Decision on the common position established by the Council with a view to the adoption of a Council Directive on the approximation of the laws of the Member States with regard to the transport of dangerous goods by rail (C4-0003/96 - 94/0284(SYN))

(Cooperation procedure: second reading)

The European Parliament,

- having regard to the common position of the Council, C4-0003/96 - 94/0284(SYN),

- having regard to its opinion at first reading ((OJ C 249, 25.9.1995, p. 137. )) on the Commission proposal to the Council, COM(94)0573 ((OJ C 389, 31.12.1994, p. 15.)),

- having regard to the amended Commission proposal, COM(95)0424 ((OJ C 313, 24.11.1995, p. 26.)),

- having been consulted by the Council pursuant to Article 189c of the EC Treaty,

- having regard to Rule 67 of its Rules of Procedure,

- having regard to the recommendation for second reading of the Committee on Transport and Tourism (A4-0074/96),

1. Amends the common position as follows;

2. Instructs its President to forward this decision to the Council and Commission.

2a. For the transport of extremely dangerous goods, the various competent authorities shall be informed in advance.

(Amendment 2)

Article 5(1a) (new)

1a. This Directive shall not restrict the right of Member States, with due regard for Community law, to adopt special rules or grant derogations for transport operations of local significance, e.g. the transport of hydrogen cyanide in purpose-built tank wagons, or for the transport of dangerous goods on narrow-gauge, dock or mountain railways.
