Non-opposition to a notified concentration

On 16 October 2009, the Commission decided not to oppose the above notified concentration and to declare it compatible with the common market. This decision is based on Article 6(1)(b) of Council Regulation (EC) No 139/2004. The full text of the decision is available only in English and will be made public after it is cleared of any business secrets it may contain. It will be available:

Communication from the Commission amending the Temporary Community Framework for State aid measures to support access to finance in the current financial and economic crisis

1.   INTRODUCTION

The Temporary Community Framework for State aid measures to support access to finance in the current financial and economic crisis applies from 17 December 2008 until 31 December 2010 (1).

The possibility under point 4.2 to grant a compatible limited amount of aid does not apply to undertakings active in the primary production of agricultural products. Farmers, however, encounter increased difficulties to obtain credit as a consequence of the financial crisis.

Following the Communication from the Commission to the Council on the dairy market situation 2009 of 22 July 2009 (SEC(2009) 1050) and the outcome of the Council meeting of agriculture ministers of 7 September 2009, it is appropriate to introduce a separate compatible limited amount of aid for undertakings active in the primary production of agricultural products.

2.   AMENDMENTS TO THE TEMPORARY COMMUNITY FRAMEWORK

The following amendments to the Temporary Community Framework for State aid measures to support access to finance in the current financial and economic crisis will take effect from 28 October 2009:

1.

point 4.2.2(g) is replaced by the following:

‘prior to granting the aid, the Member State obtains a declaration from the undertaking concerned, in written or electronic form, about any other de minimis aid and aid pursuant to this measure received during the current fiscal year and checks that the aid will not raise the total amount of aid received by the undertaking during the period from 1 January 2008 to 31 December 2010, to a level above the ceiling of EUR 500 000, and of EUR 15 000 respectively in case of aid to undertakings active in the primary production of agricultural products (2);’

2.

point 4.2.2(h) is replaced by the following:

‘the aid scheme applies as such to undertakings active in the processing and marketing of agricultural products (3), unless the aid is conditional on being partly or entirely passed on to primary producers. Where the aid is granted to undertakings active in the primary production of agricultural products (either directly or passed on from undertakings processing and marketing agricultural products), the cash grant (or gross grant equivalent) does not exceed EUR 15 000 per undertaking; aid to undertakings active in the primary production of agricultural products is not fixed on the basis of the price or quantity of products put on the market; aid to undertakings active in the processing and marketing of agricultural products is not fixed on the basis of the price or quantity of products purchased from primary producers or put on the market by the undertakings concerned.’

point 4.7, paragraph 2 is replaced by the following:

‘The temporary aid measures foreseen by this Communication may not be cumulated with aid falling within the scope of the de minimis Regulations for the same eligible costs. If the undertaking has already received de minimis aid prior to the entry into force of this temporary framework the sum of the aid received under the measures covered by point 4.2 of this Communication and the de minimis aid received must not exceed EUR 500 000, and EUR 15 000 respectively in case of aid to primary agricultural producers, between 1 January 2008 and 31 December 2010. The amount of de minimis aid received from 1 January 2008 must be deducted from the amount of compatible aid granted for the same purpose under points 4.3, 4.4, 4.5 or 4.6.’

Commission notice on the publication of the electronic templates and file format specifications referred to in Commission Decision 2007/589/EC relating to monitoring and reporting requirements under Directive 2003/87/EC of the European Parliament and of the Council establishing a system for greenhouse gas emission allowance trading within the Community

Commission Decision 2007/589/EC (1) sets out guidelines for the monitoring and reporting of greenhouse gas emissions from the activities listed in Annex I to Directive 2003/87/EC of the European Parliament and of the Council (2) and from activities included pursuant to Article 24(1) of that Directive. Decision 2007/589/EC also sets out guidelines for the monitoring and reporting of tonne-kilometre data from aviation activities for the purpose of an application under Articles 3e or 3f of Directive 2003/87/EC.

In order to facilitate monitoring and reporting in connection to aviation activities, the Commission may publish standardised electronic templates or file format specifications pursuant to section 6 and section 7 of Annex XIV, and sections 3 and 6 of Annex XV to Decision 2007/589/EC.

