CALL FOR PROPOSALS

‘Support for information measures relating to the common agricultural policy’

Implementation of information measures under budget heading 05 08 06 for 2009

1.   INTRODUCTION

This call for proposals is based on Council Regulation (EC) No 814/2000 of 17 April 2000 on information measures relating to the common agricultural policy (1) which defines the type and content of the information measures the Community may co-finance. Commission Regulation (EC) No 2208/2002 (2), modified by Regulation (EC) No 1820/2004 (3), lays down detailed rules for the application of Regulation (EC) No 814/2000.

This is a call for proposals for funding information measures as described under Article 3(1) of Regulation (EC) 814/2000 from appropriations in the 2009 budget. This call for proposals concerns information measures to be implemented (including preparation, implementation, follow-up and evaluation) between 1 June 2009 and 31 May 2010.

An information measure is a self-contained and coherent information event organised on the basis of a single budget. The activities included in such an event range from a simple conference to a comprehensive information campaign covering several types of information activities (such as conferences, audiovisual productions, mobile workshops, …) carried out in one or more regions of the Member States. In the case of such campaigns, the different activities foreseen shall be interconnected, clear in their conceptual approach and the results to be achieved and the work schedule shall be appropriate and realistic with regard to the project goals. Measures shall be carried out in EU-27 and respect the time limits explained in point 3 (duration and budget) below.

As specified in Article 4(2) of Regulation (EC) No 2208/2002, applicants for this call for proposals shall be legal persons legally constituted in a Member State for at least two years, in particular:

farmers' or rural development organisations,

consumers' associations,

environmental protection associations,

public authorities of the Member States,

medias,

universities.

2.   PRIORITIES AND OBJECTIVES FOR 2009

2.1.   Priorities

Under this call for proposals the Commission wishes to give priority to:

raising the general public's awareness on the CAP (including its rural development dimension) in the Member States. Communicating to the general public the multifunctional role of EU farmers which goes beyond food production. Farmers are also stewards of the countryside, they play an important role in conserving our common natural heritage and in many rural areas they continue to be the economic heartbeat,

discussing with agricultural stakeholders in rural areas the opportunities and benefits the two pillars of the CAP offer for the agricultural sector and for the sustainable development of rural regions,

communicating the reformed Common Agricultural Policy (CAP) and in particular:

the need to better respond to market opportunities,

emphasizing that the reformed CAP has strengthened the EU farmers' ability to respond to market signals, thereby giving the EU an opportunity to strengthen its supply of food at a time of higher food prices and help to alleviate the concerns about food security in some parts of the world,

the simplification and better targeting of the direct support to farmers,

the strengthening of the rural development policy to respond to new challenges, mainly related to climate change, water management, renewable energy and biodiversity,

discussing EU schemes within the CAP aiming at promoting healthier diet and healthy eating habits, especially fruit and vegetables for school children,

communicating to the general public the reformed CAP as an essential contribution to reaching the EU objectives in international trade,

discussing the EU policy concerning the quality of agricultural products.

2.2.   Messages to be communicated

The Commission wishes to receive applications for information measures focusing on the following messages:

the CAP is a living policy. It evolves to reflect the changing priorities of society. It was conceived as a fundamental part of the European construction with a strong focus on the European farming community. Today, European Agriculture plays a fundamental role in our societies. It directly affects the quality of our environment, the food we eat and the way we treat farm animals — issues that affect us all. The CAP seeks to promote a sustainable agriculture that responds positively to the concerns of citizens not only in agricultural communities — but in society at large,

the CAP supports farmers to help them fulfil their role as the economic heartbeat of rural areas. It enables them to supply both high-quality and safe food and public goods which cannot be provided solely by the market: the preservation of a lively economic and social rural fabric, environmental protection and preserved landscapes,

international trade barriers are being gradually dismantled. It is a trend we welcome — not least as a means of fostering further development in the world's poor countries. European agriculture is increasingly faced with competition from producers in third countries. The CAP embraces international trade. It allows European agriculture to play to its strength by promoting a sector that is competitive, innovative, responsive to the market and that focuses on the production of quality products and the identification of alternative outlets for its products such as biofuels,

agricultural subsidies are financed by tax-payers' money. We must ensure that they are correctly spent and managed in a transparent way. But we also need to make sure that the CAP is governed by simple, clear, transparent and cost efficient rules. The burden of management for those that abide by them and for those that control them should be reasonable,

the vast majority of the EU territory is in rural areas. These areas are an important source of employment and constitute a strong symbol of Europe's cultural heritage. The CAP fosters a rural development policy that supports growth and job creation in the rural areas — both within and beyond the agricultural sector in a way that will reinforce the social and environmental fabric of our rural areas.

