A4-0493/98 Decision on the joint text approved by the Conciliation Committee for a European Parliament and Council Decision concerning the fifth framework programme of the European Community for research, technological development and demonstration activities (1998-2002) (3626/98 - C4-0646/98 - 97/0119(COD))(Codecision procedure: third reading) The European Parliament, - having regard to the joint text approved by the Conciliation Committee and the relevant declarations (3626/98 - C4-0646/98 - 97/0119(COD)), - having regard to its opinion at first reading ((OJ C 14, 19.1.1998, p. 171.)) on the Commission proposal to Parliament and the Council COM(97)0142, COM(97)0439 and COM(98)0008 ((OJ C 173, 7.6.1997, p. 10; OJ C 291, 25.9.1997, p. 15; OJ C 106, 6.4.1998, p. 1. .)), - having regard to its decision on the common position ((OJ C 210, 6.7.1998, p. 131.)), - having regard to the Commission's opinion on Parliament's amendments to the common position (COM(98)0422 - C4- 0415/98), - having regard to Article 189b(5) of the EC Treaty, - having regard to Rule 77(2) of its Rules of Procedure, - having regard to the report of its delegation to the Conciliation Committee (A4-0493/98), 1. Approves the joint text and the relevant declarations, including the declaration annexed to the present decision; 2. Instructs its President to sign the act with the President of the Council, pursuant to Article 191(1) of the EC Treaty; 3. Instructs its Secretary-General to duly sign the act and, in agreement with the Secretary-General of the Council, to have it published in the Official Journal; 4. Instructs its President to forward this decision to the Council and Commission. ANNEX DECLARATION BY THE EUROPEAN PARLIAMENT on the joint text, approved by the Conciliation Committee, for a European Parliament and Council Decision concerning the fifth framework programme of the European Community for research, technological development and demonstration activities (1998-2002) (3626/98 - C4-0646/98 - 97/0119(COD)) ad Article 2 (1)(c) 'The European Parliament states that the reference to the conditions provided for in Article 130i(1) of the Treaty means that the act it adopts can refer to the scientific and technological objectives of the programme and the activities it foresees, the priorities of such activities as well as their broad lines, the maximum overall amount, the detailed rules for Community financial participation in the programme and the respective shares in each of the activities provided for. Furthermore, the European Parliament recalls that under Article 130i(2) of the Treaty, the framework programme may be adapted or supplemented as the situation changes, on the basis of a Commission proposal, and insofar as the legislative authority considers it necessary.¨
