Generally the date of cessation of presumption of conformity will be the date of withdrawal (‘dow’), set by the European Standardisation Organisation, but attention of users of these standards is drawn to the fact that in certain exceptional cases this can be otherwise.

Note 3

In case of amendments, the referenced standard is EN CCCCC:YYYY, its previous amendments, if any, and the new, quoted amendment. The superseded standard (column 3) therefore consists of EN CCCCC:YYYY and its previous amendments, if any, but without the new quoted amendment. On the date stated, the superseded standard ceases to give presumption of conformity with the essential requirements of the directive.

NOTE:

Any information concerning the availability of the standards can be obtained either from the European Standardisation Organisations or from the national standardisation bodies of which the list is annexed to Directive 98/34/EC (2) of the European Parliament and Council amended by Directive 98/48/EC (3).

4.1.   Name: Exairetiko partheno elaiolado ‘Troizinia’

4.2.   Description: Extra virgin olive oil produced either exclusively from the Manaki variety or in association with no more than 50 % of the Koroneiki variety.

Organoleptic characteristics:

Colour: yellow to yellowish green, depending on the degree of ripeness of the fruit when harvested.

flavour: has a pleasant taste with a sweet or bitter basis (over several months the bitterness steadily abates), and

aroma: newly picked fruit predominates.

4.3.   Geographical area: The area is delimited by the boundaries of the Trizinia area, in which the olives are grown and the oil prepared, which comprises the municipalities of:

4.4.   Proof of origin: Production, processing, packing and bottling are all carried out in the defined area. The growers register their olive groves in a register which is kept up to date. Processing and bottling facilities are also recorded in special registers. These registers are kept and updated by the Rural Development Directorate and the quantity of olives processed and the amount of olive oil produced are announced each year. In this way, all the stakeholders involved are recorded in the special registers and closely supervised to ensure that they fulfil their obligations, thereby ensuring the traceability of the product.

4.5   Method of production:

(a)   Cultivation techniques

The soil is worked mechanically but no herbicide is used.

25 % of the trees are watered using a hose or a trickle or sprinkler system.

Suitable pruning, water and fertilizer application leads to roughly the same yield from each tree every year.

Fertiliser provision and plant protection are carried out using mild methods compatible with the environment (organic fertilizers, suspended olive fly traps, bait spraying, etc.).

(b)   Harvesting

Almost all the fruit is harvested when its colour changes from green to dark violet. Harvesting extends from November (fruits slightly unripe) to February with the bulk in December and January. The fruit is not left to over-ripen on the tree, which would result in a loss in its weight and bulk, a poorer aroma and higher acidity of the oil.

Harvesting is traditionally carried out using rakes alone or by hand, which is beneficial for the quality of the product and good for the health of the olive trees.

(c)   Collection/storage

The picked fruit is immediately ‘bagged’ in sacks made of plant fibres (jute), which facilitates aeration, and taken to the mill on the same day. On the rare occasions when it has to be stored for 24 hours the sacks are placed on pallets in roofed areas where they are well ventilated but protected from sun and rain.

(d)   Extraction

The procedure followed is: reception, feeding, deleafing, watering, breaking, grinding, kneading, reception of oil from paste, final separation.

All the appropriate rules are complied with on cleanliness, kneading speed (17–19 rev/min), kneading time (20-30 min.) and above all temperature, which must in no case exceed 28–29 °C.

(e)   Packaging

Before being sent to the market and the final consumer, the oil is stored in stainless tanks and then packaged in 5 litre tins and dark-coloured bottles of 0,1 to 1 litre.

Packaging of the end product takes place only in the geographical area, to protect quality, ensure that the end product can be inspected, of course after taking account of the economic parameters and benefits of having the final packaging done in the region.

Lastly, it is considered both necessary and right that all activity take place within the geographical area, to ensure protection of the name and guarantee the quality and authenticity of the product.

4.6.   Link: The exceptional quality of the area's oil is due largely to its particular soil and weather conditions, the cultivation techniques used, method and time of cropping, and processing and packaging using traditional or modern methods that are technically and scientifically sound.

