DECISION OF THE EEA JOINT COMMITTEE

No 109/2010

of 1 October 2010

amending Annex XVIII (Health and safety at work, labour law, and equal treatment for men and women) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex XVIII to the Agreement was amended by Decision of the EEA Joint Committee No 92/2010 of 2 July 2010 (1).

(2)

Council Directive 2009/13/EC of 16 February 2009 implementing the Agreement concluded by the European Community Shipowners’ Associations (ECSA) and the European Transport Workers’ Federation (ETF) on the Maritime Labour Convention, 2006, and amending Directive 1999/63/EC (2) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Annex XVIII to the Agreement shall be amended as follows:

1.

the following shall be added in point 32b (Council Directive 1999/63/EC):

‘, as amended by:

32009 L 0013: Council Directive 2009/13/EC of 16 February 2009 (OJ L 124, 20.5.2009, p. 30).’;

2.

the following point shall be inserted after point 32i (Council Directive 2005/47/EC):

‘32j.

32009 L 0013: Council Directive 2009/13/EC of 16 February 2009 implementing the Agreement concluded by the European Community Shipowners’ Associations (ECSA) and the European Transport Workers’ Federation (ETF) on the Maritime Labour Convention, 2006, and amending Directive 1999/63/EC (OJ L 124, 20.5.2009, p. 30).’;

3.

the first indent (Act concerning the conditions of accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden and the adjustments of the Treaties on which the European Union is founded) of point 24 (Directive 2008/94/EC of the European Parliament and of the Council) shall be deleted.

Article 2

The text of Directive 2009/13/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 1 November 2010, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
