Operative part of the judgment

The Court:

1.

Dismisses the action;

2.

Orders Euro Asia Cargo Private Ltd to bear its own costs and to pay those incurred by the Council of the European Union;

3.

Orders the French Republic and the European Commission each to bear its own costs.
