[pic] | ΕΠΙΤΡΟΠΗ ΤΩΝ ΕΥΡΩΠΑΪΚΩΝ ΚΟΙΝΟΤΗΤΩΝ | Βρυξέλλες, 14.9.2005 COM(2005) 435 τελικό 2005/0177 (ACC) 2005/0178 (AVC) Πρόταση ΑΠΟΦΑΣΗΣ ΤΟΥ ΣΥΜΒΟΥΛΙΟΥ περί της υπογραφής από την Ευρωπαϊκή Κοινότητα της συνθήκης για την Ενεργειακή Κοινότητα Πρόταση ΑΠΟΦΑΣΗΣ ΤΟΥ ΣΥΜΒΟΥΛΙΟΥ περί της σύναψης από την Ευρωπαϊκή Κοινότητα της συνθήκης για την Ενεργειακή Κοινότητα (υποβληθείσες από την Επιτροπή) ΑΙΤΙΟΛΟΓΙΚΗ ΕΚΘΕΣΗ Το Ευρωπαϊκό Συμβούλιο της Θεσσαλονίκης ενέκρινε, τον Ιούνιο του 2003, το «Θεματολόγιο της Θεσσαλονίκης για τα Δυτικά Βαλκάνια: πορεία προς την ευρωπαϊκή ολοκλήρωση», το οποίο αποσκοπεί στην περαιτέρω ενίσχυση των σχέσεων μεταξύ της Ευρωπαϊκής Ένωσης και των Δυτικών Βαλκανίων και με το οποίο η Ευρωπαϊκή Ένωση ενθαρρύνει τις χώρες της περιοχής να υιοθετήσουν νομικώς δεσμευτική συμφωνία για την επέκταση της ενεργειακής αγοράς της Ευρωπαϊκής Κοινότητας στη Νοτιοανατολική Ευρώπη. Με την ανακοίνωσή της 26ης Μαΐου 2003 προς το Συμβούλιο και το Ευρωπαϊκό Κοινοβούλιο σχετικά με την ανάπτυξη της ενεργειακής πολιτικής για τη διευρυμένη Ευρωπαϊκή Ένωση, τις γειτονικές χώρες και τις χώρες εταίρους, η Επιτροπή ζήτησε να δημιουργηθεί γνήσια ολοκληρωμένη αγορά ενέργειας, χωρίς κανένα εμπόδιο, στον ευρύτερο ευρωπαϊκό χώρο, συμπεριλαμβανομένης της Νοτιοανατολικής Ευρώπης, με την προώθηση ίσων όρων ανταγωνισμού και υψηλών προδιαγραφών για το περιβάλλον. Το Νοέμβριο του 2002, κατά την σύνοδο υπουργών στο πλαίσιο της διαδικασίας του φόρουμ της Αθήνας, υπό τη χορηγία της Ευρωπαϊκής Επιτροπής, τα κράτη μέλη της αγοράς ηλεκτρικής ενέργειας της Νοτιανατολικής Ευρώπης υπέγραψαν Μνημόνιο Συμφωνίας με το οποίο ανέλαβαν την υποχρέωση να εφαρμόσουν κανόνες παρόμοιους με τις κοινοτικές διατάξεις για τη δημιουργία εσωτερικής αγοράς ηλεκτρικής ενέργειας στη Νοτιοανατολική Ευρώπη. Στο δεύτερο Μνημόνιο Συμφωνίας, που υπογράφηκε το Δεκέμβριο του 2003, με συμβαλλόμενο μέρος την Ευρωπαϊκή Κοινότητα, προβλέπεται η διεύρυνση της διεργασίας του φόρουμ της Αθήνας στις αγορές φυσικού αερίου και επιβεβαιώθηκε το πρώτο Μνημόνιο Συμφωνίας. Τον Νοέμβριο του 2002, η Επιτροπή πρότεινε έγγραφο κοινής στρατηγικής με τους διεθνείς χορηγούς που δραστηριοποιούνται στην Νοτιοανατολική Ευρώπη. Με το έγγραφο κοινής στρατηγικής προέτρεπε να δημιουργηθεί κανονιστικό πλαίσιο που να καθιστά δυνατή την αποτελεσματικότερη παροχή χρηματοδοτικής βοήθειας στην περιοχή. Αυτή η κοινή στρατηγική έχει καταστεί η βάση για τη συνέχιση της ανάληψης υποχρεώσεων από τους διεθνείς χρηματοπιστωτικούς οργανισμούς. Η Δημοκρατία της Βουλγαρίας, η Ρουμανία, η Δημοκρατία της Τουρκίας και η Δημοκρατία της Κροατίας είναι χώρες υποψήφιες για προσχώρηση στην Ευρωπαϊκή Ένωση, και η πρώην Γιουγκοσλαβική Δημοκρατία της Μακεδονίας έχει επίσης υποβάλει αίτηση προσχώρησης. Τον Δεκέμβριο 2002, το Ευρωπαϊκό Συμβούλιο της Κοπεγχάγης επιβεβαίωσε την Ευρωπαϊκή προοπτική της Δημοκρατίας της Αλβανίας, της Βοσνίας και Ερζεγοβίνης, της Σερβίας και του Μαυροβουνίου, ως δυνητικών υποψηφίων για προσχώρηση στην Ευρωπαϊκή Ένωση, και υπογράμμισε την αποφασιστικότητά του να υποστηρίξει τις προσπάθειές τους να πλησιάσουν περισσότερο την Ευρωπαϊκή Ένωση. Σύμφωνα με την απόφαση της 17ης Μαΐου 2004 του Συμβουλίου, η Ευρωπαϊκή Επιτροπή διαπραγματεύθηκε συμφωνία για τη δημιουργία Ενεργειακής Κοινότητας με τη Δημοκρατία της Αλβανίας, τη Δημοκρατία της Βουλγαρίας, τη Βοσνία και Ερζεγοβίνη, τη Δημοκρατία της Κροατίας, την πρώην Γιουγκοσλαβική