Directiva 98/34/CE del Parlamento Europeo y del Consejo de 22 de junio de 1998, por la que se establece un procedimiento de información en materia de las normas y reglamentaciones técnicas y de las reglas relativas a los servicios de la sociedad de la información (DO L 204 de 21.7.1998, p. 37; DO L 217 de 5.8.1998, p. 20).

La Comisión desea llamar la atención sobre la sentencia «CIA Security», dictada el 30 de abril de 1996 en el asunto C-194/94 (Rec. 1996, p. I-2201), en virtud de la cual el Tribunal de Justicia considera que los artículos 8 y 9 de la Directiva 98/34/CE (entonces 83/189/CEE) deben interpretarse en el sentido de que los particulares pueden ampararse en ellos ante los órganos jurisdiccionales nacionales, al que incumbe negarse a aplicar un reglamento técnico nacional que no haya sido notificado con arreglo a la Directiva.
Esta sentencia confirma la Comunicación de la Comisión de 1 de octubre de 1986 (DO C 245 de 1.10.1986, p. 4).

Por lo tanto, el incumplimiento de la obligación de notificar un reglamento técnico implica la inaplicabilidad de dicho reglamento y por consiguiente, no sera oponible a los particulares.