2.3.   Types of information measures

Under this call for proposals the Commission wishes to receive applications for the following types of information measures:

TV and radio programmes (such as documentaries, talk shows, etc),

visual, audio and audiovisual productions and their distribution,

actions targeting schools and universities,

conferences, seminars and workshops (including mobile ones), especially in rural areas,

exchange information visits, especially between old and new Member States,

information stands at agricultural fairs,

information campaigns, comprising several types of the above mentioned type of information measures,

other types of information measures, such as publications and web portals will only be considered if they are executed in one of the languages of the 12 new Member States.

2.4.   Target audiences

The target audiences for projects under this call for proposals are:

the general public in the EU-27,

the general public in rural areas,

agricultural stakeholders, farmers and other potential beneficiaries of rural development measures.

3.   DURATION AND BUDGET

This call for proposals concerns information measures to be implemented (including preparation, implementation, follow-up and evaluation) between 1 June 2009 and 31 May 2010.

The total foreseen budget available for the information measures to be carried out under this call for proposals is EUR 2 900 000. This amount will be distributed among the measures considered of highest quality, according to award criteria mentioned in Annex III, point 2. The Commission reserves the right to diminish this total available amount, as well as to award only part of it.

The amount of grant requested from the Commission shall be between EUR 12 500 and EUR 200 000 per information measure (flat rate for staff costs included).

Eligible costs are defined in Annex IV (drawing up of the budget). The contribution from the Commission to the selected information measures is limited to 50 % of the total eligible costs excluding the staff costs. In addition to this amount, a flat rate amount to cover all the staff costs will be paid. This flat rate may not exceed EUR 10 000 if the total of direct eligible costs of the measure (staff costs excluded) is above EUR 15 000, or EUR 5 000 if the total of direct eligible costs of the information measure (staff costs excluded) is less than or equal to EUR 15 000. For information measures of exceptional interest, and if requested in the application, the percentage of contribution from the Comission may increase up to 75 %.

An information measure will be recognised as being of exceptional interest as referred to in Article 7(2) of Regulation (EC) No 2208/2002 if the four following conditions are met:

1.

it is carried out in one of the 12 new Member States;

2.

it is of high technical quality and cost-efficiency;

3.

its dissemination plan is such as to guarantee the dissemination of the information to the largest possible audience;

4.

it has been awarded by the evaluation committee (‘The committee’) at least 75 points out of 100 points for award criteria as set out in Annex III, point 2 (award criteria).

No prefinancing will be allowed for the information measures that have been awarded a grant under this call for proposals. Selecting an application does not commit the Commission to granting the full amount requested by the applicant. In no circumstances will the grant exceed the amount requested.

4.   GENERAL INSTRUCTIONS FOR SUBMITTING AN APPLICATION

4.1.   How to prepare an application

Each applicant may apply for only one information measure per budget year.

Applications shall be drawn up by using the appropriate forms available at the following internet address:

Applicants may write their application in any of the official languages of the Community. Nevertheless, in order to facilitate a timely treatment of their application, applicants are encouraged to submit their application in English or French. If this is not possible, applicants should at least include a translation of the content of form 3 in English or French.

The application shall contain the following documents to be found on the web address mentionned above:

the application letter mentioning the title of the proposed information measure and the amount of grant requested, signed by the legally authorised representative within the applicant organisation,

form No 1 (information on the applicant), No 2 (information on the co-organisers — if applicable), No 3 (detailed description of the information measure) of the application. Applications must be submitted in a sealed envelope or cardboard box itself enclosed within a second sealed envelope or cardboard box. The inner envelope or cardboard box must bear, in addition to the name of the department to which it is addressed, as indicated in the call for proposals, the words ‘Call for proposals — Not to be opened by the mail service’. If self-adhesive envelopes are used, they must be sealed with adhesive tape and the sender must sign across that tape.