Δημοκρατία της Μακεδονίας, τη Δημοκρατία του Μαυροβουνίου, τη Ρουμανία, τη Δημοκρατία της Σερβίας, τη Δημοκρατία της Τουρκίας, και με την αποστολή των Ηνωμένων Εθνών για την προσωρινή διοίκηση του Κοσσυφοπεδίου (σύμφωνα με την απόφαση 1244 του Συμβουλίου Ασφαλείας των Ηνωμένων Εθνών). Η συνθήκη αυτή θα συμβάλει σε μεγάλο βαθμό στην επίτευξη των προαναφερόμενων στόχων Η συνθήκη θα αποτελέσει το νομικώς δεσμευτικό πλαίσιο της ήδη υφιστάμενης και συνεχιζόμενης συνεργασίας μεταξύ της Ευρωπαϊκής Κοινότητας και των χωρών της περιοχής, σύμφωνα με τα Μνημόνια Συμφωνίας της Αθήνας των ετών 2002 και 2003. Το γενικό περιεχόμενο της συνθήκης ενέκριναν το Δεκέμβριο του 2004 όλα τα μέρη που συμμετέχουν στη διαδικασία της Αθήνας, συμπεριλαμβανομένων των πέντε κρατών μελών της Ευρωπαϊκής Ένωσης που εμπλέκονται στη διαδικασία αυτή. Η Επιτροπή μπορεί να προτείνει κοινή δήλωση με το Συμβούλιο για την προστασία των συμφερόντων των εν λόγω κρατών μελών. Με τη συνθήκη δημιουργείται εσωτερική αγορά ενέργειας της Ευρωπαϊκής Κοινότητας και των χωρών της εν λόγω περιοχής που δεν είναι μέλη της ΕΕ, στην οποία συμπεριλαμβάνεται η αμοιβαία βοήθεια και, ενδεχομένως, κοινή εξωτερική πολιτική ενεργειακών συναλλαγών, συνιστώσα απαραίτητη για μια εσωτερική αγορά. Έτσι, καθιστά δυνατή τη δημιουργία του κανονιστικού πλαισίου που θα παρέχει τις συνθήκες αποτελεσματικής λειτουργίας των ενεργειακών αγορών της περιοχής, όπου συμπεριλαμβάνονται οι ενεργειακές αγορές των κρατών μελών της ΕΕ της περιοχής. Στη συνθήκη προβλέπεται να εφαρμόζεται από τις χώρες της περιοχής που δεν είναι μέλη της ΕΕ το σχετικό κοινοτικό κεκτημένο σε θέματα ενέργειας, περιβάλλοντος, ανταγωνισμού και ανανεώσιμων πηγών ενέργειας. Η συνθήκη, όπως και η διαδικασία της Αθήνας που προηγήθηκε, προβλέπει ορισμένο βαθμό συντονισμού σε περιφερειακό επίπεδο ώστε να ξεπεραστούν τα πολιτικά προβλήματα που έχουν παγιωθεί σε κρατικό επίπεδο, καθώς και θέματα συνεργασίας στην κανονιστική ρύθμιση, τις επενδύσεις, τα στατιστικά στοιχεία και στον συντονισμού των αγορών σε υλικά ζητήματα. Με τη συνθήκη δημιουργείται χώρος χωρίς εσωτερικά σύνορα για το φυσικό αέριο και την ηλεκτρική ενέργεια με σκοπό να προωθηθεί η ευρύτερη προσφορά φυσικού αερίου και ηλεκτρικής ενέργειας σε όλους τους πολίτες που να βασίζεται σε υποχρεώσεις παροχής δημόσιας υπηρεσίας, να επιτευχθεί η οικονομική και κοινωνική πρόοδος και υψηλό επίπεδο απασχόλησης, καθώς και ισόρροπη και αειφόρος ανάπτυξη. Ζητήματα σχετικά με τις συνέπειες στην κοινωνία και στην απασχόληση, περιλαμβανομένων των συνθηκών εργασίας, καθώς και ο κοινωνικός διάλογος αποτελούν επί του παρόντος αντικείμενο ζωηρών συζητήσεων, επιδιώκεται δε η ανάληψη χωριστών πολιτικών δεσμεύσεων σε συμπληρωματικό Μνημόνιο Συμφωνίας, με σκοπό να εξασφαλιστεί ότι η κοινωνική διάσταση θα αποτελέσει αναπόσπαστο μέρος της εσωτερικής αγοράς. Καίριας σημασίας για την ανάπτυξη της κοινωνικής διάστασης θα είναι η συμμετοχή των κοινωνικών εταίρων και άλλων άμεσα ενδιαφερόμενων. Πάνω απ’ όλα, πρόκειται για την πρώτη πολυμερή συνθήκη που θα έχει ποτέ υπογραφεί γι’ αυτήν την περιοχή και η οποία θα συμβάλει στην ενσωμάτωση συγκεκριμένου οικονομικού κλάδου με ιδιαίτερη συμβολική σημασία. Η συνθήκη θα προσελκύσει επενδύσεις επειδή θα δημιουργήσει σταθερό κανονιστικό και εμπορικό πλαίσιο και θα καταστήσει δυνατή την οικονομική ανάπτυξη και την κοινωνική σταθερότητα στην περιοχή. Επιπλέον, θα βελτιώσει την