Commission notice on current State aid recovery interest rates and reference/discount rates for 27 Member States applicable as from 1 November 2009

Base rates calculated in accordance with the Communication from the Commission on the revision of the method for setting the reference and discount rates (OJ C 14, 19.1.2008, p. 6). Depending on the use of the reference rate, the appropriate margins have still to be added as defined in this communication. For the discount rate this means that a margin of 100 basis points has to be added. The Commission Regulation (EC) No 271/2008 of 30 January 2008 amending the implementing Regulation (EC) No 794/2004 foresees that, unless otherwise provided for in a specific decision, the recovery rate will also be calculated by adding 100 basis points to the base rate.

Objective of aid: The number of farms certified in organic farming in Seine-Maritime is relatively low. The objective of this aid is to encourage specific investment in organic farming.

Eligible investments will be between EUR 2 000 and EUR 15 000. The planned rate of aid is between 20 and 40 % depending on how specialised the equipment is. Priority will be given to young farmers, farms which are converting to organic farming and specialized farms, and market gardening, horticulture and arboriculture.

In addition to, where appropriate, other State aid, or aid from public bodies or collectivities, and strictly in compliance with the aid ceiling set out in Article 4 of Regulation (EC) No 1857/2006 where aid is accumulated, this scheme must encourage the development of organic farming in the department.

40 % rate of aid for mechanical and thermal weeding equipment for market gardening: hoes, hillers, harrows and cultivators, ridgers and bed formers, thermal weeders and humidifiers.

20 % rate of aid: chain harrows, bladed or star-toothed hoeing machines, bevelled continental Cambridge rollers, pasture regenerators, tank netting for harvesters.

Aid shall be granted in accordance with the provisions of Article 4 of Regulation (EC) No 1857/2006

Objective of aid: In the context of consolidated farming, more and more systems are based on fully distributed feeding. Such feeding is often based on maize for silage and the proportion of grass is continuing to decrease. However, maintaining, or even developing, green land is a significant environmental challenge for the department in order to reduce erosion, water turbidity, alluviation of rivers and chemical pollution of water points. The technique of barn hay drying allows large-scale, and even exclusive, green land areas to be maintained for large flocks and for distributed feeding. The drying is based on the use of a renewable energy source (usually solar heating of the under-roof air, or boilers run on biomass fuel). To maximise the benefit of this investment in farms, aid will be granted preferentially to farmers certified in organic farming, farmers producing farm cheese with the Neufchâtel registered designation of origin and collective projects. The scheme has already been the subject of an exemption over the period 2006-2009 under reference No XA 84/06.

The aid will be granted in accordance with the provisions of Article 4 of Regulation (EC) No 1857/2006

Annual expenditure planned under the scheme or overall amount of individual aid granted to the company: Quantification of the loss and the relevant public contribution was carried out on the basis of the data on the epidemic verified by the health authorities; on the basis of the data currently available to us and validity of the aid scheme until 31 December 2010, overall annual expenditure can be estimated at EUR 450 000

Maximum aid intensity: Aid amounting to 90 % of the estimated loss is provided for.

The payments provided for under this aid scheme will be made direct to the farmer that suffered the loss; alternatively, the injured farmer may delegate the relevant farming cooperative to submit the application and collect the aid in his name and on his behalf: in that case, the aid is paid to the cooperative and subsequently transferred to the farmer in its entirety

Date of implementation: The aid scheme will be implemented from the date of publication in the Regional Official Gazette of the notice of the successful outcome of the European Commission’s examination of compatibility in accordance with Articles 87 and 88 of the Treaty

Duration of scheme or individual aid award: The aid may be granted until 31 December 2010

Objective of aid: The aim of the aid scheme is to compensate farmers in the Province affected by cases of bovine tuberculosis for earnings lost as a result of:

the loss of animals, limited to their replacement period (for four months),

The General Council of Allier would like to encourage the drawing up of health programmes by the ‘Groupement de Défense Sanitaire du Cheptel Bourbonnais’ (GDSCB), a State-recognised society from the département, in order to implement the planned action under the terms of Article C225-1 of the Rural Code.