Its mountain and hill terrain, (favouring unusually intense illumination and ventilation of the trees, well known determinants for outstanding quality), moderate rainfall (about 550 mm), mild spring, relatively dry and warm summer (during which however a beneficial 15 % of total annual rainfall occurs), high level of sunshine and moderately strong north winds, conduce to production of an oil that is of a rich colour and pleasing delicate flavour. A slightly chalky soil of neutral or slightly alkaline pH and generally high concentrations of phosphorus, potassium, boron etc. are very important for production of an oil that is naturally translucent and rich in aromatic substances.

4.1   Name: ‘AZEITE DO ALENTEJO INTERIOR’

4.2   Description: Virgin and extra virgin olive oil extracted mechanically from fruit of the Galega Vulgar (minimum 60 %), Cordovil de Serpa and/or Cobrançosa (maximum 40 %) varieties belonging to the species Olea europea sativa Hoffg. Other varieties, except for Picual and Maçanilha, may be used (to a maximum of 5 %). The oil is golden yellow or greenish yellow in colour, with a delicate fruity aroma of mature and/or green olives and other fruits, notably apple and/or figs. It has a sweet flavour. ‘Panel Test’ score — min. 6.5. Chemical features: Absorbency K232 — max. 2.40, K270 — max. 0.20 and Delta K — max. 0.00. 4.3   Geographical area: The geographical preparation, production and processing area is part of the ‘heart’ of the Alentejo region, known as Alentejo Interior and is naturally limited to the municipalities of Portel, Vidigueira, Cuba, Alvito, Viana do Alentejo, Ferreira do Alentejo and Beja plus the freguesias of Aljustrel, S. João de Negrilhos and Ervidel in the municipality of Aljustrel; Entradas in the municipality of Castro Verde; Alcaria Ruiva in the municipality of Mértola and Torrão in the municipality of Alcácer do Sal.

4.4   Proof of origin: As well as the product's characteristics, a product traceability system has been put in place. The farms and production and processing plants must be registered and approved by the Producer Group after consulting the inspection body. They must be located in the afore-mentioned geographical area. The entire production process, from the farm which produces the raw materials to the place where the product is sold, is subject to a control system to ensure full compliance with all farming, transport, production and processing practices.

The use of the PDO is only allowed on the packaging of virgin and extra virgin olive oil which has the specific analytic characteristics described above, and whose production process has been subject to control.

A numbered certification mark allows full traceability of the product to the farm. It is possible to ascertain the product's origin at any point in the production chain.

4.5   Method of production: The olives sourced from the registered olive groves, with the afore-mentioned varieties and percentages, are harvested when ripe and separated from other types. They are transported to production plants, where they are subjected to selection, washing, milling, crushing and kneading or centrifugation. Once the oil obtained has been decanted, it is stored in containers, before it is packed. All Good Practice requirements for obtaining olive oil are adhered to, notably in terms of plant protection products used to control pests, harvesting rules, the transportation method and time from the place of harvest to the mill, storage of the olives at the mills, the maximum time between the harvesting and the milling and crushing of the paste. The use of second pressing techniques is prohibited, as is the use of enzymes and talc. Virgin and extra virgin olive oil are packaged in suitable containers and appropriately labelled. All the operations described above are carried out in the geographical area because since the oil is miscible, it is impossible to carry out any alteration or separation at a later stage. This is the most appropriate way to carry out checks and ensure the traceability of the product, thus assuring the consumer of the product's origin and authenticity.

4.6   Link: The production of olive oil is intimately linked to the Alentejo Interior. The climate and soil conditions in this region are suitable to growing olive trees and producing olives adapted to the production of virgin and extra virgin olive oil. As a result, over the years, the most suitable varieties have been chosen, thus eliminating those varieties which produced different tastes and aromas to the fruity olives typical of the region, where good practices are adhered to. As well as the historic and socio-cultural link between the product and the region which can be seen in numerous monuments (some dating back to Roman times), popular songs, specially designed buildings, regional place names, gastronomy, surnames, bibliographic references and studies, olive oil from the Alentejo Interior contains a distinctive chemical and organoleptic profile which is different to that of other olive oils. Although the olive types used are not exclusive to the region, the percentage composition of the olive grove varieties and the ecosystem are essential to obtain oil with the afore-mentioned characteristics.

