article 18a is added: ‘Article 18a Pouring of wine or grape must to lees or grape marc or pressed aszú pulp The pouring of wine or grape must to lees or grape marc or pressed aszú pulp, provided for in point 4(d) of Annex IV to Regulation (EC) No 1493/1999, shall be carried out as follows, in accordance with the Hungarian provisions in force on 1 May 2004:

Part A of Annex III is replaced by the text in the Annex to this Regulation; |
3. |
the first paragraph of Annex XII is amended as follows:

Article 2
This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.
It shall apply from 1 May 2004.

amending Regulation (EC) No 1622/2000 laying down certain detailed rules for implementing Regulation (EC) No 1493/1999 on the common organisation of the market in wine and establishing a Community code of oenological practices and processes
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EC) No 1493/1999 of 17 May 1999 on the common organisation of the market in wine (1), and in particular Article 46(1) and (2) thereof,
Whereas:

The third subparagraph of Article 42(6) of Regulation (EC) No 1493/1999 lays down detailed rules on the coupage of white wines and red wines in areas where such a practice was traditional. This practice has now been prohibited in Spain since 1 August 2003. The specific rules applicable to the coupage of such wines in Spain laid down in Article 36 of Commission Regulation (EC) No 1622/2000 (2) are no longer applicable. That Article should therefore be deleted. |
(2) |
Five French table wines with geographical indications and with a total alcoholic strength by volume higher than 15 % vol. and a residual sugar content higher than 45 g/l have recently been designated by the French authorities and for their preservation in good quality conditions require a sulphur dioxide content above the general limit of 260 mg/l but less than 300 mg/l. Those wines should therefore be added to the list under the fifth indent of point (a) of the first paragraph of Annex XII to Regulation (EC) No 1622/2000. |
(3) |
One Italian quality wine psr and two French quality wines psr recently recognised by the French authorities which are made using special methods and have a residual sugar content of more than five grams per litre require, for their preservation in good quality conditions, a sulphur dioxide content above the general limit of 260 mg/l but less than 400 mg/l. The same applies to the Luxembourg quality wines psr for which special production methods have recently been laid down allowing them to be described by the words ‘vendanges tardives’, ‘vin de glace’ or ‘vin de paille’. Those wines should therefore be added to the list of wines with similar characteristics in point (b) of the first paragraph of Annex XII to Regulation (EC) No 1622/2000. |
(4) |
Certain French and Luxembourg quality wines psr and one Spanish quality wine psr, for which special production methods have recently been laid down or amended, are made using special methods and normally have a volatile acid content above the limits laid down in Annex V(B) to Regulation (EC) No 1493/1999 but less than 25, 30 or 35 milliequivalents per litre depending on the wine in question. Those wines should therefore be added to the list in Annex XIII to Regulation (EC) No 1622/2000. |
(5) |
Austrian quality wines psr meeting the requirements to be described as ‘Eiswein’ from the 2003 harvest have a volatile acid content above the limits laid down in point (d) of Annex XIII to Regulation (EC) No 1622/2000 but less than 40 milliequivalents per litre, as a result of exceptionally unfavourable weather conditions during the 2003 harvest. These wines from the 2003 vintage should therefore be added to the list in the second indent of point (d) of Annex XIII to that Regulation. |

The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Wine, |
HAS ADOPTED THIS REGULATION:

Article 36 is deleted; |

Annex XII is amended in accordance with Annex I to this Regulation; |

Annex XIII is amended in accordance with Annex II to this Regulation. |

amending Regulation (EC) No 753/2002 laying down certain rules for applying Council Regulation (EC) No 1493/1999 as regards the description, designation, presentation and protection of certain wine sector products
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EC) No 1493/1999 of 17 May 1999 on the common organisation of the market in wine (1), and in particular Article 53 thereof,
Whereas:

Certain amendments need to be made to Commission Regulation (EC) No 753/2002 (2) on account of the accession of the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia (hereinafter referred to as the new Member States) to the European Union. |
(2) |
With the Accession, it has become clear that the border of a wine-growing region is not necessarily within the border of one Member State and that traditional expressions can have a trans-border character. It is therefore necessary to modify the provision on traditional expressions in order to allow for the use under specific conditions of certain traditional expressions by two or more Member States. |
(3) |
Article 28 of Regulation (EC) No 753/2002 provides for rules specific to table wines with a geographical indication, and lists the traditional terms used in the different regions of the Member States to describe such wines. This list has to be adapted by the appropriate terms used by the new Member States. |
(4) |
The lists of the traditional specific terms and of the additional traditional terms have to be adapted by the appropriate terms used by the new Member States. |
(5) |
Annex II to Regulation (EC) No 753/2002 lists vine varieties and their synonyms that include a geographical indication and that may appear on the labelling of wines. This Annex has to be adapted by the appropriate terms that have been used by the new Member States at the date of application of this Regulation. |
(6) |
Regulation (EC) No 753/2002 should be amended accordingly. |
(7) |
For reasons of control and in order to provide for the application of the amendments to Regulation (EC) No 753/2002 as from the date of entry into force of the Treaty of Accession of the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia, this Regulation should apply as from 1 May 2004. |
(8) |
In order to facilitate the transition from the wine labelling regime that existed in the new Member States before the accession to the Community rules on wine labelling, it is necessary to allow economic operators to use labels and pre-packaging material printed in conformity with the previous national provisions. |
(9) |
The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Wine, |
HAS ADOPTED THIS REGULATION:

