EXPLANATORY MEMORANDUM

Proposal for a Council Decision on the compulsory application of Regulations No 1, 3, 4, 6, 7, 8, 10, 11, 12, 13, 13 H, 14, 16, 17, 18, 19, 20, 21, 23, 25, 26, 28, 31, 34, 37, 38, 39, 43, 44, 46, 48, 55, 58, 61, 66, 67, 73, 77, 79, 80, 87, 89, 90, 91, 93, 94, 95, 97, 98, 99, 102, 105, 107, 110, 112, 116, 118, 121, 122, 123 and 125 of the United Nations Economic Commission for Europe for the type-approval of motor vehicles, their trailers and systems, components and separate technical units intended therefor

1. CONTEXT OF THE PROPOSAL

The Community has acceded to UNECE Regulations No. 1, 3, 4, 6, 7, 8, 10, 11, 12, 13, 13 H, 14, 16, 17, 18, 19, 20, 21, 23, 25, 26, 28, 31, 34, 37, 38, 39, 43, 44, 46, 48, 55, 58, 61, 66, 67, 73, 77, 79, 80, 87, 89, 90, 91, 93, 94, 95, 97, 98, 99, 102, 105, 107, 110, 112, 116, 118, 121, 122, 123 and 125 of the United Nations Economic Commission for Europe (UNECE) for the type-approval of motor vehicles, their trailers and systems, components and separate technical units intended therefor. Directive 2007/46/EC provides for the possibility to apply UNECE Regulations for the purpose of EC vehicle type-approval on a compulsory basis. Regulation (EC) No 661/2009 repeals several Directives concerning the type-approval of motor vehicles, their trailers and systems, components and separate technical units intended therefor. The requirements set out in those Directives should be replaced, where appropriate, with references to the corresponding UNECE Regulations. It is appropriate to incorporate UNECE Regulations No. 1, 3, 4, 6, 7, 8, 10, 11, 12, 13, 13 H, 14, 16, 17, 18, 19, 20, 21, 23, 25, 26, 28, 31, 34, 37, 38, 39, 43, 44, 46, 48, 55, 58, 61, 66, 67, 73, 77, 79, 80, 87, 89, 90, 91, 93, 94, 95, 97, 98, 99, 102, 105, 107, 110, 112, 116, 118, 121, 122, 123 and 125 into the approval system for motor vehicles and thus to add them to the legislation in force within the Community, following the implementation dates set out in Article 13 of Regulation (EC) No 661/2009. According to Article 4 (2) of Regulation (EC) No 661/2009 type-approval in accordance with the UNECE Regulations which have been made mandatory shall be considered as EC type-approval in accordance with that Regulation and its implementing measures. |

3. Legal elements of the proposal Type-approvals issued under the UNECE Regulations will be considered as EC type-approvals, thus avoiding duplication not only in technical requirements but also in certification and administrative procedures, to the benefit of both industry and national authorities. In addition, type-approval that is directly based on internationally agreed standards will improve market access in third countries, in particular those which are contracting parties to the UNECE 1958 Agreement, thus enhancing EU industry’s competitiveness. The legal basis of the proposal is Article 14 of Regulation (EC) No 661/2009 of the European Parliament and of the Council of 13 July 2009 concerning type-approval requirements for the general safety of motor vehicles, their trailers and systems, components and separate technical units intended therefor. 4. BUDGETARY IMPLICATION The proposal has no implication for the Community budget. 5. Additional information The proposed act concerns an EEA matter and should therefore extend to the European Economic Area. |

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Decision 97/836/EC of 27 November 1997 with a view to accession by the European Community to the Agreement of the United Nations Economic Commission for Europe (“UN/ECE”) concerning the adoption of uniform technical prescriptions for wheeled vehicles, equipment and parts which can be fitted to and/or be used on wheeled vehicles and the conditions for reciprocal recognition of approvals granted on the basis of these prescriptions, (“Revised 1958 Agreement”)[1],

Having regard to Directive 2007/46/EC of the European Parliament and of the Council of 5 September 2007 establishing a framework for the approval of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles (Framework Directive)[2], and in particular Article 34(2) thereof,

Having regard to Regulation (EC) No 661/2009 of the European Parliament and of the Council of 13 July 2009 concerning type-approval requirements for the general safety of motor vehicles, their trailers and systems, components and separate technical units intended therefor[3], and in particular Article 14 thereof,

Having regard to the proposal from the European Commission[4],

Having regard to the opinion of the European Parliament[5],

Whereas:

1. By Council Decision 97/836/EC, the Community has acceded to UNECE Regulations No 1, 3, 4, 6, 7, 8, 10, 11, 12, 13, 14, 16, 17, 18, 19, 20, 21, 23, 25, 26, 28, 31, 34, 37, 38, 39, 43, 44, 46, 48, 58, 66, 73, 77, 79, 80, 87, 89, 90, 91, 93, 97, 98, 99 and 102.

