Operative part of the order

1.

The application initiating third-party proceedings is dismissed as inadmissible.

2.

The Portuguese Republic shall bear its own costs and pay those incurred by Transnáutica — Transportes e Navegação, SA, including those relating to the interim proceedings.

3.

The European Commission shall bear its own costs.
