COMMUNICATION FROM THE COMMISSION TO THE EUROPEAN PARLIAMENT pursuant to the second subparagraph of Article 251 (2) of the EC Treaty concerning the common position of the Council on the adoption of a Directive of the European Parliament and of the Council amending Council Directives 90/425/EEC and 92/118/EEC as regards health requirements for animal by-products

1. BACKGROUND

Date of transmission of the proposal to the EP and the Council (document COM(2000)573 final 2000/0230 COD): // 19.10.2000.

Date of the opinion of the Economic and Social Committee: // 26.4.2001.

Date of the opinion of the European Parliament, first reading: // 12.6.2001.

Date of adoption of the common position: // 20.11.2001.

2. OBJECTIVE OF THE COMMISSION PROPOSAL

This proposal makes necessary changes to Directives 90/425/EEC and 92/118/EEC, consequent on the adoption of the Regulation on animal by-products not intended for human consumption, in order to avoid overlap between the Regulation and the two Directives.

3. COMMENTS ON THE COMMON POSITION

As the Council agrees with the European Parliament on an earlier date of entry into force of the Regulation on animal by-products not intended for human consumption, the Common Position establishes that the date of entry into force of this Directive must correspond to the date of application of the Regulation.

Furthermore, as the Council agrees to clarify in the scope of the Regulation on animal by-products that Member States can regulate the importation and placing on the market of products for which the Annexes of the Regulation contain no rules, the Common Position amends Article 3 of directive 92/118/EEC in order to repeal the similar rule.

The Commission has no objection on the above Council position.

4. CONCLUSION

The Commission supports the Presidency text on the Common Position.