2. By Council Decision 2000/710/EC, the Community has acceded to UNECE Regulation 67[6].

3. By Council Decision 2001/505/EC, the Community has acceded to UNECE Regulation 105[7].

4. By Council Decision 2001/395/EC, the Community has acceded to UNECE Regulation 13 H[8].

5. By Council Decision 2005/614/EC, the Community has acceded to UNECE Regulations 94 and 95[9].

6. By Council Decision 2006/364/EC, the Community has acceded to UNECE Regulation 123[10].

7. By Council Decision 2006/444/EC, the Community has acceded to UNECE Regulation 55[11].

17. Directive 2007/46/EC provides for the possibility to apply UNECE Regulations for the purpose of EC vehicle type-approval on a compulsory basis.

18. Regulation (EC) No 661/2009 repeals several Directives concerning the type-approval of motor vehicles, their trailers and systems, components and separate technical units intended therefor. The requirements set out in those Directives should be replaced, where appropriate, with references to the corresponding UNECE Regulations.

19. It is appropriate to incorporate UNECE Regulations No 1, 3, 4, 6, 7, 8, 10, 11, 12, 13, 13 H, 14, 16, 17, 18, 19, 20, 21, 23, 25, 26, 28, 31, 34, 37, 38, 39, 43, 44, 46, 48, 55, 58, 61, 66, 67, 73, 77, 79, 80, 87, 89, 90, 91, 93, 94, 95, 97, 98, 99, 102, 105, 107, 110, 112, 116, 118, 121, 122, 123 and 125 into the approval system for motor vehicles and thus to add them to the legislation in force within the Community, following the implementation dates set out in Article 13 of Regulation (EC) No 661/2009.

20. According to Article 4 (2) of Regulation (EC) No 661/2009 type-approval in accordance with the UNECE Regulations which have been made mandatory shall be considered as EC type-approval in accordance with that Regulation and its implementing measures.

HAS ADOPTED THIS DECISION:

Article 1

21. With effect from 1 November 2012, the Regulations of the United Nations Economic Commission for Europe listed in Annex I shall be applied on a compulsory basis for the purpose of EC type-approval of new types of vehicles, their trailers and systems, components and separate technical units intended therefor.

22. With effect from 1 November 2014, the Regulations of the United Nations Economic Commission for Europe listed in Annex I shall be applied on a compulsory basis for the purpose of registration, sale and entry into service of new vehicles and their trailers and sale and entry into service of new systems, components and separate technical units intended therefor.

23. With effect from 1 November 2011, Regulation 13 H, supplement 9 of the United Nations Economic Commission for Europe[15], including the requirements set out in its Annex 9, shall be applied on a compulsory basis for the purpose of EC type-approval of new types of vehicles of categories M1.

24. With effect from 1 November 2014, Regulation 13 H, supplement 9 of the United Nations Economic Commission for Europe, including the requirements set out in its Annex 9, shall be applied on a compulsory basis for the purpose of registration, sale and entry into service of new vehicles of categories M1.

25. With effect from 1 November 2011, Regulation 13, supplement 3 to the 11 series of amendments[16], including the requirements on roll-over control and directional control set out in its Annex 21, or Regulation 13 H, supplement 9 of the United Nations Economic Commission for Europe, including the requirements set out in its Annex 9, shall be applied on a compulsory basis for the purpose of EC type-approval of new types of vehicles of categories N1.

26. With effect from 1 November 2014, Regulation 13, supplement 3 to the 11 series of amendments, including the requirements on roll-over control and directional control set out in its Annex 21, or Regulation 13 H, supplement 9 of the United Nations Economic Commission for Europe, including the requirements set out in its Annex 9, shall be applied on a compulsory basis for the purpose of registration, sale and entry into service of new vehicles of categories N1.

27. Following the implementation dates set out in Table 1 of Annex V of Regulation (EC) No 661/2009, Regulation 13, supplement 3 to the 11 series of amendments of the United Nations Economic Commission for Europe shall be applied on a compulsory basis for the purpose of EC type-approval of new types of vehicles of categories M2, M3, N2, N3, O3 and O4 on grounds relating to their electronic stability control systems.

28. Following the implementation dates set out in Table 2 of Annex V of Regulation (EC) No 661/2009, Regulation 13, supplement 3 to the 11 series of amendments of the United Nations Economic Commission for Europe shall be applied on a compulsory basis for the purpose of registration, sale and entry into service of new vehicles of categories M2, M3, N2, N3, O3 and O4 on grounds relating to their electronic stability control systems.

Article 2

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

Article 1 paragraphs 1 and 2 of this Council Decision are without prejudice to the application dates set out in the UNECE Regulations. The list below contains references to the latest amendments of the UNECE Regulations. When these amendments set out implementation dates later than those set out in Paragraphs 1 and 2, the previous versions of such UNECE Regulations shall apply in the transitory period between the dates set out in Paragraphs 1 and 2 and the implementation dates set out in the UNECE Regulations.
