EXPLANATORY MEMORANDUM
1.CONTEXT OF THE DELEGATED ACT
Commission Delegated Regulation (EU) 2022/1408 1 amends Regulation (EU) 2021/2116 of the European Parliament and of the Council on the financing, management and monitoring of the common agricultural policy 2 in order to allow Member States to pay advances as regards interventions referred to in Title III, Chapter III, of Regulation (EU) 2021/2115 establishing rules on support for strategic plans under the common agricultural policy 3 .
Pursuant to Article 44(5) of Regulation (EU) 2021/2116, the Commission is empowered to adopt delegated acts supplementing that Regulation by setting up specific conditions for the payment of advances to ensure coherence and non-discrimination.
To guarantee an appropriate use of advances in respect of Union funds by the beneficiaries implementing the interventions referred to in Title III, Chapter III, of Regulation (EU) 2021/2115, the payment of advances provided for in Article 44(3a) of Regulation (EU) 2021/2116 should be subject to specific conditions in the form of maximum percentages of the forecast expenditure and the requirement that the beneficiaries are to lodge a security. Commission Delegated Regulation (EU) 2022/127 supplementing Regulation (EU) 2021/2116 4 should therefore be amended, in accordance with Article 44(5) of Regulation (EU) 2021/2116, in order to lay down such specific conditions and to adapt the provisions on securities accordingly.
Moreover, as regards aid payments under apiculture programmes set up in accordance with Article 55 of Regulation (EU) No 1308/2013 of the European Parliament and of the Council establishing a common organisation of the markets in agricultural products 5 , the current rules on the operative event for the exchange rate cease to apply at the end of 2022. For the sake of continuity, Regulation (EU) 2022/127 should be amended in order to maintain as operative event the date of 1 January of the year when the payment is made.
Article 24(4) of Regulation (EU) 2022/127 refers erroneously to Article 27, whereas it should instead refer to Article 26 of that Regulation. The reference should be corrected.
2.CONSULTATIONS PRIOR TO THE ADOPTION OF THE DELEGATED ACT
Consultations, involving experts from all the 27 Member States, have been carried out within the Expert Group established under Regulation (EU) 2021/2116, in particular during the meetings of 15 February, 22 March and 13 September 2022. These meetings allowed for a presentation of the Commission's ideas on the scope of the delegated act and on the planned amendments to Commission Delegated Regulation (EU) 2022/127, as well as an exchange of views with the experts. Following the 4-weeks public consultation, the Commission received three observations from stakeholders and citizens. As these observations relate either to legal interpretation questions, to issues already solved in the proposed legal act or to issues not covered by the legal text, the delegated act remains therefore unchanged.
3.LEGAL ELEMENTS OF THE DELEGATED ACT
This delegated act amends and corrects Commission Delegated Regulation (EU) 2022/127 by inserting an additional chapter to that Regulation in order to lay down specific conditions for the advances referred to in Article 44(3a) of Regulation (EU) 2021/2116 and to adapt the provisions on securities set out in Chapter IV of that Regulation. The delegated act further amends Regulation (EU) 2022/127 in order to maintain the current operative event for apiculture programmes and to correct an erroneous cross-reference.
