Form of order sought

The appellant claims that the Court should:

Admit the appeal against the judgment against which the appeal is brought;

Uphold the appeal, setting aside the judgment against which the appeal is brought and, in consequence, annulling the Decision of 30 January 2024 of the President of the European Parliament finding that the appellant had engaged in psychological harassment, and the Decision of 30 January 2024 of the President of the European Parliament imposing a reprimand on the appellant for having engaged in conduct amounting to psychological harassment;

Order the party opposing the present appeal to pay the costs and maintain the order that the Parliament pay the costs at first instance.

Grounds of appeal and main arguments

1.

Infringement of the rights of the defence and of the right to sound administration, guaranteed in Article 48(2) and Article 41(1) and (2) of the Charter of Fundamental Rights of the European Union.

2.

Infringement of the principle of legal certainty and of the right to obtain a decision within a reasonable time, recognised in Article 41(1) of the Charter of Fundamental Rights of the European Union, by failing to comply with the procedural deadline laid down for adoption of the decision imposing a penalty.
