COUNCIL DECISION

of 17 November 2025

adopting the Council’s position on draft amending budget No 3 of the European Union for the financial year 2025

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 314 thereof, in conjunction with the Treaty establishing the European Atomic Energy Community, and in particular Article 106a thereof,

Having regard to Regulation (EU, Euratom) 2024/2509 of the European Parliament and of the Council of 23 September 2024 on the financial rules applicable to the general budget of the Union (recast). (1), and in particular Article 44 thereof,

Whereas:

the Union’s budget for the financial year 2025 was definitively adopted on 27 November 2024 (2);

on 3 October 2025, the Commission submitted a proposal containing draft amending budget No 3 to the general budget for the financial year 2025, which was complemented by the Commission on 5 November 2025 with the final figures for the salary adjustment in 2025;

the Council needs to proceed without delay with the adoption of its position on draft amending budget No 3 to the general budget for 2025, in view of urgently (a) increasing the level of payment appropriations (p/a) for the European Regional Development Fund (ERDF), the European Social Fund Plus (ESF+) and the Border Management and Visa Instrument (BMVI), as these amounts could not be included in the redeployments proposed in the ‘Global transfer’ (DEC No 15/2025), which was submitted to the European Parliament and the Council on 3 October 2025, (b) updating the needs for the Sustainable Fisheries Partnership Agreements (SFPAs), cancelling the amounts in reserve that will not be needed in 2025, (c) decreasing commitment appropriations (c/a) and p/a for the Customs Control Equipment Instrument (CCEI) due to delays in implementation in the Member States, (d) decreasing c/a for the Technical Support Instrument due to efficiency gains from competitive procurement procedures, (d) decreasing p/a for the Ukraine Facility, as the 2025 payment profile has been impacted by changes to assumptions such as in the pace of implementation of reforms and investments, the date of signature of guarantee and blending agreements, and the timing of the payment of the borrowing costs subsidies, (e) adjusting the EU contribution to the Anti-Money Laundering Authority (AMLA), the European Insurance and Occupational Pensions Authority (EIOPA), the European Securities Markets Authority (ESMA), the European Centre for Disease Prevention and Control (ECDC), the EU Asylum Agency (EUAA), the European Chemicals Agency (ECHA) and the European Environment Agency (EEA), the European Maritime Safety Agency (EMSA) and the European Food Safety Authority (EFSA), linked to implementation or other specific reasons, (f) integrating the final salary update for 2025 and (g) updating the revenue side of the budget accordingly. It is therefore justified to provide for an exception to the eight-week period referred to in Article 4 of Protocol No 1 on the role of national Parliaments in the European Union, annexed to the Treaty on European Union, to the Treaty on the Functioning of the European Union and to the Treaty establishing the European Atomic Energy Community.

The Council’s position on draft amending budget No 3 of the European Union for the financial year 2025 was adopted on 17 November 2025.