4.   Specification

4.1   Name: ‘PAIO DE BEJA’

4.2   Description: lightly oak-smoked sausage, made from the meat and hard fats obtained from cuts of meat from the carcasses of the Alentejana breed of pig. Salt, ground pepper, crushed dried garlic, caraway, paprika and pepper are added to the pieces of meat and fat. The casing used is naturally salted hog casing. It is a large sausage, which has a straight cylindrical section, measuring between 12 and 20 cm in length and between 6 and 15 cm in diameter. It has a bright and slightly rough exterior, and is reddish and white in colour, and has a slightly firm to firm consistency. It is tightened by twisting it, and tied with cotton twine at both ends. When the sausage is cut, the meat looks reddish to pink with white specks and the stuffing appears perfectly homogenous. The fat is pearly, shiny, aromatic, and has a pleasant taste. The sausage has a pleasant, mild, lightly salted and sometimes slightly spicy taste. It has a pleasant, slightly smoky aroma.

4.3   Geographical area: The geographical production area for raw materials which are used in the preparation of the Paio de Beja shall remain limited to the municipalities of Abrantes, Alandroal, Alcácer do Sal (except the freguesia of Santa Maria do Castelo), Alcoutim, Aljezur (the freguesias of Odeceixe, Bordeira, Rogil and Aljezur), Aljustrel, Almodôvar, Alter do Chão, Alvito, Arraiolos, Arronches, Avis, Barrancos, Beja, Borba, Campo Maior, Castelo Branco, Castelo de Vide, Castro Marim (the freguesias of Odeleite and Azinhal), Castro Verde, Chamusca, Coruche, Crato, Cuba, Elvas (except the freguesia of Caia and S. Pedro), Estremoz, Évora, Ferreira do Alentejo, Fronteira, Gavião, Grândola (except the freguesia of Melides), Idanha-a-Nova, Lagos (the freguesia of Bensafrim), Loulé (the freguesias of Ameixial, Salir, Alte, Benafim and Querença), Marvão. Mértola, Monchique (the freguesias of Monchique, Marmelete amd Alferce), Monforte, Montemor-o-Novo, Mora, Moura, Mourão, Nisa, Odemira (except the freguesias of Vila Nova de Mil Fontes and S. Given the particular weather conditions, the local production methods employed and the product's organoleptic characteristics, the geographical area where the sausage is processed, matured, cut and packaged is confined to the municipality of Beja.

4.4   Proof of origin: Paio de Beja may only be produced in duly licensed processing plants, located in the geographical area where the sausage is processed and authorised by the Group. The raw material comes from Alentejano pigs on livestock farms with oak groves compatible with extensive or semi-extensive farming systems, as the animals are usually reared outdoors. The animals are registered as Alentejano pigs in the herd-book. Both the slaughtering of the pigs, and the recovery of meat may be carried out in licensed plants within the geographical area where the sausage is processed. Agricultural farms, slaughterhouses, cutting plants and production plants of Paio de Beja are duly registered in the Group, and are subject to independent control. This system allows full traceability of the product, enabling random checks to be carried out to determine the product's origin, from the agricultural farm to each piece sold. Each piece shall always bear a numbered certification mark.

4.5   Method of production: Obtained from cuts of meat from the loin, leg and shoulder and fat from Alentejano pigs, which are minced either mechanically or manually. The proportion of lean meat content shall be 70-90 % and the proportion of fat content shall be 10-30 %. Once the meat has been minced, it is mixed in a container with the fat and seasoning, which has been previously diluted in water, which is a typical characteristic of this region. The mass is left for 1 to 2 days in a refrigeration room where the temperature does not exceed 10o C and the humidity level is approximately 80/90 %. The mixture is then put into the hog casings which have been preserved in brine, ensuring that the sausages are tightly filled and tied. Once the sausages have been stuffed they are smoked. This process lasts a minimum of 3 days and a maximum of 12 days, (5 to 10 days in summer and 8 to 12 days in winter). The sausage is placed on the market as a whole sausage, or in pieces or slices, and is always pre-packed at the place of origin. Special material, which is innocuous and inert when it comes into contact with the product, is used for its packaging. The product may be packed in a normal or controlled atmosphere or in a vacuum. Cutting and packing can only be carried out in the geographical processing. area so as to ensure traceability and control and to prevent any change to the product's taste and microbiological characteristics

