implementing Regulation (EU) 2018/858 of the European Parliament and of the Council as regards the basic format, structure and the means of exchange of the data of the certificate of conformity in electronic format
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2018/858 of the European Parliament and of the Council of 30 May 2018 on the approval and market surveillance of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles, amending Regulations (EC) No 715/2007 and (EC) No 595/2009 and repealing Directive 2007/46/EC 1 , and in particular Article 37(8) thereof,
Whereas:
(1)To ensure that Member States have sufficient time to establish the organisation and structure of their data network, to enable data supply and reception of the certificates of conformity as structured data in electronic format, it is appropriate to designate the European Vehicle and Driving Licence Information System (EUCARIS) 2 for the exchange of that data. EUCARIS has been developed by and for governmental authorities to share vehicle and driving license registration information.
(2)In order to ensure that the certificates of conformity are exchanged in a uniform manner and that the data elements and messages they contain are harmonised, the format and structure of the data elements of the certificates of conformity should be based on Extensible Markup Language (XML) schema structure and principles. The manufacturer and the approval authority should use the standardised Initial Vehicle Information (IVI) messages developed by the EUCARIS nominated party for operation, for their exchange as structured data in electronic format.
(3)In order to make it possible for the approval authority and the manufacturer to implement the amendments to the data elements for the certificate of conformity in paper format referred to in Article 36(1) of Regulation (EU) 2018/858 in their data network it is necessary to lay down practical arrangements for such amendments.
(4)In order to enable type-approval authorities, market surveillance authorities and registration authorities of the Member States as well as manufacturers to prepare for the application of the new rules introduced by this Regulation, the date of application should be deferred.
(5)The measures provided for in this Regulation are in accordance with the opinion of the Technical Committee – Motor Vehicles (TCMV),
HAS ADOPTED THIS REGULATION:
Article 1
The means of exchange of data
1.The manufacturer shall make available an electronic version of the certificate of conformity in accordance with the format and structure of the data elements and standardised messages set out in Article 2 through any national access point of the European Vehicle and Driving Licence Information System (EUCARIS) in the Union to the type-approval authority that has granted the whole-vehicle type-approval.
2.The approval authority shall use EUCARIS as the means of exchange of data of the certificate of conformity as structured data in electronic format referred to in point (c) of Article 37(8) of Regulation (EU) 2018/858.
Article 2
Basic format and structure of the data elements and standardised messages
1.The format and structure of the data elements of the certificates of conformity in electronic format and the messages used in the exchange, referred to in point (a) of Article 37(8) of Regulation (EU) 2018/858, shall be based on Extensible Markup Language (XML) schema structure and principles.
2.The manufacturer and the approval authority shall use the standardised Initial Vehicle Information (IVI) messages developed by the EUCARIS nominated party for operation, for the exchange of the certificates of conformity as structured data in electronic format.