ασφάλεια του εφοδιασμού της Ευρωπαϊκής Ένωσης παρέχοντας κίνητρα για τη σύνδεση των Βαλκανίων με τα αποθέματα φυσικού αερίου της Κασπίας, της Βόρειας Αφρικής και της Μέσης Ανατολής και θα θέσει τέλος στην απομόνωση των δικτύων της Ελλάδας. Σε συνεργασία με τους διεθνείς χορηγούς, η συνθήκη θα βελτιώσει τον συντονισμό της παροχής χρηματοδοτικής βοήθειας στην περιοχή. Η Παγκόσμια Τράπεζα έχει εν προκειμένω αναγγείλει τη δημιουργία ταμείου επενδύσεων ύψους 1,75 δισεκατομμυρίων $ για τους κλάδους ηλεκτρικής ενέργειας και φυσικού αερίου της περιοχής. Η χορήγηση κονδυλίων θα εξαρτάται από τη συμμόρφωση προς τη συνθήκη. Το ταμείο της Παγκόσμιας Τράπεζας ενδέχεται να αυξηθεί, δεδομένου ότι η Παγκόσμια Τράπεζα εκτιμά ότι οι συνολικές επενδύσεις που είναι απαραίτητες ώστε να φθάσει η αγορά το επίπεδο της ΕΕ είναι της τάξεως των 20 δισεκατομμυρίων $. Η διαδικασία της συνθήκης για την Ενεργειακή Κοινότητα έχει επίσης συμπεριληφθεί στην πολιτική δανειοδότησης από την Ευρωπαϊκή Τράπεζα Ανασυγκρότησης και Ανάπτυξης (ΕΤΑΑ), η οποία έχει χορηγήσει διάφορα δάνεια με βάση τους συνολικές προσδοκίες της. Σκοπός είναι να ελαχιστοποιηθούν αντικρουόμενες μεταξύ των χορηγών προϋποθέσεις χρηματοδότησης. Η Ευρωπαϊκή Κοινότητα θα έχει το δικαίωμα αρνησικυρίας επί όλων των αποφάσεων που θα λαμβάνει η Ενεργειακή Κοινότητα. Οι συνέπειες στον προϋπολογισμό της Ευρωπαϊκής Κοινότητας είναι πολύ περιορισμένες, δεδομένου ότι ο προϋπολογισμός της συνθήκης για την Ενεργειακή Κοινότητα θα καλύπτει μόνον τις δαπάνες της Ενεργειακής Κοινότητας που είναι απαραίτητες για τη λειτουργία των θεσμικών της οργάνων. Η Επιτροπή καλείται να εγκρίνει: 1. τις αποφάσεις περί υπογραφής και σύναψης· και 2. το σχέδιο κοινής δήλωσης της Επιτροπής και του Συμβουλίου. 2005/0177 (ACC) Πρόταση ΑΠΟΦΑΣΗΣ ΤΟΥ ΣΥΜΒΟΥΛΙΟΥ περί της υπογραφής από την Ευρωπαϊκή Κοινότητα της συνθήκης για την Ενεργειακή Κοινότητα ΤΟ ΣΥΜΒΟΥΛΙΟ ΤΗΣ ΕΥΡΩΠΑΪΚΗΣ ΕΝΩΣΗΣ, Έχοντας υπόψη: τη συνθήκη για την ίδρυση της Ευρωπαϊκής Κοινότητας, και ιδίως το άρθρο 47 παράγραφος 2, τα άρθρα 55, 83, 89, 95, 133 και 175 σε συνδυασμό με το άρθρο 300 παράγραφος 2 πρώτο εδάφιο πρώτη πρόταση, την πρόταση της Επιτροπής[1], Εκτιμώντας τα εξής: 3. Σύμφωνα με την απόφαση του Συμβουλίου της 17ης Μαΐου 2004, η Ευρωπαϊκή Επιτροπή διαπραγματεύθηκε συνθήκη για την ίδρυση της Ενεργειακής Κοινότητας με τη Δημοκρατία της Αλβανίας, τη Δημοκρατία της Βουλγαρίας, τη Βοσνία και Ερζεγοβίνη, τη Δημοκρατία της Κροατίας, την πρώην Γιουγκοσλαβική Δημοκρατία της Μακεδονίας, τη Δημοκρατία του Μαυροβουνίου, τη Ρουμανία, τη Δημοκρατία της Σερβίας, τη Δημοκρατία της Τουρκίας, και την αποστολή των Ηνωμένων Εθνών για την προσωρινή διοίκηση του Κοσσυφοπεδίου (σύμφωνα με την απόφαση 1244 του Συμβουλίου Ασφαλείας των Ηνωμένων Εθνών). 4. Με την επιφύλαξη ενδεχόμενης σύναψής της σε μεταγενέστερη ημερομηνία, η συμφωνία που μονογραφήθηκε στις 31 Μαΐου 2005 πρέπει να υπογραφεί, εξ ονόµατος της Ευρωπαϊκής Κοινότητας, ΑΠΟΦΑΣΙΖΕΙ: Άρθρο 1 Ο Πρόεδρος του Συµβουλίου εξουσιοδοτείται να ορίσει το πρόσωπο ή τα πρόσωπα που είναι αρµόδιο(α) να υπογράψει(ουν), εξ ονόµατος της Κοινότητας, τη συνθήκη για την ίδρυση της Ενεργειακής Κοινότητας, με την επιφύλαξη της ενδεχόμενης σύναψής της σε µεταγενέστερη ηµεροµηνία. Άρθρο 2 Η παρούσα απόφαση δημοσιεύεται στην Επίσημη Εφημερίδα της Ευρωπαϊκής Ένωσης . Βρυξέλλες, Για το Συμβούλιο Ο Πρόεδρος 2005/0178 (AVC) Πρόταση ΑΠΟΦΑΣΗΣ ΤΟΥ ΣΥΜΒΟΥΛΙΟΥ περί