4.6   Link: Human consumption of pork meat has been found in remains in the Baixo Alentejo region dating back to the Bronze Age, principally next to dolmens and other megalithic monuments. The consumption of this meat is also reported in the region in the 4th century B.C., during the period of Celtic rule. These peoples made an important contribution to the diversification of the eating habits of the Baixo Alentejo region. Later, the consumption of pork meat increased following the Roman tradition, when the region was ruled by the Romans. These colonisers encountered innovative culinary techniques: the pigs were fed acorns and local aromatic plants were used in the production of food. The first millennium A.D. is marked by the arrival of Muslim invaders. However, the rules of the Koran did not have any influence on local customs. The main legacy of this period is the use of spices in local cooking. Throughout the ages there are numerous references to pigs being fed acorns from oak groves. This was the most consumed type of meat in the region, either fresh or preserved. The animals lived in extensive farms, and sometimes in community pigsties called ‘adúas’, which until recently could still be found in the Alentejo region. Thus, pork has always had a unique place in Alentejo regional cuisine, from ancient times up to the present day. The art of sausage making, of which the Paio de Beja is an important product, developed as a result of the need to preserve pork meat throughout the year. In conclusion, 3 basic elements link the Paio de Beja to the region: the meat used comes from a breed of animal peculiar to the region; this animal is reared on oak groves in the region; the meat has a specific flavour, with seasoning and sensory characteristics and a unique appearance which differs from other sausage meat products from the Alentejo region.

On 22 May 2006 the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Merill Lynch L.P. Holdings, Inc (‘MLLPHI’, USA), controlled by Merill Lynch & Co., Inc., Cabana Investors B.V. (‘Farallon’, USA), part of the Farallon Group and Barceló Corporación Empresarial, S.A. (‘Barceló’, Spain), belonging to the group Barceló, acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of the undertaking Playa Hotels & Resorts, S.L. (‘Playa’, Spain) by way of purchase of shares.

The business activities of the undertakings concerned are:

for MLLPHI: investment bank and advisor to corporations, governments, institutions and individuals worldwide. Management of financial assets;

On 23 May 2006, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Huntsman International LLC (‘Huntsman’, United States) and Huntsman Germany GmbH (‘Huntsman Germany’, Germany) acquire within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of Textile Effects Business of Ciba Specialty Chemicals Holding Inc (‘Ciba’, Switzerland) by way of purchase of shares and purchase of assets.

The business activities of the undertakings concerned are:

Huntsman: development, production and distribution of a wide variety of chemical products;

Ciba: development and production of specialty chemicals to the textile industry.

On 23 May 2006 the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which DSG International plc (‘DSGI’, UK) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of Fotovista S. A. (‘Fotovista’, France) by way of purchase of securities.

2.

The business activities of the undertakings concerned are:

DSGI: retailing of electrical consumer goods;

Fotovista: retailing of electrical consumer goods.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

1.   INTRODUCTION

Pursuant to Article 4(1)(a) of Council Regulation (EEC) No 2408/92 of 23 July 1992 on access for Community air carriers to intra-Community air routes (http://europa.eu.int/eur-lex/lex/LexUriServ/LexUriServ.do?uri=CELEX:31992R2408:EN:HTML), Iceland has decided to continue imposing public service obligations in respect of scheduled air services as of 1 January 2007 on the following routes:

2.   THE PUBLIC SERVICE OBLIGATIONS INCLUDE THE FOLLOWING

2.1.   Minimum frequencies, seating capacity, routing and timetables

The requirements apply throughout the operating period from 1 January 2007 to 31 December 2009 (3 years).

Reykjavík-Gjögur-Reykjavík: 2 roundtrips every week

Reykjavík-Bíldudalur-Reykjavík: 6 roundtrips every week

Reykjavík-Sauðárkrókur-Reykjavík: 5 roundtrips every week

Aureyri-Grímsey-Akureyri: 3 roundtrips every week

Akureyri-Vopnafjörður-Þórshöfn-Akureyri: 5 roundtrips every week

Reykjavík-Höfn-Reykjavík: 7 roundtrips every week

Routing

The required services shall be non-stop.

Timetable

Reykjavík-Gjögur-Reykjavík: Departure from Reykjavík at 09:00 or later. Arrival to Reykjavík no later than 17:00.

Reykjavík-Bíldudalur-Reykjavík: Departure from Reykjavík kl. 09:00 or later. Arrival to Reykjavík no later than 19:00.

