Are Article 157 TFEU, Articles 21 and 23 of the Charter, Articles 4, 14(1)(c) and 15 of Directive 2006/54/EC (1) and Article 10(2) of Directive (EU) 2019/1158 (2) to be interpreted as precluding a provision in a collective agreement under which a one-off special payment agreed in the collective agreement is made only to employees who are in receipt of pay at the time of that one-off payment, so that employees who, at the time of the special payment, are on unpaid pregnancy leave, special pregnancy leave, parental leave or childcare leave are denied the special payment?

Are the aforementioned rules and provisions to be interpreted as precluding a provision in a collective agreement under which a one-off special payment agreed in the collective agreement is made in proportion to the working hours of employees who take parental leave or childcare leave in the form of part-time work and is thus made on the basis of the same principles which apply to other part-time employees?