5.   PROCEDURE AND TIMETABLE

5.1.   Receipt and registration of applications

The Commission will register your application and send you a confirmation of receipt by email with the number attributed to your application within 15 working days from the submission deadline.

5.2.   Examination of applications in light of eligibility and exclusion criteria.

An ad hoc evaluation committee will proceed with the examination of eligibility of applications. Applications that do not fulfil one or more criteria set out in Annex II (eligibility and exclusion criteria) will be rejected.

All eligible applications will be admitted to the next phase (examination in light of the selection criteria — technical and financial capacity of the applicants).

5.3.   Examination of applications in light of the selection criteria — technical and financial capacity of the applicants

During this phase the committee will examine the technical and financial capacity of the eligible applicants on the basis of the information provided in the application according to the criteria described in Annex III(1) (selection criteria).

All applications that have passed this phase will be admitted to the next phase (evaluation in light of award criteria).

5.4.   Evaluation of applications in light of the award criteria

During this phase, the committee will evaluate applications in light of the award criteria explained in Annex III(2) (award criteria). Only applications having received at least 60 out of 100 available points, and at least 50 % of the points available for each criterion, during this phase will be proposed for a grant by the committee. Having received 60 out of 100 available points does not guarantee, however, that an information measure will be awarded a grant. The Commission might raise the minimum acceptable rating in view of the number of successful applications and the budgetary resources available.

Applications having received less than 60 out of 100 available points or less than 50 % of the points available for each criterion will be rejected and the applicant will receive written information giving the reasons for the rejection.

If a grant is awarded, the beneficiary will receive a grant agreement (model available from the web address mentioned in point 4.1 of this call for proposals), denominated in euros, specifying the conditions and level of financing, which may be inferior to the amount requested in the application. In case of arithmetical errors or costs considered ineligible, the budget will be corrected by the Commission services. If the correction leads to a higher amount of total costs, the amount requested will remain unchanged and the contribution of the applicant will be increased accordingly.

The expected date for the end of the evaluation procedure is the 31 May 2009. The Commission services are not authorised to inform applicants on the status of the evaluation of their application before the award decision. For this reason, applicants are requested not to telephone or write to the Commission concerning the result of their application before the expected date mentioned above.

6.   PUBLICITY

The beneficiaries will be under a contractual obligation to ensure, by all appropriate means and in accordance with the conditions laid down in the grant agreement, that the funding awarded to the information measure by the Commission is publicised during the life of the information measure and acknowledged in any publications and permanent or ongoing publicity material subsequent to this and that the sole responsibility on the content of the information measure lies with the author of the communication or publication, and that the Commission is not responsible for any use that may be made of the information contained therein. Evidence of this publicity shall be included in the final technical implementation reports.

If the beneficiary organisation does not comply with the aforementioned obligation, the Commission reserves the right to reduce the grant amount allocated to the concerned information measure or refuse complelety the payment of the grant to the beneficiary.

7.   PROTECTION OF PERSONAL DATA

The European Commission ensures that any personal data contained in the application are processed as required by Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data (4). This applies in particular to the confidentiality and security of such data.

ANNEX II

ELIGIBILITY AND EXCLUSION CRITERIA

1.   ELIGIBILITY CRITERIA

(a)   Eligibility criteria concerning the applicant

the applicant shall be a legal person legally constituted in a Member State for at least two years. This shall be clearly shown in the application and the supporting documents. Applicants that have not been legally constituted in a Member State for at least two years, or fail to prove it, will be disqualified.

(b)   Eligibility criteria concerning the application

The application under this call for proposals shall fulfil all the following criteria:

it shall be submitted on 14 November 2008 by the latest (the postmark on the envelope being taken as proof of the date of sending),

it shall be drawn up using the original forms available for download from the Internet address mentioned in point 4.1 for the application and budget,

it shall be written in one of the official languages of the Community,

it shall contain all documents listed in point 4.1 of this call for proposal,

the letter of the application shall mention the title of the information measure and the amount of grant requested and shall be signed by the legally authorised representative within the applicant organisation,

applicants are allowed to submit only one application per budget year,

the amount of grant requested from the Commission (including the flat rate amount for the staff costs) shall be between EUR 12 500 and EUR 200 000,

the budget of the proposed information measures must:

be presented in euro,

contain one expenditure and one income table in balance,

be dated and signed in both expenditure and income tables by the legally authorized representative within the applicant organisation,