της σύναψης από την Ευρωπαϊκή Κοινότητα της συνθήκης για την Ενεργειακή Κοινότητα ΤΟ ΣΥΜΒΟΥΛΙΟ ΤΗΣ ΕΥΡΩΠΑΪΚΗΣ ΕΝΩΣΗΣ, Έχοντας υπόψη: τη συνθήκη για την ίδρυση της Ευρωπαϊκής Κοινότητας, και ιδίως το άρθρο 47 παράγραφος 2, τα άρθρα 55, 83, 89, 95, 133 και 175, και το άρθρο 300 παράγραφος 2 πρώτο εδάφιο πρώτη πρόταση σε συνδυασμό με την παράγραφο 3 δεύτερο εδάφιο, την πρόταση της Επιτροπής[2], τη σύμφωνη γνώμη του Ευρωπαϊκού Κοινοβουλίου[3], Εκτιμώντας τα εξής: (1) Σύμφωνα με την απόφαση του Συμβουλίου της 17ης Μαΐου 2004, η Ευρωπαϊκή Επιτροπή διαπραγματεύθηκε συνθήκη για την ίδρυση της Ενεργειακής Κοινότητας με τη Δημοκρατία της Αλβανίας, τη Δημοκρατία της Βουλγαρίας, τη Βοσνία και Ερζεγοβίνη, τη Δημοκρατία της Κροατίας, την πρώην Γιουγκοσλαβική Δημοκρατία της Μακεδονίας, τη Δημοκρατία του Μαυροβουνίου, τη Ρουμανία, τη Δημοκρατία της Σερβίας, τη Δημοκρατία της Τουρκίας, και την αποστολή των Ηνωμένων Εθνών για την προσωρινή διοίκηση του Κοσσυφοπεδίου (σύμφωνα με την απόφαση 1244 του Συμβουλίου Ασφαλείας των Ηνωμένων Εθνών). (2) Στις […], υπογράφηκε εξ ονόματος της Κοινότητας η συνθήκη για την Ενεργειακή Κοινότητα, σύμφωνα με την απόφαση του Συμβουλίου της […]. (3) Στην συνθήκη για την Ενεργειακή Κοινότητα προβλέπεται η δημιουργία ολοκληρωμένης αγοράς φυσικού αερίου και ηλεκτρικής ενέργειας η οποία θα δημιουργήσει σταθερό κανονιστικό και εμπορικό πλαίσιο, ικανό να προσελκύσει επενδύσεις σε δίκτυα φυσικού αερίου, στην ηλεκτροπαραγωγή και σε δίκτυα μεταφοράς, έτσι ώστε όλα τα συμβαλλόμενα μέρη να έχουν πρόσβαση σε σταθερό και συνεχή εφοδιασμό με φυσικό αέριο και ηλεκτρική ενέργεια, στοιχείο σημαντικό για την οικονομική ανάπτυξη και την κοινωνική σταθερότητα. Η συνθήκη καθιστά δυνατή τη συγκρότηση κανονιστικού πλαισίου που θα επιτρέπει την αποτελεσματική λειτουργία των ενεργειακών αγορών στην περιοχή, συμπεριλαμβανομένων ζητημάτων όπως η διαχείριση της συμφόρησης, η διασυνοριακή ροή, οι συναλλαγές ηλεκτρικής ενέργειας και άλλα. Κατά συνέπεια, αποσκοπεί στην προώθηση της υψηλού επιπέδου παροχής φυσικού αερίου και ηλεκτρικής ενέργειας σε όλους τους πολίτες με βάση υποχρεώσεις δημόσιας υπηρεσίας και στην επίτευξη οικονομικής και κοινωνικής προόδου και υψηλού επιπέδου απασχόλησης. (4) To «Θεματολόγιο της Θεσσαλονίκης για τα Δυτικά Βαλκάνια: πορεία προς την ευρωπαϊκή ολοκλήρωση», που εγκρίθηκε από Ευρωπαϊκό Συμβούλιο του Ιουνίου 2003, αποσκοπεί στην περαιτέρω ενίσχυση των σχέσεων μεταξύ της Ευρωπαϊκής Ένωσης και των Δυτικών Βαλκανίων. Με τη δημιουργία ευνοϊκών οικονομικών συνθηκών και την επιβολή της εφαρμογής του σχετικού κοινοτικού κεκτημένου, η συνθήκη για την Ενεργειακή Κοινότητα συμβάλλει στην οικονομική ενσωμάτωση των άλλων συμβαλλομένων μερών της συνθήκης. (5) Η συνθήκη για την Ενεργειακή Κοινότητα βελτιώνει την ασφάλεια του εφοδιασμού των συμβαλλομένων μερών της συνθήκης λόγω της σύνδεσης της Ελλάδας στις αγορές φυσικού αερίου και ηλεκτρικής ενέργειας της ηπειρωτικής Ευρωπαϊκής Ένωσης και με την παροχή κινήτρων για τη σύνδεση των Βαλκανίων στα αποθέματα φυσικού αερίου της Κασπίας, της Βόρειας Αφρικής και της Μέσης Ανατολής. (6) Η συνθήκη για την Ενεργειακή Κοινότητα καθιστά δυνατή την ανάπτυξη ανταγωνισμού σε μεγαλύτερη κλίμακα στην ενεργειακή αγορά και την αξιοποίηση οικονομιών κλίμακας. (7) Η συνθήκη για την Ενεργειακή Κοινότητα βελτιώνει την κατάσταση του περιβάλλοντος όσον αφορά το φυσικό αέριο και την ηλεκτρική ενέργεια και