The Commission draws attention to the judgment delivered on 30 April 1996 in the ‘CIA Security’ case (C-194/94, ECR I-2201), in which the Court of Justice ruled that Articles 8 and 9 of Directive 98/34/EC (formerly 83/189/EEC) are to be interpreted as meaning that individuals may rely on them before national courts which must decline to apply a national technical regulation which has not been notified in accordance with the Directive.

This judgment confirms the Commission's communication of 1 October 1986 (OJ C 245, 1.10.1986, p. 4).

Accordingly, breach of the obligation to notify renders the technical regulations concerned inapplicable, and consequently unenforceable against individuals.

Non-opposition to a notified concentration

(Case No COMP/M.3354 — SANOFI-SYNTHELABO/AVENTIS)

On 26 April 2004, the Commission decided not to oppose the above notified concentration and to declare it compatible with the common market. This decision is based on Article 6(1)(b) of Council Regulation (EEC) No 4064/89. The full text of the decision is available only in French and will be made public after it is cleared of any business secrets it may contain. It will be available:

CALL FOR APPLICATIONS WITH A VIEW TO THE APPOINTMENT OF THE EUROPEAN OMBUDSMAN

Having regard to Articles 21 and 195 of the Treaty establishing the European Community and to Article 107d of the Euratom Treaty,

Having regard to the regulations and general conditions governing the performance of the Ombudsman's duties adopted by the European Parliament on 9 March 1994 (OJ L 113, 4.5.1994) and amended by its decision of 14 March 2002 (OJ L 92, 9.4.2002) and, in particular, to Article 6 and Article 7 thereof, contained in Annex X of the European Parliament's Rules of Procedure,

Having regard, also, to Rule 194 of the European Parliament's Rules of Procedure,

Whereas this appointment of the European Ombudsman by the European Parliament will be for the duration of the 2004-2009 parliamentary term;

Whereas the European Ombudsman is eligible for re-appointment;

Whereas the European Ombudsman is chosen from among persons who are European Union citizens, have full civil and political rights, offer every guarantee of independence, and meet the conditions required for the exercise of the highest judicial office in the country or have the acknowledged competence and experience to undertake the duties of the Ombudsman,

Applications are hereby invited with a view to the appointment of the European Ombudsman by the European Parliament.

2.

Applicants must have the support of a minimum of thirty-seven Members of the European Parliament who are citizens of at least two Member States and must provide all supporting documents needed to show conclusively that they fulfil the conditions required by the regulations and general conditions governing the performance of the Ombudsman's duties and a solemn undertaking on the part of the candidate that, if appointed, he/she will not engage in any other professional occupation, whether gainful or not, during his/her term of office.

Applications must be forwarded to the President of the European Parliament no later than 30 September 2004 (1).

In Section III: Commission, Volume II, pages 931 and 934, in Item 17 01 04 03 and Article 17 02 01 respectively, at the end of the Remarks, the following paragraph should be added:

‘Any revenue from the candidate countries' contribution to participation in Community programmes, entered in Item 6 0 9 1 of the statement of revenue, may give rise to the provision of additional appropriations, according to the same ratio as between the amount authorised for expenditure on administrative management and the total appropriations entered for the programme, pursuant to Article 18(1)(d) of the Financial Regulation.’
