++++ ADMINISTRATIVE COMMISSION OF THE EUROPEAN COMMUNITIES ON SOCIAL SECURITY FOR MIGRANT WORKERS DECISION No 111 of 29 June 1979 amending Decision No 90 of 24 May 1973 concerning the compilation of the lists provided for in Article 94 ( 4 ) and Article 95 ( 4 ) of Council Regulation ( EEC ) No 574/72 of 21 March 1972 THE ADMINISTRATIVE COMMISSION OF THE EUROPEAN COMMUNITIES ON SOCIAL SECURITY FOR MIGRANT WORKERS , Having regard to Article 81 ( a ) of Regulation ( EEC ) No 1408/71 under which it is given the responsibility for dealing with all administrative questions arising from Council Regulations ( EEC ) No 1408/71 and ( EEC ) No 574/72 , Having regard to Decision No 90 of 24 May 1973 published in Official Journal of the European Communities No C 131 of 25 October 1974 , Whereas it is necessary to amend the abovementioned Decision No 90 to cover a case where a pensioner is staying temporarily in the territory of a Member State before transferring his place of residence there , HAS DECIDED AS FOLLOWS : 1 . Section II , point 2 of Article 1 of Decision No 90 shall be amended as follows : " 2 . The date from which the lump sums are calculated shall be : ( a ) the date on which the institution of the place of residence receives Form E 121 . This date should be entered at point 9.12 of Form E 121 and is the date on which Form E 120 ceases to have effect ; ( b ) the date on which the person concerned acquires the right to benefits in kind under the legislation of the competent country , if Form E 120 has not been issued ; this date should be entered a : point 5.3 of Form E 121 ; ( c ) the date of transfer of residence if it falls after the date mentioned at points ( a ) or ( b ) above , and if Form E 111 was not issued ; ( d ) the date following the end of the period during which entitlement to benefits had been acquired on the basis of Form E 111 . If the pensioners or the members of their family are still entitled to benefits under the legisaltion of their country of residence , the lump sum shall be calculated from the date on which such entitlement ends .
