COMMON POSITION of 24 July 1997 defined by the Council on the basis of Article J.2 of the Treaty on European Union, on the Korean Peninsular Energy Development Organisation (KEDO) (97/484/CFSP)

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article J.2 thereof,

Whereas the European Council meeting on 24 and 25 June 1994 in Corfu attached particular importance to compliance by all parties with the Treaty on the Non-Proliferation of Nuclear Weapons;

Whereas on 5 March 1996 the Council adopted Joint Action No 96/195/CFSP (1) the objective of which is to contribute to an overall solution to the issue of nuclear proliferation in the Korean Peninsula;

Whereas the European Atomic Energy Community (EAEC) has negotiated accession to the Korean Peninsular Energy Development Organization (KEDO) with a view to supporting KEDO's objectives, thereby providing significant funds over a five-year period;

Whereas contributions are being made on a national basis by individual Member States; whereas these developments constitute key elements of the European Union's commitment to resolving the issue of nuclear proliferation and to the maintenance of peace and security in the Korean peninsula;

Whereas, with regard to the conclusion by the Commission of the Agreement on terms and conditions of the accession of the EAEC to KEDO, the Council and the Commission agreed that, if the executive board of KEDO were to address a matter falling outside EAEC competencies, it is the Presidency which shall take the floor, to express a position on such matters,

HAS DEFINED THE FOLLOWING COMMON POSITION:

1. For matters falling outside EAEC competencies, the position in the KEDO Executive Board shall be determined by the Council and expressed by the Presidency.

2. To this end, the Commission, which is the single point of contact in connection with the activities of the KEDO Executive Board, shall immediately inform the Presidency of any CFSP matters to be discussed at KEDO Executive Board meetings.

3. This common position shall be published in the Official Journal.
