THE JOINT COMMITTEE,
Having regard to the Agreement between the European Community and the Principality of Monaco on the application of certain Community acts on the territory of the Principality of Monaco, signed in Brussels on 4 December 2003 (hereinafter referred to as ‘the Agreement’), and in particular Article 1(1) thereof,
Whereas:
(1)The Union has undertaken a reform of the legislation on health products, including a fundamental revision of the rules on medical devices and in vitro diagnostic medical devices, in order to establish a robust regulatory framework that ensures a high level of safety and health protection. A decision of the Joint Committee is therefore necessary to update the Annex to the Agreement in order to include the new acts concerning these products.
(2)This update addresses certain difficulties that have been encountered, particularly in the conduct of joint inspections by the Monegasque and French authorities of laboratories and production structures established in the Principality of Monaco. However, it is clarified that Monegasque economic operators will not be able to rely on these provisions to obtain or justify access to the single market for goods covered by the scope of the Agreement.
(3)Under Article 1(2) of the Agreement, Union acts adopted by the institutions of the Union in application of the acts referred to in Article 1(1) of the Agreement apply on the territory of the Principality of Monaco without the need for a decision of the Joint Committee. It should therefore be specified, in the context of this update of the Annex and for reasons of clarity and legal certainty, that the Annex lists the basic Union acts and their amending acts, while acts adopted by the Commission in application of those acts, including delegated and implementing acts, apply automatically under the Agreement and are not explicitly listed in that Annex,
HAS ADOPTED THIS DECISION:
Article 1
The text set out in the Annex to the Agreement between the European Community and the Principality of Monaco on the application of certain Community acts on the territory of the Principality of Monaco is replaced by the text set out in the Annex to this Decision.
For the purpose of implementing the Agreement, the Annex lists the basic Union acts and the acts amending, supplementing or replacing them.
In line with Article 1(2) of the Agreement, this also means that delegated and implementing acts adopted in application of the acts listed in the Annex apply without the need for a decision of the Joint Committee and without any requirement to list them separately in that Annex.