Reykjavík-Sauðárkrókur-Reykjavík: Departure from Reykjavík 08:00 or later. Arrival to Reykjavík no later than 19:00.

Akureyri-Grímsey-Akureyri: Departure from Akureyri 09:00 or later. Arrival to Akureyri no later than 17:00.

Akureyri-Vopnafjörður-Þórshöfn-Akureyri: Departure from Akureyri 09:00 or later. Arrival to Akureyri no later than 17:00.

Reykjavík-Höfn-Reykjavík: Departure from Reykjavík 08:00 or later. Arrival to Reykjavík no later than 18:00.

Seating capacity

Reykjavík-Gjögur-Reykjavík: In both directions at least 9 seats shall be offered for each trip.

Reykjavík-Bíldudalur-Reykjavík: In both directions at least 9 seats shall be offered for each trip.

Reykjavík-Sauðárkrókur-Reykjavík: In both directions at least 15 seats shall be offered for each trip.

Akureyri-Grímsey-Akureyri: In both directions at least 9 seats shall be offered for each trip during the period 1 September — 30 April. In both directions at least 15 seats shall be offered for each trip during the period of 1 May — 31 August.

Akureyri-Vopnafjörður-Þórshöfn-Akureyri: In both directions at least 9 seats shall be offered for each trip during the period 1 September — 30 April. In both directions at least 15 seats shall be offered for each trip during the period of 1 May — 31 August.

Reykjavík-Höfn-Reykjavík: In both directions at least 15 seats shall be offered for each trip.

2.2.   Aircraft category

Reykjavík-Gjögur-Reykjavík: Multi engine turboprop aircraft registered for minimum 9 passengers and 600 kg freight shall be used for the required flights during the period of 1 November till 31 May. Multi engine turboprop aircraft registered for minimum 9 passengers and 200 kg freight shall be used for the required flights during the period of 1 June till 31 October.

Reykjavík-Bíldudalur-Reykjavík: Multi engine turboprop aircraft registered for minimum 9 passengers shall be used for the required flights.

Reykjavík-Sauðárkrókur-Reykjavík: Multi engine turboprop aircraft registered for minimum 15 passengers shall be used for the required flights.

Akureyri-Grímsey-Akureyri: Multi engine turboprop aircraft registered for minimum 9 passengers shall be used for the required flights during the period of 1 September — 30 April. Multi engine turboprop aircraft registered for minimum 15 passengers shall be used for the required flights during the period 1 May — 31 August.

Akureyri-Vopnafjörður-Þórshöfn-Akureyri: Multi engine turboprop aircraft registered for minimum 9 passengers shall be used for the required flights during the period of 1 September — 30 April. Multi engine turboprop aircraft registered for minimum 15 passengers shall be used for the required flights during the period 1 May — 31 August.

Reykjavík-Höfn-Reykjavík: Multi engine turboprop aircraft registered for minimum 15 passengers shall be used for the required flights.

Carriers attention is especially drawn to technical and operative conditions applying at the airports.

2.3.   Fares

Maximum basic one-way fare (fully flexible) excluding airport tax and insurance premium may not exceed following prices (price index January 2006):

2.4.   Freight rates

Reykjavík-Gjögur-Reykjavík: The service fee per freight shall not exceed ISK 680 excl. VAT and price charged per kg shall not exceed ISK 19 excl. VAT during the period 1 November — 31 May (price level January 2006).

2.5.   Service continuity

The number of flight cancelled for reasons directly attributable to the carrier must not exceed 4 % of the intended number of flights on an annual basis.

Fares

All connecting fares to/from other air services shall be offered on equal terms for all carriers. Exempted from this are connecting fares to/from other services carried out by the tenderer, provided that the fare is maximum 40 % of the fully flexible fare.

Transfer conditions

All conditions set out by the carrier for the transfer of passenger to and from other carriers routes, including connecting times and through check-in of tickets and baggage, shall be objective and non-discriminatory.

