RÈGLEMENT D’EXÉCUTION (UE) 2023/265 DE LA COMMISSION

du 9 février 2023

instituant un droit antidumping définitif sur les importations de carreaux en céramique originaires de l’Inde et de Turquie

Article premier

Un droit antidumping définitif est institué sur les importations de carreaux et dalles de pavement ou de revêtement, en céramique, les cubes, dés et articles similaires pour mosaïques, en céramique, même sur un support, et les pièces de finition, en céramique, relevant actuellement des codes NC 6907 21 00 , 6907 22 00 , 6907 23 00 , 6907 30 00 et 6907 40 00 et originaires de l’Inde ou de Turquie.

Les taux du droit antidumping définitif applicables au prix net franco frontière de l’Union, avant dédouanement, du produit décrit au paragraphe 1 et fabriqué par les sociétés désignées ci-dessous, s’établissent comme suit:

L’application des taux de droit individuels précisés pour les sociétés mentionnées au paragraphe 2, ainsi que la non-application d’un quelconque taux de droit antidumping pour les sociétés mentionnées au paragraphe 3, sont subordonnées à la présentation aux autorités douanières des États membres d’une facture commerciale en bonne et due forme, sur laquelle doit apparaître une déclaration datée et signée par un représentant de l’entité délivrant une telle facture, identifié par son nom et sa fonction, et rédigée comme suit: «Je soussigné(e) certifie que le [volume] de [produit concerné] vendu à l’exportation vers l’Union européenne et couvert par la présente facture a été produit par [nom et adresse de la société] (code additionnel TARIC) en [pays concerné]. Je déclare que les informations fournies dans la présente facture sont complètes et correctes.». Faute de présentation de cette facture, le droit applicable à toutes les autres sociétés s’applique.

Sauf indication contraire, les dispositions en vigueur en matière de droits de douane s’appliquent.

Article 2

L’article 1er, paragraphe 2, peut être modifié pour ajouter de nouveaux producteurs-exportateurs de l’Inde ou de Turquie et les soumettre au taux de droit antidumping moyen pondéré approprié pour les sociétés ayant coopéré non retenues dans l’échantillon. Tout nouveau producteur-exportateur devra apporter la preuve:

qu’il n’a pas exporté les produits visés à l’article 1er, paragraphe 1, et originaires de l’Inde ou de Turquie au cours de la période d’enquête (du 1er juillet 2020 au 30 juin 2021);

qu’il n’est pas lié à un exportateur ou à un producteur soumis aux mesures instituées par le présent règlement et qui aurait pu coopérer à l’enquête initiale; et

qu’il a effectivement exporté le produit concerné ou s’est engagé d’une manière irrévocable par contrat à en exporter une quantité importante vers l’Union après la fin de la période d’enquête.

Article 3

Le présent règlement entre en vigueur le jour suivant celui de sa publication au Journal officiel de l’Union européenne.

Le présent règlement est obligatoire dans tous ses éléments et directement applicable dans tout État membre.
