DECISION OF THE EEA JOINT COMMITTEE
No 53/2012
of 30 March 2012
amending Annex IX (Financial services) to the EEA Agreement
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,
Whereas:

Annex IX to the Agreement was amended by Decision of the EEA Joint Committee No 20/2012 of 10 February 2012 (1). |

(2) |
Commission Decision 2010/578/EU of 28 September 2010 on the recognition of the legal and supervisory framework of Japan as equivalent to the requirements of Regulation (EC) No 1060/2009 of the European Parliament and of the Council on credit rating agencies (2) is to be incorporated into the Agreement, |
HAS ADOPTED THIS DECISION:
Article 1
The following point shall be inserted after point 31eb (Regulation (EC) No 1060/2009 of the European Parliament and of the Council) of Annex IX to the Agreement:

32010 D 0578: Commission Decision 2010/578/EU of 28 September 2010 on the recognition of the legal and supervisory framework of Japan as equivalent to the requirements of Regulation (EC) No 1060/2009 of the European Parliament and of the Council on credit rating agencies (OJ L 254, 29.9.2010, p. 46).’. |
Article 2
The text of Decision 2010/578/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 31 March 2012, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1), or on the day of the entry into force of Decision of the EEA Joint Committee No 20/2012 of 10 February 2012, whichever is the later.
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

Joint Declaration by the Contracting Parties to Decision of the EEA Joint Committee No 53/2012 of 30 March 2012 incorporating Commission Decision 2010/578/EU into the Agreement
‘Commission Decision 2010/578/EU of 28 September 2010 deals with equivalence for third countries. The incorporation of this Decision is without prejudice to the scope of the EEA Agreement.’
