    DECISION OF THE EEA JOINT COMMITTEE

    No 304/2019

    of 13 December 2019

    amending Annex IX (Financial Services) to the EEA Agreement [2020/322]

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

    Whereas:

    (1)

    Commission Delegated Regulation (EU) 2017/2358 of 21 September 2017 supplementing Directive (EU) 2016/97 of the European Parliament and of the Council with regard to product oversight and governance requirements for insurance undertakings and insurance distributors (1) is to be incorporated into the EEA Agreement.

    (2)

    Commission Delegated Regulation (EU) 2017/2359 of 21 September 2017 supplementing Directive (EU) 2016/97 of the European Parliament and of the Council with regard to information requirements and conduct of business rules applicable to the distribution of insurance-based investment products (2) is to be incorporated into the EEA Agreement.

    (3)

    Commission Delegated Regulation (EU) 2018/541 of 20 December 2017 amending Delegated Regulation (EU) 2017/2358 and Delegated Regulation (EU) 2017/2359 as regards their dates of application (3) is to be incorporated into the EEA Agreement.

    (4)

    Commission Implementing Regulation (EU) 2017/1469 of 11 August 2017 laying down a standardised presentation format for the insurance product information document (4) is to be incorporated into the EEA Agreement.

    (5)

    Annex IX to the EEA Agreement should therefore be amended accordingly,

    HAS ADOPTED THIS DECISION:

    Article 1

    The following points are inserted after point 13e (Directive (EU) 2016/97 of the European Parliament and of the Council) of Annex IX to the EEA Agreement:

    ‘13ea.

    32017 R 1469: Commission Implementing Regulation (EU) 2017/1469 of 11 August 2017 laying down a standardised presentation format for the insurance product information document (OJ L 209, 12.8.2017, p. 19).

    32017 R 2358: Commission Delegated Regulation (EU) 2017/2358 of 21 September 2017 supplementing Directive (EU) 2016/97 of the European Parliament and of the Council with regard to product oversight and governance requirements for insurance undertakings and insurance distributors (OJ L 341, 20.12.2017, p. 1), as amended by:

    —

    32018 R 0541: Commission Delegated Regulation (EU) 2018/541 of 20 December 2017 (OJ L 90, 6.4.2018, p. 59).

    32017 R 2359: Commission Delegated Regulation (EU) 2017/2359 of 21 September 2017 supplementing Directive (EU) 2016/97 of the European Parliament and of the Council with regard to information requirements and conduct of business rules applicable to the distribution of insurance-based investment products (OJ L 341, 20.12.2017, p. 8), as amended by:

    —

    32018 R 0541: Commission Delegated Regulation (EU) 2018/541 of 20 December 2017 (OJ L 90, 6.4.2018, p. 59).’

    Article 2

    The texts of Delegated Regulations (EU) 2017/2358, (EU) 2017/2359, (EU) 2018/541 and Implementing Regulation (EU) 2017/1469 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 3

    This Decision shall enter into force on 14 December 2019, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1), or on the day of the entry into force of Decision of the EEA Joint Committee No 214/2018 of 26 October 2018 (5), whichever is the later.

    Article 4

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