be drawn up using detailed calculations (quantities, unit prices, total prices) and specifications used in drawing it up; no flat rate amounts (except for staff costs) will be accepted,

respect the maximum amounts established by the Commission for certain categories of expenditure (see Annex IV and document ‘maximum accommodation costs (hotel) accepted by the Commission’ available at the web address mentioned in point 4.1),

be presented without VAT if the applicant is subject to VAT and entitled to deduct it,

include on the income part the direct contribution from the applicant, the requested Commission funding, and (if applicable) details of any contributions from other providers of funds, as well as all revenue generated by the project, including, where appropriate, the fees required of participants.

The dates of the proposed information measure shall be between 1 June 2009 and 31 May 2010.

The following are not eligible:

measures required by law, measures receiving Community financing from another budget line,

profit-making measures,

general assemblies or statutory meetings.

All applications not fulfilling one or more of the above criteria will be rejected as non-eligible.

2.   EXCLUSION CRITERIA

The Commission will exclude all applicants that find themselves in one of the situations described in Article 5 of Regulation (EC) 2208/2002 and Articles 93(1), 94 and 96(2)(a) of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities. Grants may not be awarded to applicants who are, at the time of a grant procedure, in one of the following situations:

they are in bankruptcy or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations,

they have been convicted of an offence concerning their professional conduct by a judgement which has the force of res judicata,

they have been guilty of grave professional misconduct proven by any means which the contracting authority can justify,

they have not fulfilled obligations relating to payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the contracting authority or those of the country where the measure is to be performed,

they have been the subject of a judgement which has the force of res judicata for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the Community's financial interests,

following another procurement procedure or grant award procedure financed by the Community budget, they have been declared to be in a serious breach of contract for failure to comply with their contractual obligations,

they have knowingly submitted false declarations in providing the information required,

they are subject to a conflict of interest,

they are guilty of misrepresentation in supplying the information required by the authorising department or of failing to supply this information.

Applicants will have to declare on honour that they are not in one of the above situations (see the application letter available from the web address mentioned in point 4.1 of this call for proposals). The Commission may, depending on the analysis of management risks, request additional evidence. Applicants who are found guilty of false declarations may be subject to administrative and financial penalties.


ANNEX III

SELECTION AND AWARD CRITERIA

1.   SELECTION CRITERIA

In order to demonstrate their technical capacity applicants shall show that:

they have the necessary technical skills of direct relevance to the preparation, implementation, follow-up and evaluation of the type information measure proposed,

they have at least two years experience in dealing with the subject(s) proposed.

In order to demonstrate their financial capacity applicants shall show that:

their financial situation is sound enough to maintain their activity throughout the period during which the information measure is being carried out.

The technical and financial capacity of the applicants will be judged based on the information provided by the applicants in the application. The Commission may, however, request additional information. Applicants are reminded that the Commission will not give pre-financing to the information measures awarded a grant under this call for proposals. Applicants will have to assume the total cost of the information measures themselves. The Commission grant will only be paid following the approval of the final technical and financial implementation report submitted by the beneficiaries after the end of the information measure.

2.   AWARD CRITERIA

Each information measure will be evaluated by the ad hoc committee in light of the following criteria:

1.

(maximum 25 points): the relevance and general interest of the measure are to be appraised, in particular, in light of:

the extent to which the goals and the content of the measure are in line with the objectives laid down in Article 1 of Regulation (EC) No 814/2000 and the priorities and objectives set out in the call for proposals (15 points),

the overall quality of the proposal. Project proposals should be clear in their conceptual approach and the results to be achieved. The description of the action and the messages shall be precise and the respective roles and responsibilities of the applicant and each co-organiser should be clear. The programme of the measure shall be detailed. The work schedule should be appropriate and realistic with regard to the project goals (10 points);

2.

(maximum 25 points): the overall added value of the proposal is to be appraised, in particular, in light of:

the countries covered by the measure. Preference will be given to measures addressing audiences in more than one Member State and/or addressing the general public in the 12 new Member States (10 points),

the number and representativeness of the organisations — not including subcontractors — involved in drawing up, implementing and disseminating the measure (5 points),

the financial quality of the proposal. Proposals should demonstrate that the measure will offer good value for the financial support requested from the Commission and that it will be cost-effective (10 points);

3.