EU-US Cooperation in Higher Education and Vocational Training

ATLANTIS Programme

(Actions for Transatlantic Links and Academic Networks in Training and Integrated Studies)

1.   Objectives and description

The general objective of the call for proposals is to promote better understanding and interaction between the peoples of the EU Member States and of the US, including a broader knowledge of their languages, cultures and institutions, and to improve the quality of higher education and vocational education and training in the EU and in US. There two types of action under this call:

Transatlantic Degree Consortia Projects

This Action provides support for consortia of EU and US higher education institutions (hereafter called ‘consortium’) to implement dual/double or joint degree programmes referred to in the present document as ‘Transatlantic Degrees.’ Support may include mobility grants for students and members of the academic teaching staff (‘faculty’).

Policy-oriented measures

This Action provides support to multilateral EU-US projects and activities designed to enhance collaboration in the higher education and vocational training field.

2.   Eligible applicants

Submission of grant requests under this call is open to higher education institutions and to vocational education and training institutions. For Policy Oriented Measures, the call is also open to other organisations such as accreditation agencies, education agencies or organisations, private companies, industry and business groups, non-governmental organisations, research institutes and professional bodies. Eligible applicants must be established in one of the 25 countries of the European Union.

3.   Budget and project duration

The budget available for the co-financing of projects is estimated at 4 million Euros the majority of which will be devoted to Transatlantic Degree Consortia Projects.

It is anticipated that approximately five degree implementation projects and a small number of policy-oriented measures projects will be funded in 2006.

The maximum amount of funding on the EU side will be EUR 696 000 for a 4-year Transatlantic Degree consortia project and EUR 50 000 for a 2-year Policy Oriented Measure. Projects activities are planned to start in November 2006. The duration for Transatlantic Degree Consortia Project is 48 months and for Policy Oriented Measure 24 months.

Applications must be sent to the Commission no later than 7 July 2006.

1.   Introduction: Pursuant to Article 4(1)(a) of Council Regulation (EEC) No 2408/92 of 23.7.1992 on access for Community air carriers to intra-Community air routes (http://europa.eu.int/eur-lex/en/lif/dat/en_392R2408.html), Iceland has decided to continue imposing public service obligations in respect of scheduled air services as of 1.1.2007 on the following routes, as published on 1.6.2006 in the Official Journal of the European Union C 128 and the EEA supplement No 27, 1.6.2006:

If no air carrier has informed the Ministry of Communications in Iceland that it has commenced, or is about to commence, scheduled air services 4 weeks before the intended coming into force of the contract on the said routes, effective as of 1.1.2007, in conformity with the public service obligation imposed on the routes mentioned above, without requesting financial compensation or market protection, Iceland has decided, under the procedure provided for by Article 4(1)(d) of the same Regulation, to limit access to only 1 air carrier on each route and following an invitation to tender, to grant the right to operate the routes for 3 years with effect from 1.1.2007.

2.   Objective of the invitation to tender: The objective of the tender is to provide, with effect from 1.1.2007, scheduled air services on the following routes:

in accordance with the imposed public service obligations, as published in the Official Journal of the European Union C 128, 1.6.2006.

3.   Eligibility to tender: All air carriers holding a valid operating licence pursuant to Council Regulation (EEC) No 2407/92 of 23.7.1992 on the licensing of air carriers are eligible to tender (http://europa.eu.int/eur-lex/lex/LexUriServ/LexUriServ.do?uri=CELEX:31992R2407:EN:HTML ).

4.   Tender procedure: This invitation to tender is subject to the provisions of subparagraphs (d) - (i) of Article 4(1) of Council Regulation (EEC) No 2408/92.

The State Trading Centre, acting on behalf of the Public Road Administration, reserves the right to reject all tenders. Overdue tenders and tenders not in conformity with this invitation to tender will be rejected.

The State Trading Centre, acting on behalf of the Public Roads Administration, reserves the right to apply subsequent negotiations if all tenders submitted are incorrect, or, if after the final date for receipt of tenders, there proves to be only 1 tenderer or no tender. Such negotiations shall be in accordance with the public service obligations imposed and without making substantial changes in the original tender conditions.

The tenders can tender for all routes, or just routes nr 1 and 2, or only route nr 3, or routes nr 4 and 5, or only route nr 6.

The tenders shall be made in Icelandic or English.

The tender is binding on the tenderer until the award is made. However, the tender will remain valid until no later than 12 weeks from the opening of tenders.

5.   Award: The award will be made to the tender requiring the lowest amount of compensation for the period 1.1.2007 to 31.12.2009.

