The applicant claims that the Court should:

annul Article 1, paragraphs (15) and (16) of Council Decision (CFSP) 2025/1495 of 18 July 2025 amending Decision 2014/512/CFSP concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine, (1)

annul Article 1, paragraphs (18), (19) and (20) of Council Regulation (EU) 2025/1494 of 18 July 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine, (2)

insofar as they concern the applicant;

order the Council to bear the cost of the present proceedings.

Pleas in law and main arguments

In support of the action, the applicant relies on eight pleas in law.

1.

First plea in law, alleging a breach of the European Union’s international obligations – breach of Article V(2)(d) of Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York, 1958), a breach of Article 54 ICSID Convention, Regulations and Rules and a breach of the principle of pacta sunt servanda under Article 26 of the Vienna Convention on the law of treaties.

2.

Second plea in law, alleging a breach of Article 4(3) TEU: a breach of the principle of sincere cooperation and a breach of the obligation to fulfil international commitments.

3.

Third plea in law, alleging a misapplication of Article 215 TFEU – an incorrect choice of legal basis.

Fourth plea in law alleging a breach of Articles 2 and 3 TFEU and Article 40 TUE as well as Regulation (EU) 1219/2012 of the European Parliament and of the Council of 12 December 2012. (3)

5.

Fifth plea in law, alleging a breach of the European Union general principle of legitimate expectations and breach of the principle of legal certainty.

6.

Sixth plea in law, alleging a breach of the Agreement on partnership and cooperation establishing a partnership between the European Communities and their Member States, of the one part, and the Russian Federation, of the other part. (4)

7.

Seventh plea in law, alleging a violation of the principle of non-discrimination (a breach of Articles 20 and 21 of the Charter of Fundamental Rights and a breach of Article 14 of the European Convention on Human Rights) and the principle of proportionality.

8.

Eighth plea in law, alleging a breach of the right to be heard and a breach of the right to effective judicial protection (Articles 41(a), 47 and 48 of the Charter of Fundamental Rights, Articles 6 and 13 of the European Convention of Human Rights) and a breach of the right to property (Article 17 of the Charter of Fundamental Rights, Article 1 protocol No 1 of the European Convention of Human Rights).
