[pic] | COMMISSION OF THE EUROPEAN COMMUNITIES | Brussels, 16.8.2006 COM(2006) 460 final Proposal for a COUNCIL DECISION on a Community position on Decision No 1/2006 of the Joint Management Committee set up by the Agreement establishing an Association between the European Community and its Member States, of the one part, and the Republic of Chile, of the other part regarding the amendment of Appendices IC, IIIA, IIIB and XI to Annex IV to the Association Agreement (presented by the Commission) EXPLANATORY MEMORANDUM The Agreement establishing an Association between the European Community and its Member States, of the one part, and the Republic of Chile, of the other part, hereinafter called the "Agreement", was signed on 18 November 2002. Certain provisions, including those relating to sanitary, phytosanitary and animal welfare measures, have been provisionally applied since 1 February 2003. All Agreement provisions entered into force on 1 March 2005, after being ratified by the Member States (EU-15). Annex IV to the Agreement lays down the Sanitary and Phytosanitary (SPS) measures applicable to trade in animals and animal products, plants, plant products and other goods and animal welfare (hereinafter called the "SPS Agreement”). Article 6 (4) of the Agreement establishes that the Association Committee shall have the power to take decisions in the cases provided for in this Agreement or where such power has been delegated to it by the Association Council. Article 89 (3) of the Agreement, by way of derogation from Article 193, establishes that the Association Committee when dealing with SPS measures, shall be composed of representatives of the Community and Chile with responsibility for SPS matters. This Committee is called the “Joint Management Committee for SPS matters”, hereinafter called “the Joint Management Committee”, and it is empowered to modify, by means of a decision, Appendices I to XII to the SPS Agreement as established in its Article 16 (2) c. The Community must adopt the position it is to take in the Joint Management Committee regarding the adoption of the amendments needed to update Appendices IC, IIIA, IIIB and XI to the SPS Agreement. Under Article 4(1) of Decision 2002/979/EC, the Community's position is to be adopted by the Council on a proposal from the Commission. The draft amendment concerns Appendices IC, IIIA, IIIB and XI to the SPS Agreement. For Appendix IC the draft amendment extends the scope of the Agreement by including animal welfare standards to the transport of animals by land and sea as recommended by the working group on animal welfare at its meeting of September 2005. This recommendation was endorsed by the Parties at the third meeting of the Joint Management Committee of November 2005. For Appendices IIIA and XI the draft amendment updates the legal basis of the parties for animal and fish diseases subject to notification, for which the status of the Parties is recognised and for which regionalisation decisions may be taken and the contact points and Websites for the SPS Agreement respectively. Footnote 1 of Appendix IIIB to the SPS Agreement, concerning the pests subject to notification, for which the status of the Parties is recognised and for which regionalisation decisions may be taken, establishes that the Joint Management Committee shall complete the lists of this Appendix by means of a decision. Decision No 1/2006 of the Joint Management Committee will be published in the Official Journal of the European Union . Proposal for a COUNCIL DECISION on a Community position on Decision No 1/2006 of the Joint Management Committee set up by the Agreement establishing an Association between the European Community and its Member States, of the one part, and the Republic of Chile, of the other part regarding the amendment of Appendices IC, IIIA, IIIB and XI to Annex IV to the Association Agreement (Text with EEA relevance) THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty establishing the European Community, and in particular Article 37 and Article 152(4)(b) in conjunction with the second subparagraph of Article 300(2) thereof, Having regard to the proposal from the Commission, Whereas: 1. Article 4 (1) of Council Decision 2002/979/EC, on the signature and provisional application of certain provisions of an Agreement establishing an Association between the European Community and its Member States, of the one part, and the Republic of Chile, of the other part, hereinafter called the "Agreement", establishes that the position to be taken by the Community within the Association Committee shall be adopted by the Council, on a proposal from the Commission, in accordance with the corresponding provisions of the Treaty. 2. Annex IV to the Agreement lays down the Sanitary and Phytosanitary (SPS) measures applicable to trade in animals and animal products, plants, plant products and other goods and animal welfare (hereinafter called the “SPS Agreement”). 3. It is necessary to amend Appendices IC, IIIA, IIIB and XI to the SPS Agreement to take account of the progress made under the consultations and procedures provided for under the SPS Agreement. 4. Article 6 (4) of the Agreement establishes that the Association Committee shall have the power to take decisions in the cases provided for in the Agreement or where such power has been delegated to it by the Association Council. 5. Article 89 (3) of the Agreement by way of derogation from Article 193, establishes that the Association Committee when dealing with SPS measures is called the “Joint Management Committee for SPS matters, hereinafter called “the Joint Management Committee”, and it is empowered to modify by means of a decision Appendices I to XII to the SPS Agreement as established in its Article 16 (2) c. 6. To that effect the Community must adopt the position it is to take in the Joint Management Committee regarding the necessary amendments. HAS DECIDED AS FOLLOWS: Article 1 The position to be adopted by the Community in the Joint Management Committee set up by Article 89 (3) of the Agreement regarding the amendments to Appendices IC, IIIA, IIIB and XI to the SPS Agreement shall be to agree to the draft Decision of the Joint Management Committee annexed to this Decision. Article 2 Decision No 1/2006 of the Joint Management Committee on amendments to Appendices IC, IIIA, IIIB and XI to the SPS Agreement shall be published in the Official Journal of the European Union as soon as it has been adopted. (2) Appendix IC to the SPS Agreement should be amended to take account of the recommendation by the working group on animal welfare, endorsed by the Joint Management Committee, to extend the scope of the Agreement to other animal welfare standards concerning the transport of animals by land and sea. (3) Appendix IIIA to the SPS Agreement should be amended to take account of the changes in the legislation of the Community and Chile. (4) Appendix IIIB to the SPS Agreement should be amended to take account of footnote 1 that establishes that the Joint Management Committee shall complete the lists of this Appendix by means of a decision. (5) Appendix XI to the SPS Agreement should be amended to take account of the changes in the Community and Chilean contact points and Websites for the Agreement, HAS ADOPTED THIS DECISION: Article 1 Appendices IC, IIIA, IIIB and XI to the SPS Agreement between the European Community and the Republic of Chile are hereby replaced by the Appendices in the Annex to this Decision. Article 2 This Decision, drawn up in duplicate, shall be signed by the joint chairmen or other persons empowered to act in the name of the Parties.
