Operative part of the judgment

The Court:

1)

Annuls the decision of the Third Board of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs) (OHIM) of 8 November 2012 (Case R 1512/2010-3);

2)

Orders OHIM to bear its own costs and to pay the costs incurred by Cezar Przedsiębiorstwo Produkcyjne Dariusz Bogdan Niewiński;

3)

Orders Poli-Eco Tworzywa Sztuczne sp. z o.o. to bear its own costs.
