Σύμφωνα με το άρθρο 4 (1) του Ν. 109(Ι)/2001, η Αρμόδια Αρχή έχει εξουσία και αρμοδιότητα να εκπονεί και εφαρμόζει ειδικά προγράμματα και να καταρτίζει ειδικά σχέδια αντιμετώπισης ζωικών ασθενειών. Οι ενισχύσεις εντάσσονται στο πλαίσιο προγράμματος που έχει εκδοθεί δυνάμει του άρθρου αυτού.

Annual expenditure planned under the scheme or overall amount of individual aid granted to the company: Expenditure scheduled for 2010 amounts to EUR 50 000. It is estimated that the same amount will be needed for 2011.

Maximum aid intensity: 100 %

Date of implementation: The programme will be implemented only after it has been published by the European Commission in accordance with Regulation (EC) No 1857/2006.

Duration of scheme or individual aid award: Until 31 December 2011.

Objective of aid: Prevention and eradication of Maedi/Visna in sheep and caprine arthritis/encephalitis, with a view to officially identifying the holdings that are free from the diseases. The scheme concerns the free provision of tests falling within the aid authorised under Article 10(1) of Regulation (EC) No 1857/2006.

Sector(s) concerned: The beneficiaries of aid under this scheme are sheep and goat farmers in the areas controlled by the Republic of Cyprus.

The aid under the voluntary control programme for Maedi/Visna in sheep and caprine arthritis/encephalitis is aimed at farmers who voluntarily submit a request to be included in the scheme, with a view to officially establishing that their holdings are free from Maedi/Visna in sheep and caprine arthritis/encephalitis.

The diseases are included in the list of the World Organisation for Animal Health (OIE).

2.

The beneficiaries of the aid under the scheme are sheep and goat farmers in the areas controlled by the Republic of Cyprus who voluntarily join the scheme by submitting a correctly filled out binding statement, as provided for in the scheme.

3.

The scheme applies to small and medium-sized enterprises as defined in Commission Recommendation 2003/361/EC of 6 May 2003 concerning the definition of micro, small and medium-sized enterprises. Large enterprises are excluded from the scope of the scheme. State aid for combating animal diseases can be provided to large undertakings if it is notified in advance to the Commission for approval under Chapter V.B.4 of the Community Guidelines for State aid in the Agriculture and Forestry Sector 2007 to 2013.

The scheme applies exclusively to the primary production of agricultural products. Therefore, undertakings that engage in the marketing and/or processing of agricultural products (e.g. animal traders, butchers) do not fall within the scope of the scheme. The definitions of the marketing and processing of agricultural products are set out in Article 2(3) and (4) of Regulation (EC) No 1857/2006.

The aid will be provided only for activities engaged in or services received after the scheme is set up and published in accordance with Commission Regulation (EC) No 1857/2006. An application must be submitted to the competent authority and the aid itself is granted for activities engaged in and services received only if the following conditions are met: (a) the aid scheme must have been set up and published in accordance with Commission Regulation (EC) No 1857/2006; (b) an aid application must have been duly submitted to the competent authority; (c) the application must have been accepted by the competent authority concerned in a manner which obliges that authority to grant the aid, clearly indicating the amount of aid to be granted or how this amount will be calculated; such acceptance by the competent authority may only be made if the budget available for the aid or aid scheme is not exhausted.

The diseases are included in legal provisions and payment of the aid is made as part of a public programme at national level as mentioned above under the paragraph entitled Legal Basis, in application of Article 10(4) of Commission Regulation (EC) No 1857/2006.

7.

The aid must not relate to diseases in respect of which Community legislation provides for specific charges for control measures.

8.

The aid must not relate to measures in respect of which Community legislation provides that their cost is to be borne by the agricultural holding.

Annual expenditure planned under the scheme or overall amount of individual aid granted to the company: Maximum overall amount: EUR 90 000.

Maximum aid intensity: The amount of aid will be no more than 25 % of the amount of the losses calculated for each of the eligible producers.

Date of implementation: From receipt of the acknowledgement of receipt showing the identification number of the measure and publication of the summary of the measure on the Commission’s website.

Duration of scheme or individual aid award: The scheme will end on 31 December 2010.

Objective of aid: This aid scheme comes under Article 11 of Regulation (EC) No 1857/2006 of 15 December 2006.

As the ‘Fonds national de garantie des calamités agricoles’ (French agricultural disaster guarantee fund) does not cover damage caused to fruit growers by hail and as, in this sector consisting solely of small and medium-sized agricultural enterprises, very few growers had taken out insurance for 2009, the Conseil général de la Savoie (Savoy Departmental Council) wishes, within the limits of the appropriations available, to support fruit growers in the Albertville region whose crops have been seriously affected by hail and who have suffered losses of at least 30 %.

Aid will be given to those growers who fell victim to the exceptional climatic events, i.e. the violent hail storms accompanied by winds of more than 90 km/h, which occurred on the night of 24 August 2009 and significantly affected the production of apples and pears in the Albertville region.

In accordance with Article 11(3) of the agricultural exemption Regulation, for any farmer who was a beneficiary of an insurance contract prior to the disastrous event, the maximum amount of loss eligible for aid will be reduced by the amount of compensation received under the insurance policy taken out.

The rules for calculating the allowances will be the same as those adopted for aid from the FNGCA in scheme XA 37/10 by the departmental committee set up to assess harvest losses in the crops concerned (http://ec.europa.eu/competition/state_aid/register/ii/doc/XA%20037-10-FR.pdf).

In any event, the production loss threshold must be at least 30 % of the average annual production over the preceding three years. Losses will be calculated for each individual farm and aid will be paid directly to each farmer affected.

Sector(s) concerned: This aid will be paid only to farms producing apples and/or pears in the affected municipalities acknowledged by the prefectural decree of 2 April 2010 on harvest losses following the storms of 24 August 2009:

Albertville, Allondaz, Cléry, Frontenex, Gilly-sur-Isère, Grignon, Marthod, Mercury, Montailleur, Monthion, Notre-Dame-des-Millières, Pallud, Plancherine, Saint-Vital, Thénésol, Tournon and Verrens-Arvey, and:

whose size does not exceed that of an SME as defined in EU legislation (cf. Annex I to Commission Regulation (EC) No 800/2008 of 6 August 2008, OJ L 214 of 9.8.2008),

that are active in the primary production of agricultural products,

that are not enterprises in difficulty within the meaning of the Community guidelines on State aid for the rescue and restructuring of companies in difficulty (OJ C 244 of 1.10.2004).

Objective of aid: Applicable provision: Article 12 of Regulation (EC) No 1857/2006 of 15 December 2006.

The objectives of the aid are:

to support farmers in Baden-Württemberg and to enable them to adequately cover themselves against the risk of hail at economically bearable costs,

to prevent economic loss for primary agricultural production caused by adverse climatic events which can be assimilated to natural disasters and other losses caused by weather conditions,

to stimulate the uptake of insurance against risks of hail in agriculture.

Hail insurance premiums for agricultural field use, including all specialised crops from a premium rate of at least 10,01 %, are eligible.