6.   Tender file: The full file for the invitation to tender, containing the imposition of public service obligations, the specific rules to the invitation to tender (Icelandic Act No 65/1993 on the implementation of invitation to tender in connection with public service obligations to implement Council Regulation (EEC) No 2408/92, Article 4), may be obtained from:

7.   Financial compensation: The tenders shall specify the compensation in Icelandic crones (ISK) required for 1 round trip of each routes nr 1, 2, 3, 4, 5, and 6, in conformity with compensation required for operation of the service in question for 3 years from the scheduled starting date, 1.1.2007. The tenders shall be based on the price level on the opening day of the tenders. Also required is an operating budget for a 12-month period. This information shall be set out in a format included in the tender file, along with the information required in the tender file.

Price adjustment:

All amounts of compensation will be based on the price level on opening day of tenders.

The amount of compensation required for each roundtrip on opening day of tenders will be adjusted 1.1.2007 and the adjusted amount of compensation will be valid for the period 1.1.2007 – 31.12.2007. The amount of compensation for the periods 1.1.2008 – 31.12.2008 and 1.1.2009 – 31.12.2009 will be adjusted at the beginning of the period. The adjustment will be in accordance with the following index:

1 % change in fuel price, JET A-1, change in the amount of compensation of 0,2 %.

1 % change in consumer price index, change in the amount of compensation of 0,8 %.

The operator can ask for revision of ticket prices and freight rates according to changes in the above index, but no more frequently than every 6 months.

The operator shall retain all revenue generated by the service and is fully responsible for the expenses, however, re-negotiation in accordance with the standard contract may apply in case of substantial and unforeseeable changes in the assumptions underlying it.

8.   Fares and freight rates: The tenders submitted shall specify the fares and freight rates and the conditions there to. The fares shall be in accordance with the public service obligations published in the Official Journal of the European Union C 128, 1.6.2006.

9.   Duration, amendment and termination of the contract: The contract shall start on 1.1.2007 and end on 31.12.2009.

A review of implementation of the contract shall be carried out in concert with the carrier during the 6 weeks following the end of the contract period.

The contract may not be modified unless the changes are in accordance with the public service obligations. Any modification of the contract shall be recorded in an annex thereto.

The carrier may terminate the contract only after a 6-month period of notice.

10.   Breach of contract/cancellation: In the event of substantial breach of the contract by 1 party, it may be cancelled with immediate effect by the other party.

The air carrier shall carry out all the obligations of the contract according to the public service obligations published in the Official Journal of the European Union C 128, 1.6.2006 and the tender file. In the event of non-performance of such obligations, The Icelandic Road Administration may discontinue payments corresponding to the non-performance.

The Icelandic Road Administration may cancel the contract with immediate effect, in the event of substantial breach of the contract or in the event of the insolvency or bankruptcy of the carrier.

The Icelandic Road Administration may cancel the contract with immediate effect if the operator has his licence revoked or it is not renewed.

Independent of any action for damages, any discontinuation of contracted services which can be attributed directly to the operator shall lead to a reduction in the amount of financial compensation in accordance with the number of flights cancelled if the number of cancelled flights exceeds 4 % of planned numbers of flights.

11.   Airline codes: The flights cannot carry any airline codes other than the tenderer's own and cannot be part of any code-sharing agreement.

12.   Submission of tenders: Tenders must be sent by registered post with acknowledgement of receipt, in which case the postmark will be accepted as proof of submission, or delivered by hand to the State Trading Centre, not later than 6.7.2006 (14:00), where they will be opened in the presence of those tenderers requesting to be present 6.7.2006 (14:00). Tenders submitted later than 6.7.2006 (14:00) will not be opened.

The tenders submitted must be contained in a sealed envelope addressed as follows:

13.   Validity of the invitation to tender: This invitation to tender shall be valid only to the extent that no EEA carrier (EEA carrier means a Community air carrier or an air carrier with a valid operating license granted by an EFTA State, party to the EEA Agreement, in accordance with the Act referred to in point 66b in Annex XIII of the EEA Agreement (Council Regulation (EEC) No 2407/92 on licensing of air carriers)) informs the Ministry of Communications, 4 weeks or more before the intended entry of force of the contract, that it will commence scheduled flights according to the public service obligations on any of the air routes without requiring any financial support or market protection.
