Delegated Regulation (EU) 2022/2104 supplementing Regulation (EU) No 1308/2013 as regards marketing standards for olive oil

Implementing Regulation (EU) 2022/2105 laying down rules on conformity checks of marketing standards for olive oil and methods of analysis of the characteristics of olive oil

WHAT IS THE AIM OF THE REGULATIONS?

  • The olive oil marketing standards protect European Union (EU) consumers and businesses from misdescribed and adulterated olive oil products. The standards ensure olive oil is marketed fairly, facilitating trade, and provide a deterrent against fraud.
  • Regulations (EU) 2022/2104 and (EU) 2022/2105 repeal and replace two existing regulations – Regulation (EEC) No 2568/91 and Implementing Regulation (EU) No 29/2012 – with the aim of simplifying, clarifying and providing greater transparency.

  • The regulations stem from Regulation (EU) No 1308/2013 (see summary) on the common organisation of agricultural markets in the EU.
  • The marketing standards set out:
    • parameters for different categories of olive oil (e.g. extra virgin olive oil, virgin olive oil, olive oil composed of refined olive oils and virgin olive oils, olive pomace oil);
    • methods of analyses and other control rules;
    • labelling and packaging rules.
  • The delegated act sets out rules for different olive oil categories including:
    • naming;
    • labelling – including greater control on the use of the legal names of the various categories of olive oil;

    • blending with other vegetable oils.

  • The implementing act clarifies and simplifies the rules on:
    • checking conformity with the standards for the different categories of olive oil;
    • cooperation between national authorities on conformity checks;
    • record-keeping by producers or holders of olive oil, along with the approval of packaging plants;
    • the methods for analysing olive oil’s characteristics.
  • Technical details on how to carry out checks are set out in annexes to the implementing act.