προωθεί την ενεργειακή απόδοση και τις ανανεώσιμες πηγές ενέργειας. (8) Η συνθήκη παρέχει τη δυνατότητα στις ενδιαφερόμενες γειτονικές τρίτες χώρες, συγκεκριμένα στη Μολδαβία, το Βασίλειο της Νορβηγίας και την Ουκρανία, να καταστούν συμβαλλόμενα μέρη ή παρατηρητές στην Ενεργειακή Κοινότητα. (9) Η συνθήκη για την Ενεργειακή Κοινότητα πρέπει επομένως να εγκριθεί. (10) Η Ενεργειακή Κοινότητα έχει αυτονομία λήψης αποφάσεων. Η Ευρωπαϊκή Κοινότητα αντιπροσωπεύεται από δύο αντιπροσώπους στο Συμβούλιο Υπουργών και την Μόνιμη Ομάδα Υψηλού Επιπέδου όπως ορίζεται στη συνθήκη. Πρέπει κατά συνέπεια να προβλεφθούν οι κατάλληλοι κανόνες και διαδικασίες για την οργάνωση της εκπροσώπησης της Ευρωπαϊκής Κοινότητας στο πλαίσιο των θεσμικών οργάνων της Ενεργειακής Κοινότητας, και για τον καθορισμό και τη διατύπωση της θέσης της Ευρωπαϊκής Κοινότητας. (11) Η θέση της Ευρωπαϊκής Κοινότητας σχετικά με αποφάσεις της Ενεργειακής Κοινότητας από τις οποίες απορρέουν ουσιαστικές υποχρεώσεις για την Ευρωπαϊκή Κοινότητα καθορίζεται από το Συμβούλιο σύμφωνα με το άρθρο 300 παράγραφος 2 δεύτερο εδάφιο της Συνθήκης ΕΚ. (12) Τα κράτη μέλη τα οποία αφορά άμεσα ο τίτλος ΙΙΙ πρέπει να διαδραματίζουν καίριο ρόλο για την υλοποίηση των στόχων της Ενεργειακής Κοινότητας. Κατά συνέπεια, είναι αναγκαίο, με την επιφύλαξη των σχετικών διατάξεων της συνθήκης ΕΚ, να επιτευχθεί η δραστήρια συμμετοχή τους στη διαδικασία λήψης αποφάσεων και η πλήρης υποστήριξή τους για τα μέτρα υλοποίησης που θα υιοθετηθούν σύμφωνα με τον τίτλο ΙΙΙ. (13) Είναι σκόπιμο να καθοριστούν κανόνες σχετικά με τις περιπτώσεις που τη θέση της Ευρωπαϊκής Κοινότητας διατυπώνει ο αντιπρόσωπος του Συμβουλίου της Ευρωπαϊκής Ένωσης ή ο αντιπρόσωπος της Ευρωπαϊκής Επιτροπής. (14) Είναι σκόπιμο να καθοριστεί ειδική διαδικασία για την εφαρμογή της ρήτρας εσωτερικής αναθεώρησης που προβλέπεται στο άρθρο 101 σημείο (iii) της συνθήκης, ΑΠΟΦΑΣΙΖΕΙ: Άρθρο 1 (1) Η συνθήκη για την ίδρυση της Ενεργειακής Κοινότητας εγκρίνεται εξ ονόματος της Ευρωπαϊκής Κοινότητας. (2) Το κείμενο της συνθήκης για την Ενεργειακή Κοινότητα επισυνάπτεται στην παρούσα απόφαση. Άρθρο 2 Ο Πρόεδρος του Συμβουλίου εξουσιοδοτείται να ορίσει το πρόσωπο που είναι αρμόδιο να καταθέσει, εξ ονόματος της Ευρωπαϊκής Κοινότητας, την πράξη έγκρισης που προβλέπεται στο άρθρο 1 στον Γενικό Γραμματέα του Συμβουλίου, ως θεματοφύλακα της εν λόγω συνθήκης σύμφωνα με το άρθρο 106, εκφράζοντας τη συναίνεση της Κοινότητας να δεσμευθεί. Άρθρο 3 (1) Την Ευρωπαϊκή Κοινότητα αντιπροσωπεύουν στο Συμβούλιο Υπουργών και τη Μόνιμη Ομάδα Υψηλού Επιπέδου που προβλέπονται στη συνθήκη: (α) αντιπρόσωπος του Συμβουλίου της Ευρωπαϊκής Ένωσης ο οποίος ορίζεται από το κράτος μέλος το οποίο ασκεί την προεδρία του Συμβουλίου της Ευρωπαϊκής Ένωσης· και (β) αντιπρόσωπος που ορίζεται από την Ευρωπαϊκή Επιτροπή. (2) Η Επιτροπή ασκεί την αντιπροεδρία του Ρυθμιστικού Συμβουλίου και της Μόνιμης Ομάδας Υψηλού Επιπέδου. (3) Η Ευρωπαϊκή Επιτροπή αντιπροσωπεύει την Ευρωπαϊκή Κοινότητα στο Ρυθμιστικό Συμβούλιο και το φόρουμ που προβλέπονται στη συνθήκη. Άρθρο 4 (1) Το Συμβούλιο εγκρίνει, με ειδική πλειοψηφία και μετά από πρόταση της Επιτροπής, τις θέσεις της Ευρωπαϊκής Κοινότητας στο πλαίσιο του Συμβουλίου Υπουργών, της Μόνιμης Ομάδας Υψηλού Επιπέδου και του Ρυθμιστικού Συμβουλίου σχετικά με τις οριζόμενες στο άρθρο 76 δεύτερη παράγραφος της συνθήκης αποφάσεις οι οποίες λαμβάνονται από την Ενεργειακή