Regulation (EC) No 753/2002 is amended as follows:

in paragraph 5 of Article 24, the following subparagraph is added: ‘A traditional term is deemed traditional in the official language of one Member State if it has been used in that official language and in a specified border region of the neighbouring Member State(s) for wines elaborated under the same conditions provided that such a term fulfils the criteria in points (a) to (d) in one of these Member States and both Member States mutually agree to define, use and protect such a term.’; |

Article 2
In the case of Slovenia, products covered by this Regulation, the description and presentation in Slovenian of which conformed to the provisions applicable in Slovenia before its accession to the Community on 1 May 2004 and were put into circulation before the accession but do not conform to this Regulation, may be held for sale and exported until stocks are exhausted, however, by the latest on 30 April 2006 and in case of the vintage year 2003, on 30 April 2007.
Article 3
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
It shall apply from 1 May 2004.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION DECISION
of 2 August 2004
amending Decision 97/467/EC as regards the inclusion of one establishment in Iceland for farmed game meat and one establishment in Botswana for ratite meat in provisional lists of third country establishments from which Member States are authorised to import such products

THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Decision 95/408/EC of 22 June 1995 on the conditions for drawing up, for an interim period, provisional lists of third country establishments from which Member States are authorised to import certain products of animal origin, fishery products or live bivalve molluscs (1), and in particular Article 2(4) thereof,
Whereas:

Commission Decision 97/467/EC of 7 July 1997 drawing up provisional lists of third country establishments from which the Member States authorise imports of rabbit meat and farmed game meat (2) sets out provisional lists of establishments in third countries from which the Member States are authorised to import farmed game meat, rabbit meat and ratite meat. |
(2) |
Iceland has provided the name of one establishment producing farmed game meat for which the responsible authorities certify that the establishment complies with the Community rules. |
(3) |
Botswana has provided the name of one establishment producing ratite meat for which the responsible authorities certify that the establishment complies with Community rules. |
(4) |
Accordingly, those establishments should be included in the lists set out in Decision 97/467/EC. |
(5) |
As on-the-spot inspections of the concerned establishments have not yet been carried out, imports from them should not be eligible for reduced physical checks pursuant to Council Directive 97/78/EC of 18 December 1997 laying down the principles governing the organisation of veterinary checks on products entering the Community from third countries (3). |
(6) |
Decision 97/467/EC should therefore be amended accordingly. |
(7) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS ADOPTED THIS DECISION:
Article 1
Annex I to Decision 97/467/EC is amended in accordance with Annex I to this Decision.
Article 2
Annex II to Decision 97/467/EC is amended in accordance with Annex II to this Decision.
Article 3
This Decision shall apply from 17 August 2004.
Article 4
This Decision is addressed to the Member States.

amending Decision 1999/659/EEC fixing an indicative allocation by Member State of the allocations under the European Agricultural Guidance and Guarantee Fund-Guarantee section for rural development measures for the period 2000 to 2006

THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EC) No 1257/1999 of 17 May 1999 on support for rural development from the European Agricultural Guidance and Guarantee Fund (EAGGF) (1), and in particular Article 46(2) thereof,
Whereas:
(1) |
By Decision 1999/659/EC (2), the Commission determined the initial allocations to the Member States for rural development measures part-financed by the EAGGF Guarantee Section for the period 2000 to 2006. |
(2) |
In accordance with Article 46(3) of Regulation (EC) No 1257/1999, initial allocations shall be adjusted on the basis of actual expenditure and revised expenditure forecasts submitted by the Member States taking into account programmes objectives. |
(3) |
In accordance with Article 57(2) of Commission Regulation (EC) No 817/2004 of 29 April 2004 laying down detailed rules for the application of the Council Regulation (EC) No 1257/1999 on support for rural development from the European Agricultural Guidance and Guarantee Fund (EAGGF) (3), the Commission shall adapt the initial allocations per Member State fixed by Decision 1999/659/EC within two months of the adoption of the budget for the financial year concerned. |
(4) |
The adaptations of the initial allocations has to take into account the financial execution realised by Member States in the years 2000-2003 and the revised forecasts for 2004, 2005 and 2006, submitted before 1 October 2003. |
(5) |
Decision 1999/659/EC should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
The Annex to Decision 1999/659/EC is replaced by the text set out in the Annex to this Decision.
Article 2
This Decision is addressed to the Kingdom of Belgium, the Kingdom of Denmark, the Federal Republic of Germany, the Hellenic Republic, the Kingdom of Spain, the French Republic, Ireland, the Italian Republic, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands, the Republic of Austria, the Portuguese Republic, the Republic of Finland, the Kingdom of Sweden and the United Kingdom of Great Britain and Northern Ireland.