(maximum 25 points): the impact of the measure and the dissemination policy chosen will be assessed, in particular, in light of:

the dimension, quality and representativeness of the target audience (including the indirect beneficiaries) in relation to the type of measure (10 points),

the capacity of the applicant and co-organisers to ensure effective follow-up, disseminate the results achieved and the dissemination channels used (in particular the press, radio and television, Internet, direct distribution), and their role in the measure (15 points);

4.

(maximum 25 points): the evaluation of the measure will be appraised, in particular, in light of:

the motivation of the expected interest in the measure and the assessment of the results after the execution of the measure (15 points),

the techniques used (surveys, questionnaires, statistics, etc.) to measure the impact of the messages sent (10 points).

Measures will be considered of highest quality and will be proposed for a grant by the Evaluation Committee if they receive at least 60 out of 100 points allocated for the criteria 1 to 4 as described above, and have at least 50 % of the points available for each criterion. The Commission may increase the minimum acceptable rating in light of the budget resources available. Please note that the final decision of the Commission to award a grant may differ from the proposal issued by the Committee.


ANNEX IV

DRAWING UP OF THE BUDGET

The budget should respect all the relevant rules foreseen in Annex II (Eligibility and Exclusion Criteria). It should be presented using the original forms (expenditure and income tables) in one of the three following languages: EN, FR or DE.

The expenditure table has to be specific and allow a clear understanding of each expenditure (e.g. no ‘other’). The different categories of costs should be reflected in the description of the information measure (Form 3).

The income table has to be specific and allow a clear understanding of each revenue/financial contribution and respect the non-profit rule. Proofs of contributions from other providers of funds must be annexed (see doc. H of Annex I).

In order to facilitate the drawing up of the budget, an example of a correctly filled in budget is available at the Internet address mentioned in point 4.1.

The expenditure table of the budget should include only eligible costs (see hereafter).

Any expenditure incurred before the agreement is signed is at the own risk of the applicant and will not be legally or financially binding on the Commission.

1.   Eligible costs

Eligible costs of the information measure are costs actually incurred by the beneficiary, which meet the following criteria:

(a)

they are connected with the subject of the agreement and they are indicated in the estimated overall budget of the information measure;

(b)

they are necessary for the implementation of the information measure which is the subject of the grant;

(c)

they are incurred and paid by the beneficiary during the duration of the information measure as specified in Article I.2.2 of the grant agreement i.e., supported by the original supporting documents (see table in point 3 hereafter) and by the respective proofs of payment;

(d)

they are identifiable and verifiable, in particular being recorded in the accounting records of the beneficiary and determined according to the applicable accounting standards of the country where the beneficiary is established and according to the usual cost-accounting practices of the beneficiary;

(e)

they are reasonable, justified, and comply with the requirements of sound financial management, in particular regarding economy and efficiency;

(f)

they comply with the requirements of applicable tax and social legislation,

SUPPLIERS/SUBCONTRACTORS for services exceeding EUR 10 000.

Please note that where the applicant intends to use suppliers/subcontractors and where the amount of all services to be rendered by one supplier/subcontractor exceeds EUR 10 000, the applicant will have to submit to the Commission at least three tenders asked from at least 3 different companies, to annex the tender chosen and the reason of this choice (applicants will have to show that the supplier/subcontractor selected represents the best value for money and must justify their choice where the tender selected is not the cheapest).

These documents have to be submitted as soon as possible to the Commission and at the latest with the final technical and financial reports.

Failure to do this will entitle the Commission to consider those costs as non eligible.

2.   Non-eligible costs

The following costs shall not be considered eligible:

contributions in kind,

non-specified or flat-rate expenditure, except in the case of staff costs,

indirect costs (rent, electricity, water, gas, insurance, taxes, etc.),

costs of office material (such as paper, stationery etc.),

costs arising from the purchase of new or second-hand equipment,

depreciation costs of equipments,

costs not provided for in the forward budget,

VAT, unless the beneficiary can show that he/she is unable to recover it according to the applicable national legislation,

return on capital,

debt and debt service charges,

provisions for losses or potential future liabilities,

interest owed,

doubtful debts,

exchange losses,

costs declared by the beneficiary and covered by another action or work programme receiving a Community grant,

excessive or reckless expenditure.
