DECISION OF THE EEA JOINT COMMITTEE

No 72/2010

of 11 June 2010

amending Annex XIII (Transport) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex XIII to the Agreement was amended by Decision of the EEA Joint Committee No 51/2010 of 30 April 2010 (1).

(2)

Commission Directive 2008/126/EC of 19 December 2008 amending Directive 2006/87/EC of the European Parliament and of the Council laying down technical requirements for inland waterway vessels (2) is to be incorporated into the Agreement.

(3)

Commission Directive 2009/46/EC of 24 April 2009 amending Directive 2006/87/EC of the European Parliament and of the Council laying down technical requirements for inland waterway vessels (3) is to be incorporated into the Agreement.

(4)

Commission Directive 2009/56/EC of 12 June 2009 correcting Directive 2008/126/EC amending Directive 2006/87/EC of the European Parliament and of the Council laying down technical requirements for inland waterway vessels, as regards its date of transposition (4) is to be incorporated into the Agreement.

(5)

Directive 2009/100/EC of the European Parliament and of the Council of 16 September 2009 on reciprocal recognition of navigability licences for inland waterway vessels (5) is to be incorporated into the Agreement.

(6)

Directive 2009/100/EC repeals Council Directive 76/135/EEC (6), which is incorporated into the Agreement and which is consequently to be repealed under the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Annex XIII to the Agreement shall be amended as follows:

1.

the following indents shall be added in point 47a (Directive 2006/87/EC of the European Parliament and of the Council):

‘—

32008 L 0126: Commission Directive 2008/126/EC of 19 December 2008 (OJ L 32, 31.1.2009, p. 1), as corrected by:

—

32009 L 0056: Commission Directive 2009/56/EC of 12 June 2009 (OJ L 150, 13.6.2009, p. 5),

—

32009 L 0046: Commission Directive 2009/46/EC of 24 April 2009 (OJ L 109, 30.4.2009, p. 14).’;

2.

the text of point 48 (Council Directive 76/135/EEC) shall be replaced by the following:

‘ 32009 L 0100: Directive 2009/100/EC of the European Parliament and of the Council of 16 September 2009 on reciprocal recognition of navigability licences for inland waterway vessels (OJ L 259, 2.10.2009, p. 8).’.

Article 2

The texts of Directives 2008/126/EC, 2009/46/EC, 2009/56/EC and 2009/100/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 12 June 2010, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
