According to Article 180(c) of the Treaty, an action for the annulment of a measure adopted by the Board of Directors of the European Investment Bank may be instituted only by Member States or by the Commission. Consequently, that provision, a more flexible interpretation of which would go beyond the limits laid down by its wording for the Community judicature, precludes actions brought by natural or legal persons. This does not have the effect of depriving that category of persons of effective judicial redress, since that is secured for them by the jurisdiction of the Community judicature under Article 178 of the Treaty to entertain disputes relating to the non-contractual liability of the European Investment Bank.
