The Court:

1.

Declares that, by failing to notify the European Commission of its national programme for the implementation of spent fuel and radioactive waste management policy, the Italian Republic has failed to fulfil its obligations under Article 15(4), in conjunction with Article 13(1), of Council Directive 2011/70/Euratom of 19 July 2011 establishing a Community framework for the responsible and safe management of spent fuel and radioactive waste;

2.

Orders the Italian Republic to pay the costs.