Κοινότητα σύμφωνα με τα άρθρα 82, 84, 91, 92, 96, και 100 της συνθήκης και αφορούν την Ευρωπαϊκή Κοινότητα. (2) Δεν υπερβαίνουν το κοινοτικό κεκτημένο οι θέσεις οι οποίες εγκρίνονται σύμφωνα με την παράγραφο 1 σχετικά με αποφάσεις της Ενεργειακής Κοινότητας που υπάγονται στον τίτλο ΙΙΙ της συνθήκης και είναι εφαρμοστέες στο έδαφος ενός ή περισσοτέρων κρατών μελών. (3) Το Ευρωπαϊκό Κοινοβούλιο ενημερώνεται αμέσως και πλήρως σχετικά με κάθε απόφαση του Συμβουλίου δυνάμει της ανωτέρω παραγράφου 1 που αφορά τον καθορισμό της θέσης της Κοινότητας στο πλαίσιο του Συμβουλίου Υπουργών, της Μόνιμης Ομάδας Υψηλού Επιπέδου και του Ρυθμιστικού Συμβουλίου. (4) Οι θέσεις της Ευρωπαϊκής Κοινότητας στο πλαίσιο των θεσμικών οργάνων της Ενεργειακής Κοινότητας εξασφαλίζουν ότι η Ενεργειακή Κοινότητα δεν λαμβάνει μέτρα που θίγουν την Ευρωπαϊκή Κοινότητα υπό την έννοια ότι αντιβαίνουν το κοινοτικό κεκτημένο, δημιουργούν διακρίσεις μεταξύ των κρατών μελών ή θίγουν την αρμοδιότητα κράτους μέλους της Ευρωπαϊκής Ένωσης όσον αφορά τον καθορισμό των προϋποθέσεων για την αξιοποίηση των ενεργειακών του πόρων, την επιλογή μεταξύ ενεργειακών πηγών και την γενική διάρθρωση του ενεργειακού του εφοδιασμού. (5) Οι θέσεις της Ευρωπαϊκής Κοινότητας στο πλαίσιο του Ρυθμιστικού Συμβουλίου καθορίζονται αφού ζητηθεί η γνώμη της Ευρωπαϊκής Ομάδας Ρυθμιστικών Αρχών για την Ηλεκτρική Ενέργεια και το Φυσικό Αέριο (ERGEG) σύμφωνα με την απόφαση της Επιτροπής, της 11ης Νοεμβρίου 2003, σχετικά με τη σύσταση ευρωπαϊκής ομάδας ρυθμιστικών αρχών για την ηλεκτρική ενέργεια και το φυσικό αέριο (2003/796/ΕΚ). CHARACTERISTICS AND OBJECTIVES Details of the context of the proposal are required in the Explanatory Memorandum. Need to be met in the short or long term The creation of the Energy Community by means of a binding treaty is a major initiative of the European Commission to prepare a smooth transition of pre-accession candidate countries having in mind a sectoral approach. It is an initiative of EC accession and neighbourhood policy, however limited to the energy sector. The aim is to bring the signatory countries to comply with European standards and specific provisions of the acquis communautaire. In that respect it is essential to guide the process intensively in the short as well as in the longer term (2007-2013) to ensure the respect of the compliance with commitments agreed and the safeguard of the European Community’s interests. 18. Value-added of Community involvement and coherence of the proposal with other financial instruments and possible synergy The Community – and the Commission as the guardian of the Treaties and the arbiter of compliance with the acquis communautaire - involvement is a condition sine qua non and not only contributes to stabilising the region but also to enhance the European Community’s possibility to secure security of supply on energy resources. Coherence with other financial instruments and possible synergies: The new Institutions can better co-ordinate the needs of the region with respect to energy. The Institutions have a detailed regional overview and a co-ordination role on all Donor’s activities in that area, raising thus synergies and avoiding overlaps. 