COMMISSION IMPLEMENTING REGULATION (EU) 2021/1820

of 18 October 2021

amending Implementing Regulation (EU) 2017/325 imposing a definitive anti-dumping duty on imports of high tenacity yarns of polyesters originating in the People’s Republic of China following an expiry review pursuant to Article 11(2) of Regulation (EU) 2016/1036 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union (1), and in particular Article 11 thereof,

Whereas:

Imports into the Union of high tenacity yarns of polyesters originating in the People’s Republic of China are subject to the anti-dumping measures from 5,1 % to 9,8 % for the sampled exporting producers from the PRC. For the cooperating exporting producers that were not included in the sample, a duty rate of 5,3 % was imposed. Furthermore, a countrywide duty rate of 9,8 % was imposed on imports of high tenacity yarns of polyesters by Council Implementing Regulation (EU) No 1105/2010 (2) .

Following an expiry review, the original measures were prolonged for five more years by Commission Implementing Regulation (EU) 2017/325 (3).

Commission Implementing Regulation (EU) 2019/1706 (4) concluded that the company Wuxi Solead Technology Development Co., Ltd (Wuxi Solead) met the criteria to be considered as a new exporting producer and added its name to the list of cooperating companies not included in the sample.

The company, following a change of its name (5) on 16 January 2020, requested on 26 May 2020 the Commission to confirm that the change of name did not affect the right of the company to benefit from the individual anti-dumping duty rate applied to it under its previous name.

The Commission examined the information supplied and concluded that the change of name did not affect the findings of Implementing Regulation (EU) 2019/1706 and in particular the anti-dumping duty rate applicable to Wuxi Solead.

On 8 July 2021 the Commission informed interested parties regarding its above findings and invited them to comment within a specified deadline. No comments were received.

The measures provided for in this Regulation are in accordance with the opinion of the Committee established by Article 15(1) of Regulation (EU) 2016/1036,

HAS ADOPTED THIS REGULATION:

Article 1

1.   In the Annex to Implementing Regulation (EU) 2017/325, the reference to:

‘Wuxi Solead Technology Development Co., Ltd.

Yixing City’

should be read as:

‘Jiangsu Solead New Material Group Co., Ltd.

Yixing City’

2.   The TARIC additional code A977 applicable to non-sampled Chinese cooperating exporting producers shall apply to Jiangsu Solead New Material Group Co., Ltd, Yixing City’ as of 16 January 2020. Any definitive duty paid on imports of products manufactured by Jiangsu Solead New Material Group Co., Ltd., Yixing City in excess of the anti-dumping duty established in Article 1(2) of Implementing Regulation (EU) 2017/325 as regards Wuxi Solead Technology Development Co., Ltd. shall be repaid or remitted in accordance with the applicable customs legislation.

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
