COMMISSION OPINION

of 9 July 2007

concerning the plan for the disposal of radioactive waste from the NCS radioactive waste storage facility at the Hanau site in Germany, in accordance with Article 37 of the Euratom Treaty

On 18 October 2006, the European Commission received from the Government of the Federal Republic of Germany, in accordance with Article 37 of the Euratom Treaty, General Data relating to the plan for the disposal of radioactive waste from the NCS facility at the site of Hanau.

On the basis of these data and the additional information requested by the Commission on 7 December 2006 and provided by the German Government on 31 January 2007, and following consultation with the Group of Experts, the Commission has drawn up the following opinion:

1.

The distance between the plant and the nearest point on the territory of another Member State, in this case France, is approximately 150 km.

2.

During normal operation, discharges of liquid and gaseous effluents will not cause an exposure liable to affect the health of the population in other Member States.

3.

Solid radioactive waste from the production operations will be eliminated at an approved site.

4.

In the event of unplanned releases of radioactive effluents resulting from an accident of the type and magnitude considered in the General Data, the doses received in other Member States would not be liable to affect the health of the population.

In conclusion, the Commission is of the opinion that the implementation of the plan for the disposal of radioactive waste in whatever form from the operation of the NCS facility at the Hanau site in the Federal Republic of Germany, both in normal operation and in the event of an accident of the type and magnitude considered in the General Data, is not liable to result in the radioactive contamination of the water, soil or airspace of another Member State.

Call for proposals under the multiannual Community Programme on promoting safer use of the Internet and new online technologies (Safer Internet plus)

1.   Objectives and description

The European Commission has adopted a Work Programme and a Call for proposals to implement the Safer Internet plus Programme (1).

The present call is open for proposals addressing the following actions:

1.   Fighting against Illegal Content

1.1.

Integrated network: Hotlines for reporting illegal content

1.2.

Integrated network: Hotline co-ordinator

1.3.

Targeted projects: Enhancing law enforcement agencies' analysis of illegal material

1.4.

Thematic network: Facilitating cooperation of law enforcement agencies in Europe and internationally

2.   Tackling unwanted and harmful content

There will not be a call for new actions under this action line in 2007.

3.   Promoting a Safer Environment

3.1.

Thematic network: NGO network for child protection on the internet

4.   Awareness-raising

4.1.

Integrated network: Awareness nodes

4.2.

Integrated network: Awareness network co-ordinator

4.3.

Integrated network: Helplines, where children can raise concerns about illegal and harmful content and uncomfortable or scary experiences related to their use of online technologies

2.   Eligible applicants

The call for proposals under this Work Programme is open to all legal entities established in the Member States. It is also open to participation of legal entities established in EFTA States which are contracting parties to the EEA Agreement (Norway, Iceland and Liechtenstein).

It is furthermore open to legal entities established in Turkey, Croatia and the Former Yugoslav Republic of Macedonia (2). If proposals submitted by legal entities from these countries are selected for funding, a grant agreement will only be signed once the necessary steps have been taken for the country concerned to join the Programme through signature of a bilateral agreement. Up to date information on which countries are part of the Programme is available on the programme website at: http://ec.europa.eu/saferinternet

Legal entities established in third countries and international organisations may take part in all projects at their own expense.

3.   Budget

The indicative total budget available for this call is EUR 11,51 million of Community contribution under the 2007 budget.

4.   Deadline

The deadline for receipt of proposals by the Commission is 22 October 2007 at 17.00 (Luxembourg local time).

All applications must comply with the specifications and conditions described in the full text of the call for proposals, the Work Programme and the Guide for proposers which are available in English on the Commission's above-mentioned internet site. These include information on how to prepare and submit proposals.

The evaluation of proposals will be based on the principles of transparency and equality of treatment. It will be carried out by the Commission with the assistance of outside experts. Each submission will be assessed on the basis of the evaluation criteria set out in the Safer Internet plus 2007 Work Programme.

All proposals received by the European Commission will be treated in strict confidence.

On 29 June 2007, the Commission received a notification of a proposed concentration pursuant to Article 4 and following a referral pursuant to Article 4(5) of Council Regulation (EC) No 139/2004 (1) by which the undertaking Austrian Energy & Environment AG & Co KG (‘AEE’, Austria) belonging to the Austrian A-Tec group (‘A-Tec’, Austria), acquire(s) within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Lentjes GmbH (‘Lentjes’, Germany), by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

for A-Tec: engineering and manufacturing in the area of energy and environment technology;

for Lentjes: engineering in the area of energy and environment technology.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

On 2 July 2007, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Barclays PLC (‘Barclays’, UK) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking ABN AMRO Holding N.V. (‘ABN AMRO’, the Netherlands) by way of public bid announced on 23 April 2007.

2.

The business activities of the undertakings concerned are:

for undertaking Barclays: a global financial services provider;

for undertaking ABN AMRO: international bank.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

for Heidelberg: production of cement, aggregates, ready-mix concrete, cement additives and other related products;

for Hanson: production of aggregates, cement additives, ready-mix concrete and other related products.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.