19. Objectives, expected results and related indicators of the proposal in the context of the ABM framework Objectives: - to establish a stable and reliable energy supply which is a precondition to economic growth in that area - to ensuring EU access to gas resources in Middle East and the Caspian Area, enhancing diversity of supply and security of supply - to increase environmental standards to EU acquis provisions - to introduce sectoral provisions of the acquis communautaire and to create a larger single European energy market - to foster investment climate and reduce regulatory risk in the area Operational objectives (cost allocation to activities): - to run the institutions effectuating the tasks attributed to them by the Treaty and indicatively depicted in the details’ section below - to organise and co-fund/reimburse larger meetings as the PHLG (Permanent High level group meetings), the Ministerial, the Fora (electricity and gas) if so decided under the Treaty provisions Details: 1. The ENERGY COMMUNITY process 1.1. The Energy Community Process The project of the creation of the Energy Community in South East Europe is a major step of European Union foreign policy with respect to the EC neighbouring countries. It is the first initiative where the European Union takes a sectoral approach to questions of trade and environment, to assist applying EU standards with a view to possible future accession. A stable and reliable energy supply is an important precondition for economic growth and prosperity. This process, which already accomplished significant achievements with the signing of the Athens Memoranda 2002 and 2003 as well as the Tirana Declaration, was endorsed by the European Council by granting a negotiating directive to the European Commission with a view of establishing a binding treaty with the countries of the region. The treaty has been initialled recently and is likely to be signed in mid 2005. This includes the CARDS countries (Albania, Bosnia & Herzegovina, Croatia, the FYROM, Serbia and Montenegro, the UNMIK) and the energy-wise linked neighbouring countries of Bulgaria, Romania and Turkey [NOTE: Turkey participation unclear]. Several institutions will be established by the Treaty (which are already in place from the stipulations of the Athens Memoranda), shadowing the institutions of the European Union as can be seen in the following graph: [pic] 1.1.1. The ENERGY COMMUNITY Secretariat The purpose of the ENERGY COMMUNITY Secretariat is to assist the European Commission in its tasks to assure the ENERGY COMMUNITY process co-ordination on a daily basis and to serve as a monitoring institution. To avoid any unclear interpretation of the purpose, the activity of the ENERGY COMMUNITY Secretariat does under no circumstances intervene with the task of the Commission to act as “the secretariat” to the institutions stipulated in the Memoranda and the draft treaty. 1.1.2. Overview - The tasks of the ENERGY COMMUNITY Secretariat The tasks of the ENERGY COMMUNITY Secretariat stem from the obligations of the EC with respect to the stipulations of the Athens Memoranda (MOU) 2002 & 2003, the Tirana Declaration and the negotiating directive of the Council. In that sense and reflecting the negotiating directive of the Council as well as the initialled treaty, it is clear that the EC has substantive control over the work of the Secretariat. The detailed tasks follow the Annexe 2 of the EC ENERGY COMMUNITY strategy discussion paper, issued at the Athens Energy Week in June 2004. It is clear that when the treaty enters into force, the definitions and tasks therein and to be confirmed by procedural act under the terms of the Treaty itself are the base of work for the Secretariat. 