By its action under Article 263 TFEU, the applicant seeks annulment of the decision of the European Commission of 18 August 2023, by which the Commission modified the contract with reference DIGIT/A3/PN/2019/026 and entitled ‘Trans-European Services for Telematics between Administrations – New Generation Extension (TESTA-ng II Ext)’ (OJ 2023/S 158-500221) without launching a new procurement procedure.

Dismisses the action;

Orders BT Global Services Belgium to pay the costs.