The aim of these programmes is to guarantee better public health by improving the health quality of cattle and sheep with a programme of screening and support for sickness:

In 2001, the General Council gave a commitment to the GDSCB regarding the implementation of the IBR Plan. This screening plan followed on from the introduction of a certification scheme on a national level by the IBR (STC) in late 1999. This certification was an innovative operation aimed at increasing the economic value of the animals. Since the campaign of 2003-2004, all cattle farms in the département are obliged by prefectural decree to carry out an annual screening for IBR in their cattle. Furthermore, in view of the reduction in prophylaxis brucellosis since 2005, the département intervened in the case of blood samples taken on a complementary basis outside of the prophylaxis brucellosis campaign after 2006.

BVD is an illness affecting the mucus membrane of cattle and it can have significant economic and health implications as far as breeding is concerned. The GDSCB therefore suggested the implementation of a protocol of screening and identifying so-called IPI animals, or lifelong carriers of the virus. This collective step should allow the spreading of the virus to be controlled, while limiting the economic consequences in cattle farms and responding to the health demands of livestock farmers, especially in the West. In particular this screening will take place when new animals are added to livestock. The département has played a part in the BVD analyses since 2006.

The 2007-2008 campaign revealed a growing concern regarding the increased number of miscarriages on private farms and the link with the establishing of bluetongue (BT) in our département. So as to avoid a hasty conclusion regarding the causes of the miscarriages and to miss a serious problem by attributing miscarriages to BT, the GDSCB would like to offer an analysis kit to livestock farmers allowing them to identify the abortive illness and in this way put into place curative solutions and suitable preventive measures.

The protocol will consist of taking a sample from the female who miscarried or from the placenta following a second miscarriage on the farm within a 12-month period. These kits will detect the following illnesses:

bovine kit: Q fever, BT and BVD,

sheep kit: chlamydiosis, Q fever and BT.

It will be ensured that farmers will benefit from these subsidies only if their farm complies with the Community criteria for small and medium-sized enterprises (SMEs). Subject to this caveat, the aid will be granted in the form of subsidised services available to all livestock farmers regardless of whether they belong to a producers’ organisation or another structure

Objective of aid: A swift emergency vaccination programme needs to be carried out throughout the whole of Germany and thus also in Saxony-Anhalt to prevent the rapid spread of bluetongue disease and to avoid the threat which it poses to agricultural holdings. There is therefore an overwhelming State interest in the rapid immunisation of the livestock population. At present there are no approved vaccines for vaccinations against serotype 8 in the EU. Livestock farmers thus have no way of obtaining vaccines.

However, existing vaccines can be used on the basis of an Emergency Ordinance of the Federal Ministry for Food, Agriculture and Consumer Protection. Under an EU-wide tendering procedure carried out by the German federal states, vaccines were selected which will be used on a large-scale basis as from February 2009. The safety and effectiveness of the vaccines have been demonstrated by a vaccine test carried out with the scientific support of the Friedrich-Loeffler Institute.

The beneficiaries are small and medium-sized enterprises within the meaning of Regulation (EC) No 1857/2006.

The aid will not be given as direct monetary payments but in the form of subsidised services. The Saxony-Anhalt Animal Diseases Fund [Tierseuchenkasse Sachsen-Anhalt], a public law institution, obtains the vaccine and makes it available to the veterinary authorities. They pass it on to established veterinarians for vaccinating cattle, sheep and goats in the Land of Saxony-Anhalt.

The aid does not concern measures whose costs are required by Community law to be borne by agricultural holdings themselves.

Payment of the costs for procuring the vaccine for immunising 350 000 cattle, 150 000 sheep and 10 000 goats.

In order to ensure the objective of full coverage of the integrated European network of Safer Internet centres, the budget of the 2009 call for proposals may be reinforced by appropriations from the 2010 budget, subject to the adoption of the 2010 budget by the Budgetary Authority and to the availability of appropriations. Should such reinforcement be decided, it will occur before the deadline of this call.’
