Form of order sought

The applicant claims that the Court should:

Annul the decision of 16 May 2025, by which the European Commission rejected the applicant’s complaint regarding alleged unlawful aid granted by the Republic of Bulgaria (the ‘contested decision’);

Order the defendant to bear its own costs as well as the applicant’s costs for the current proceedings.

Pleas in law and main arguments

In support of the action, the applicant relies on six pleas in law.

1.

First plea in law, alleging that the contested decision infringes the obligation to state reasons.

2.

Second plea in law, alleging that the contested decision infringes Article 41(2) of the Charter of Fundamental Rights of the EU.

3.

Third plea in law, alleging that the contested decision is vitiated by an error of fact.

4.

Fourth plea, alleging that the contested decision infringes Articles 1(h) and 24(2) of Council Regulation (EU) 2015/1589.

5.

Fifth plea in law, alleging that the contested decision infringed the applicant’s procedural rights under the second subparagraph of Article 24(2) of Council Regulation (EU) 2015/1589.

6.

Sixth plea in law, alleging on a subsidiary basis, that the contested decision is vitiated by errors of assessment and errors of fact.
