Operative part of the judgment

The Tribunal:

1.

Annuls the decision setting Mr Valero Jordana's total number of points at the end of the 2004 promotion exercise and the decision not to promote him under that exercise;

2.

Dismisses the remainder of the action;

3.

Orders the Commission of the European Communities to bear all the costs.
