COMMISSION DELEGATED REGULATION (EU) No 1040/2014
of 25 July 2014
amending Council Directive 2001/112/EC relating to fruit juices and certain similar products intended for human consumption to adapt its Annex I to technical progress
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 2001/112/EC of 20 December 2001 relating to fruit juices and certain similar products intended for human consumption (1), and in particular Article 7 thereof,
Whereas:

Directive 2001/112/EC empowers the Commission to adopt delegated acts to amend the Annexes to that Directive, with the exception of Part I of Annex I, and of Annex II, in order to bring them into line with developments in relevant international standards and in order to take into account technical progress. |
|
(2) |
Annex I to Directive 2001/112/EC relates to product names, definitions of products and characteristics. Point 3 of Part II of that Annex regulates the authorised treatments and substances. Due to the technical developments new substances for clarification of juices are now available. Those substances are plant proteins derived from either wheat, peas or potatoes, which can be an alternative to the currently authorized substance gelatine, derived from animal products. |

In order to take into account this technical progress, point 3 of Part II of Annex I to Directive 2001/112/EC should be amended by incorporating those new substances, |
HAS ADOPTED THIS REGULATION:
Article 1
In point 3 of Part II of Annex I to Directive 2001/112/EC, the following indent is added:

Plant proteins from wheat, peas or potatoes for clarification’ |
Article 2
This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

establishing the standard import values for determining the entry price of certain fruit and vegetables
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1),
Having regard to Commission Implementing Regulation (EU) No 543/2011 of 7 June 2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors (2), and in particular Article 136(1) thereof,
Whereas:

Implementing Regulation (EU) No 543/2011 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XVI, Part A thereto. |

The standard import value is calculated each working day, in accordance with Article 136(1) of Implementing Regulation (EU) No 543/2011, taking into account variable daily data. Therefore this Regulation should enter into force on the day of its publication in the Official Journal of the European Union, |
HAS ADOPTED THIS REGULATION:
Article 1
The standard import values referred to in Article 136 of Implementing Regulation (EU) No 543/2011 are fixed in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING DECISION

repealing Decision 2006/464/EC on provisional emergency measures to prevent the introduction into and the spread within the Community of Dryocosmus kuriphilus Yasumatsu
(notified under document C(2014) 6566)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 2000/29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community (1), and in particular the fourth sentence of Article 16(3) thereof,
Whereas:

The measures set out by Commission Decision 2006/464/EC (2) did not prevent the spread of Dryocosmus kuriphilus Yasumatsu (oriental chestnut gall wasp) as appears from the yearly surveys carried out by the Member States pursuant to that Decision. Those surveys further show that Dryocosmus kuriphilus Yasumatsu is widely spread in a large part of its potential area of establishment within the Union territory. In addition, the conditions for movement of susceptible plants set out in Decision 2006/464/EC are not feasible and appropriate for that large part of the Union territory. |

(2) |
Decision 2006/464/EC should therefore be repealed. |
|
(3) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plant Health, |
HAS ADOPTED THIS DECISION:
Article 1
Decision 2006/464/EC is repealed.
Article 2
This Decision is addressed to the Member States.
