Should Articles 41 and 47 of the Charter of Fundamental Rights of the European Union be interpreted as meaning that the exercise of powers in matters where competence is shared between the European Union and the Member States, such as the environment and energy, requires that the national authorities exercising those powers apply the principles laid down in those articles, such as the right of the developer to have its case dealt with fairly and to obtain a reasoned decision on the merits and access to the file, the principle of transparency, the right to effective judicial protection and the right of defence?

Should Articles 6(3) and 8 of Directive 2011/92/EU of 13 December 2011 (1) be interpreted as meaning that it would be contrary to those provisions if the national body competent to authorise the renewable generation installation were to prevent consideration of the documentation required to be examined in the environmental assessment procedure by failing to forward the reports and submissions obtained during the public information and consultation procedure, and that would simply result in the file being closed?

3.

Should Articles 2, 15 and 16 of Directive (EU) 2018/2001 of 11 December 2018 (2) be interpreted as meaning that it is contrary to those provisions for dual procedures (competent and environmental) to be used to obstruct the respective procedures, to conceal the file and, in short, to hinder the deployment of such installations by failing to issue a decision on the substance of their environmental and energy-related merits?
