Proposal for a Council Regulation amending, for the seventeenth time, Regulation (EEC) No. 3094/86 laying down certain technical measures for the conservation of fishery resources (COM(94)0481 - C4-0224/94 - 94/0253(CNS))

The proposal was approved with the following amendments:

Recitals 3a, b, c and d (new)

Whereas fishing with gill nets is highly selective;

Whereas there is a need to review minimum landing sizes;

Whereas there is a need to examine time-recording devices;

Whereas there is a need to explore more fully areas closed to beam trawling and trawling;

ARTICLE 1a (new)

To ensure the selectivity of gill netting and the quality of fish caught, the Commission shall undertake to determine the feasibility of using timing devices on such nets to control and limit the amount of time such nets are left in the water. The Commission shall report back to Parliament on the outcome of such studies.

ARTICLE 2, first paragraph

This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Communities.

This Regulation shall enter into force fifteen months following its publication in the Official Journal of the European Communities provided that the appropriate control system has been included in Regulation (EEC) No. 2847/93 establishing a control system applicable to the common fisheries policy(1).

Should this not be the case, this Regulation shall enter into force fifteen months following the publication of the Regulation amending, in respect of passive fishing gear, Regulation (EEC) No. 2847/93.

The European Parliament,

- having regard to the Commission proposal to the Council, COM(94)0481 - 94/0253(CNS) (( OJ C 348, 9.12.1994, p. 7.)),

- having been consulted by the Council pursuant to Article 43 of the EC Treaty (C4-0224/94),

- having regard to Rule 58 of its Rules of Procedure,

- having regard to the report of the Committee on Fisheries (A4-0016/95),

1. Approves the Commission proposal, subject to Parliament's amendments;

2. Calls on the Council to notify Parliament should it intend to depart from the text approved by Parliament;

3. Asks to be consulted again should the Council intend to make substantial modifications to the Commission proposal;

4. Instructs its President to forward this opinion to the Council and Commission.
