COMMISSION IMPLEMENTING REGULATION (EU) 2024/2195

determining the format for submitting the reports of data referred to in Article 26 of Regulation (EU) 2024/573 of the European Parliament and of the Council on fluorinated greenhouse gases and repealing Commission Implementing Regulation (EU) No 1191/2014

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2024/573 of the European Parliament and of the Council of 7 February 2024 on fluorinated greenhouse gases, amending Directive (EU) 2019/1937 and repealing Regulation (EU) No 517/2014 (1), and in particular Article 26(9), second subparagraph,

Whereas:

Commission Implementing Regulation (EU) No 1191/2014 (2) established the format for the report to be submitted by producers, importers, exporters and certain users of fluorinated greenhouse gases in accordance with Article 19 of Regulation (EU) No 517/2014 of the European Parliament and of the Council (3).

(2)

Regulation (EU) No 517/2014 has since been replaced by Regulation (EU) 2024/573. Article 26 of Regulation (EU) 2024/573 establishes new reporting obligations concerning producers, importers, exporters and certain users of fluorinated greenhouse gases. In particular, the list of gases, equipment containing those gases and activities related to those gases has been extended.

Implementing Regulation (EU) No 1191/2014 should therefore be repealed.

The measures provided for in this Regulation are in accordance with the opinion of the Committee on fluorinated greenhouse gases,

HAS ADOPTED THIS REGULATION:

Article 1

The reports referred to in Article 26 of Regulation (EU) 2024/573 shall be based on the format set out in the Annex to this Regulation.

Article 2

Implementing Regulation (EU) No 1191/2014 is repealed.

Article 3

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

ANNEX

GENERAL EXPLANATIONS

Unless otherwise stated in the reporting sections of this Annex, the reported data shall cover the activities of the undertaking during the calendar year for which the report is submitted.

The units of measurement, the gases covered, the level of detail and an indication of the year in which activities are to be reported are specified separately in each reporting section.

The general format of the reporting tool is set out in the following reporting sections.

REPORTING SECTIONS

Section 1:   To be filled in by producers of gases – Article 26(1), first subparagraph, Article 26(2) and (3), of Regulation (EU) 2024/573 and point 1(a) of Annex IX to that Regulation

Only bulk imports shall be reported in this section, including quantities shipped alongside equipment for the purpose of charging that equipment after import, but not quantities contained in equipment. Imports of gases contained in products or equipment shall be reported under Section 11. All imports shall be reported, except goods under temporary storage.

An explanation for the emissions shall be provided.

Section 3:   To be filled in by exporters of gases – Article 26(1), first subparagraph, of Regulation (EU) 2024/573 and point 3 of Annex IX to that Regulation

Quantities shall be reported in metric tonnes with accuracy to the third decimal place (if the fourth decimal place is 5 or more, the third decimal place shall be rounded up, otherwise it shall be rounded down), separately for each gas listed in Annexes I, II or III to Regulation (EU) 2024/573, for mixtures containing at least one of those gases or for each gas or mixture contained in exported pre-blended polyols. Quantities of hydrofluorocarbons shall be reported separately for each country of destination, except where indicated otherwise in the following table.

Only exports of bulk gases, including any quantities shipped alongside equipment for the purpose of charging that equipment after export, shall be reported under this section.

Quantities from own production supplied to other undertakings in the Union for direct export, or own imports released for free circulation and exported either by the importer itself or supplied to other undertakings in the Union for direct export, shall be reported in reporting Section 5.

Quantity supplied directly to undertakings for export out of the Union, where those quantities were not subsequently made available to another party within the Union prior to export

Quantities that undertakings released for free circulation and directly exported themselves shall also be reported here.

Note that all gases to be reported here must have been labelled as ‘for direct export out of the EU only’ at the time of release for free circulation in line with Article 12(9) of Regulation (EU) 2024/573.

Quantities imported under special customs procedures and sold or supplied to other undertakings during those procedures for re-export shall only be reported in Section 2H.

The exporting undertaking/s shall be specified.

Verification documents should be provided.

Only hydrofluorocarbons in bulk shall be reported, not quantities contained in products or equipment.

5D

Quantity supplied directly for use in military equipment

The undertaking receiving the quantity for use in military equipment shall be specified.

Quantity supplied directly to an undertaking using it for the etching of semiconductor material or the cleaning of chemicals vapour deposition chambers within the semiconductor manufacturing sector

The receiving semiconductor manufacturer shall be specified.

5F

Quantity supplied directly to an undertaking producing metered dose inhalers for the delivery of pharmaceutical ingredients

The receiving producer of metered dose inhalers for the delivery of pharmaceutical ingredients shall be specified.

Only quantities actually used as feedstock shall be reported in this section.

Where hydrofluorocarbons (gases listed in Section 1 of Annex I to Regulation (EU) 2024/573 or mixture containing at least one of those gases) were produced or imported by the undertaking using them as the feedstock, the quantities used shall also be reported in Section 5. Where hydrofluorocarbons were produced by the undertaking using them as the feedstock, the quantities used shall also be reported in Section 1. Where an undertaking produced or imported hydrofluorocarbons and subsequently sold them for use as feedstock to other undertakings, the quantities supplied shall not be reported in this section, but only in reporting Section 5, specifying the feedstock using undertaking, and in the case of producers those shall also be reported in reporting Section 1, specifying the Member State where the feedstock use takes place.

