Re:

By its action under Article 263 TFEU, the applicant seeks the annulment of Council Decision (CFSP) 2023/1094 of 5 June 2023, amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (OJ 2023 L 146, p. 20) and Council Regulation (EU) 2023/1089 of 5 June 2023, amending Regulation (EU) No 269/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (OJ 2023 L 146, p. 1).

Operative part of the order

1.

The action is dismissed.

2.

There is no longer any need to rule on the application to intervene submitted by the Republic of Estonia.

3.

Mr Artem Alexandrovich shall pay the costs, with the exception of those relating to the application to intervene.

4.

Mr Artem Alexandrovich, the Council and the Republic of Estonia shall each bear their own costs relating to the application to intervene.
