    Temporary committee on policy challenges and budgetary means

    European Parliament decision on setting up a temporary committee on policy challenges and budgetary means of the enlarged Union 2007-2013

    The European Parliament,

    having regard to Rule 175 of its Rules of Procedure,

    having regard to the decision of the Conference of Presidents of 9 September 2004 proposing the setting-up of a temporary committee on the policy challenges and budgetary means of the enlarged Union 2007-2013,

    having regard to its resolution of 22 April 2004 on building our common future: policy challenges and budgetary means of the enlarged Union 2007-2013 (1),

    having regard to the Commission communication entitled ‘Building our common Future: Policy challenges and Budgetary means of the Enlarged Union 2007-2013’ (COM(2004) 0101),

    having regard to the Commission communication entitled ‘Financial Perspectives 2007-2013’ (COM (2004) 0487),

    having regard to the need to gather and coordinate the views of the different committees concerned and to establish a mandate for the Committee on Budgets for its negotiation with the Council of a new Interinstitutional Agreement containing the Financial Perspective,

    1.

    Decides to set up a temporary committee with the following mandate:

    (a)

    to define the European Parliament's political priorities for the future financial perspective both in legislative and budgetary terms;

    (b)

    to propose a structure for the future financial perspective in line with these priorities;

    (c)

    to make an estimate of the financial resources to be allocated to European Union expenditure for the period 2007-2013;

    (d)

    to propose an indicative allocation of resources between and within the different headings of the financial perspective in line with the priorities and proposed structure;

    2.

    Decides that the temporary committee should present to the European Parliament a final report before the Council establishes its common position, with a view to determining Parliament's negotiating position;

    3.

    Recalls that the specific budgetary and legislative proposals will be dealt with by the relevant committees in accordance with Annex VI to its Rules of Procedure;

    4.

    Decides that the temporary committee shall be composed of 50 members.

    EU-Mauritius fishing agreement *

    European Parliament legislative resolution on the proposal for a Council regulation on the conclusion of the Protocol defining, for the period 3 December 2003 to 2 December 2007, the fishing opportunities and the financial compensation provided for by the Agreement between the European Economic Community and the Government of Mauritius on fishing in the waters of Mauritius (COM(2004) 0197 — C5-0179/2004 — 2004/0071(CNS))

    (Consultation procedure)

    The European Parliament,

    having regard to the proposal for a Council regulation (COM(2004) 0197) (1),

    having regard to Articles 37 and 300(2) of the EC Treaty,

    having regard to Article 300(3), first subparagraph, of the EC Treaty, pursuant to which the Council consulted Parliament (C5-0179/2004),

    having regard to Rules 51 and 83(7) of its Rules of Procedure,

    having regard to the report of the Committee on Fisheries and the opinion of the Committee on Development (A6-0001/2004),

    1.

    Approves the proposal for a Council regulation as amended and approves conclusion of the Protocol;

    2.

    Instructs its President to forward its position to the Council and Commission and to the governments and parliaments of the Member States and Mauritius.

    Amendment 1

    Recital 4a (new)

     

    (4a) The protection of the EU's fisheries interests must be coordinated with the sustainable management of fishery resources in economic, social and environmental terms, and with the development of coastal populations living on fisheries.

    Amendment 2

    Recital 4b (new)

     

    (4b) The Commission should continue with its impact assessment studies concerning the sustainable character of the Agreement with Mauritius.

    Amendment 3

    Recital 4c (new)

     

    (4c) The Commission should ensure that allocated funds are fully applied for the purposes established in the Agreement, and should monitor its impact on local populations' development, in particular the coastal communities living on traditional fisheries.

    Amendment 4

    Article 3a (new)

     

    Article 3a

    The Commission shall forward to the European Parliament and to the Council a copy of the annual report referred to in Article 3(5) of the Protocol.

    Amendments 5 and 6

    Article 3b (new)

     

    Article 3b

    1. During the final year of the Protocol's validity and before negotiations are opened on its possible renewal, the Commission shall submit to the European Parliament and to the Council a general report on its application and the conditions under which it was implemented, with particular regard to the specific actions, together with a cost-benefit analysis, so that an assessment can be made of its economic, social and environmental impact.

    2. On the basis of this report, and taking account of the European Parliament's opinion thereon, the Council shall, where appropriate, authorise the Commission to open negotiations with a view to the adoption of a new protocol.

    having regard to the proposal for a Council regulation (COM(2004) 0218) (1),

    having regard to Articles 37 and 300(2) of the EC Treaty,

    During the last year in which the Protocol is in force and prior to commencing any negotiations on its renewal, the Commission shall submit a general assessment report to the European Parliament and the Council, including a cost-benefit analysis, the utilisation of the fishing opportunities and an assessment of the implementation of the targeted measures, so that the economic, social and environmental impact of the Protocol can be examined.

    Article 3c (new)

    On the basis of the above reports and taking due account of the European Parliament's opinion thereon, the Council shall, if appropriate, then authorise the Commission to open negotiations with a view to concluding a new Protocol.

    Before the extension of this Protocol expires and before any agreement on the renewal thereof is concluded, the Commission shall submit to the European Parliament and the Council a report on the implementation of the Protocol (including an analysis of the use made of the funds earmarked for the targeted measures), in order to enable the social, economic and environmental impact of the Protocol to be studied.

    Amendment 2

    Article 3b (new)

    On the basis of the above report and bearing in mind the European Parliament's opinion on the matter, the Council shall authorise the Commission if appropriate to initiate negotiations with a view to concluding a new Protocol.

    Should the Cape Verde authorities so request, the Commission shall consider the possibility of transferring amounts which are currently included under ‘targeted measures’ to Commission-financed projects which serve the same purpose as the targeted-measures projects.