Quantities shall be reported in metric tonnes with accuracy to the third decimal place (if the fourth decimal place is 5 or more, the third decimal place shall be rounded up, otherwise it shall be rounded down), separately for each fluorinated greenhouse gas listed in Annexes I, II or III to Regulation (EU) 2024/573, or mixture containing at least one of those gases.

For hydrofluorocarbons, the destruction technology approved under the Montreal Protocol shall be specified, differentiating concentrated sources (such as recovered refrigerants) and dilute sources (such as waste streams containing foams).

The total quantities destroyed by the reporting undertakings themselves shall be reported. Undertakings which are producers shall also report on the quantities of their own production which has been destroyed, in reporting Section 1.

Undertakings which are importers of hydrofluorocarbons (gases listed in Section 1 of Annex I to Regulation (EU) 2024/573, or mixture containing at least one of those gases) shall also report the quantities of their own imports which have been destroyed, in reporting Section 5.

Quantities sent for destruction to other undertakings in the Union shall not be reported in this section. Quantities exported for destruction outside the Union shall be reported in Section 3G.

Quantities of fluorinated greenhouse gases listed in Annexes I, II or III to Regulation (EU) 2024/573 or mixtures containing at least one of those gases contained in the products and equipment or parts thereof shall be reported in metric tonnes with accuracy to the third decimal place (if the fourth decimal place is 5 or more, the third decimal place shall be rounded up, otherwise it shall be rounded down), by category. In addition to the total quantity of gases, the number of units shall be reported per category, unless otherwise stated. For Section 11_M, the number of units shall refer to the number of functional units and shall be reported on with the associated quantities of substances.

Producers of products or equipment or parts thereof manufactured in the Union shall not report on products and equipment or parts thereof where the contained gases were previously imported into or produced in the Union. Where a producer itself produces bulk gas in the Union for use in the Union for manufacturing their products and equipment or parts thereof, its reporting on production (reporting Section 1) shall also cover the relevant gas amounts, so those amounts shall not be reported in this Section, but only in reporting Section 1.

Importers of products or equipment or parts thereof containing a fluorinated greenhouse gas listed in Annexes I, II and III to Regulation (EU) 2024/573 shall report on all gas containing imports released by customs for free circulation in the Union. Imports of pre-blended polyols shall not be reported in this Section, but only in Section 2.

Where hydrofluorocarbons (gases listed in Section 1 of Annex I to Regulation (EU) 2024/573 or mixtures containing at least one of those gases) contained in imported refrigeration, air conditioning equipment or heat pumps or in imported metered dose inhalers for the delivery of pharmaceutical ingredients had previously been exported from the Union, and had been subject to the hydrofluorocarbon quota limitation for placing on the Union market, that shall be reported in reporting Section 12 in order to prove compliance with Article 19 of Regulation (EU) 2024/573. Where imported refrigeration equipment, air conditioning equipment or heat pumps or parts thereof or imported metered dose inhalers for the delivery of pharmaceutical ingredients containing hydrofluorocarbons had previously been placed on the Union market (including the charge of hydrofluorocarbons) and had subsequently been exported from the Union prior to re-import, that shall be reported in reporting Section 12a to prove compliance with Article 19 of Regulation (EU) 2024/573. The following categories of products or equipment or parts thereof include components intended for that specified product or equipment categories.

Where there is a reference to rated capacity and the equipment can have different functions the rated capacity refers to the primary function of the equipment.

The undertaking/s having placed the hydrofluorocarbons on the Union market for the first time and the year/s of that placing on the market shall be specified.

Amount of hydrofluorocarbons charged into the imported metered dose inhalers, released by customs for free circulation in the Union, for which the hydrofluorocarbons had previously been exported from the Union and which had been subject to the hydrofluorocarbon quota limitation for placing on the Union market

Applicable for the first time to reporting on activities carried out in 2025 (by 31 March 2026 at the latest).

Applies to hydrofluorocarbons contained in imported metered dose inhalers included in the amounts reported in Section 11_J1.

The hydrofluorocarbon exporting undertaking/s and the year/s of export shall be specified.

The undertaking/s having placed the hydrofluorocarbons on the Union market for the first time and the year/s of that placing on the market shall be specified.

Section 12a:   To be filled in by importers of refrigeration equipment, air conditioning equipment tor heat pumps or metered dose inhalers charged with hydrofluorocarbons, where the imported equipment or products (including the charge of hydrofluorocarbons) had previously been placed on the Union market and subsequently been exported from the Union prior to the re-import – Article 26(7) of Regulation (EU) 2024/573 and point 6 of Annex IX to that Regulation

Quantities shall be reported in metric tonnes with accuracy to the third decimal place (if the fourth decimal place is 5 or more, the third decimal place shall be rounded up, otherwise it shall be rounded down), separately for each hydrofluorocarbon (gases listed in Section 1 of Annex I to Regulation (EU) 2024/573 or mixture containing at least one of those gases).

Nil report:   To be completed by undertakings that have been allocated quota pursuant to Article 17(4) of Regulation (EU) 2024/573, or have received quotas pursuant to Article 21(1) of that Regulation but have not placed any quantities of hydrofluorocarbons on the market the calendar year for which the report is submitted – Article 26(1), second subparagraph, of Regulation (EU) 2024/573

Undertakings that report no hydrofluorocarbons (gases listed in Section 1 of Annex I to Regulation (EU) 2024/573 or mixtures containing at least one of those gases) placed on the Union market in Section 4M shall confirm the absence of related activities.