1.1.2.1. The ENERGY COMMUNITY Secretariat Structure Given the work load attributed to the Secretariat and the estimated time necessary for the accomplishment of the aim of creating an Energy Community in South East Europe in line with the relevant provisions of the acquis communautaire, it is envisaged to set up a permanent structure, embracing the specific advantages of local know how and geographic synergies. In the period until the end of 2006, an interim Secretariat has been established in Vienna, the major part of which is funded under EC CARDS provisions. Being an interim Secretariat, the structure and budget are limited to set-up the process and to prepare for the entry into force of the treaty. Thereafter, it is envisaged to build up the Secretariat as well as other institutions to cope with its tasks as currently envisaged in the Treaty. The budget plan runs from 2007 to 2013. The likely duration of the treaty is until 2016, with a possible extension. The specific budget plan for 2014-16 will be presented in time and according to the exigencies then needed. The chart below demonstrates a possible structure of the Secretariat: [pic] To realise efficient cost management all tasks attributed to the Secretariat or any other Institution of the Treaty are administered via the Secretariat. The Secretariat re-distributes funds when entitled to do so. The financial auditing of the whole process can be assured and double or triple overhead costs avoided. Some funds might be attributed to staff which will work most of the time on other locations than the Secretariat, supporting other Institutions mainly for administrative purposes. 1.2. Some assumptions for the Institutions in the ENERGY COMMUNITY process, other than the Secretariat 1.2.1. Ministerial The ministerial is the decision making body of the process. It entitles other institutions to act. The venue of the Ministerial meetings will rotate. It is funded by the host, some co-funding is included in the forecast. 1.2.2. Permanent High Level Group The Permanent High level group shadows the work of the Council Energy Working Group and gives guidance within their competence given by the ministerial. The PHLG organisation is co-funded. 1.2.3. Regulatory Board The Regulatory Board might have secretarial services at its disposal. The Funds are dispatched via the Secretariat accounting system. 1.2.4. Regulatory Forum Electricity The Regulatory Forum Electricity shadows the Florence Forum process. Roughly 50.000 € per year are foreseen from 2007 onwards (indexed) 1.2.5. Regulatory Forum Gas The Regulatory Forum Gas shadows the Madrid Forum process. Roughly 50.000 € per year are foreseen from 2007 onwards (indexed) 2. Assist other Donors with respect to infrastructure investment funding activities Prepare the project dossiers following an agreed methodology and in line with the donors’ specific programs’ rules and procedures. Transparency of activities is a key requisite for the institutions’ acceptance. The European Commission monitors progress ultimately itself with adequate internal measures. Auditing is done twice, once on behalf of the Institutions, once on behalf of the European Commission independently. 22. Evaluation 23.
